The Bihar Municipal Ward Committee (Community Participation)

(Amendment) Rules, 2017.

No 5N.Vi/vividh-21/17-6533/UD&HD— In exercise of the powers conferred by section 419

of Bihar Municipal Act, 2007 the Governor of Bihar is pleased to make the following Rule to amend

the Bihar Municipal Ward Committee (Community Participation) Rules, 2013:-

1. Short title, extent and commencement—

(1) These Rules may be called The Bihar Municipal Ward Committee (Community

Participation) (Amendment) Rules, 2017.

(2) It shall extend to the whole Municipal area of the State of Bihar.

(3) It shall come into force at once

2. Clause (a) of Rule 3 of the said Rules, 2013 shall be substituted by following—

“(a) determine that municipality with population of forty thousand and above shall

have an area sabha in each ward;

3. The following clauses (g), (h), (i), (j), (k) and (l) shall be added after clause (f) of

subrule (3) of Rule 18 of the said Rules, 2013—

"(g) It will the power to realise the user fees for the civil facilities provided by the

Municipalities:

(h) Collected amount will be deposited in the Bank Account maintained in the

Notified Commercial Bank in the name of Ward Samittee.

(i)

Operation of the said Bank Account will be by joint signatures of the Chairman

and the secretary of the Ward Committee.

(j)

First meeting of the Word Committee will be held immediately after its

constitution and thereafter the meeting will be conven at least once in three

months.

(k) Expenditure of collected amount will be made on the maintenance of the

infrastructures relating to the civil facilities provided by the Municipality.

(l)

Maintenance of account and statement of income and expenditure will be

published publically by the Ward Committee."

4. The following clause (f) shall be added after clause (e) of sub rule (1) of Rule 19 of

The said Rules 2013—

" (f) to manage, maintain and monitor the schemes conducted in the ward."
