GSR 10 Dated The 21st December 2017— In exercise of the powers conferred by section-3
of the Essential Commodities Act 1955 (Central Act 10 of 1955) read with the order of the
Government of India in the Ministry of Consumer Affairs, Food and Public Distribution, published
under order S.O. 3348(E) dated 28th October 2016 and S.O.-3443(E) dated 27th October 2017 and in
view of Removal of (Licensing Requirements, Stock Limits and Movement Restrictions) on
Specified Foodstuffs Order 2016 and clause (5) of the Sugar (control) Order, 1966 and with prior
concurrence of Government of India the Governor of Bihar is pleased to make the following
Amendment in the order issued vide Notification no. GSR 49 dated 17th October 1985 for the storage
limit of trade articles under clause (3) of Bihar Trade Articles (Licensing Unification) Order 1984,
published by Food and Consumer Protection Department, Bihar, Patna under order GSR - 9, dated
19th April 1984, Namely :-
Amendment
No dealer of sugar shall hold any stock of vacuum pan sugar or khandsari (open pan sugar)
for a period exceeding thirty days from the date of receipt by him of such stock and shall not keep in
stock at any time vacuum pan sugar/khandsari in excess of the quantities as follows -
(a)
Wholesale dealer
-
5000 (Five thousand) Quintals;
(b)
Retail dealer
-
100 (One hundred) Quintals;
Provided that nothing contained in this order shall apply to the holding or keeping of stock
of sugar/khandsari -
(i)
On Government account; or
(ii)
By the licensed dealers nominated by the State Government or an officer authorised
by it to hold stock for distribution through fair price shops; or
(iii)
By the Food Corporation of India/Bihar State Food and Civil Supplies Corporation,
stock;
2. Previously issued corresponding notifications/orders shall be deemed amended upto
this extent.
3. This notification shall come into force at once.
