"However, the Court would like to observe that a large number of cases are coming to this

Court in respect of employees who were earlier in the Government Corporation and by different

decisions taken at different times by the government upon the Corporation became sick were taken

into State Government service. Sometime the government took a decision to grant continuity of

service. Sometime it took decision to give pay protection. Sometime they were treated as fresh

appointees. Thus, denying them of any pensionary benefit. It is high time that the government should

take a uniform decision in the matter so that all employees who were similarly situated and brought

to government service are treated similarly so that no person or group has grievance against them.

They all should be treated in non discriminatory manner. It would be for the Principal Secretary of

General Administration Department to consider and decide the policy but in the fact as of now the

petitioner cannot be granted any relief.

Department, Govt. of Bihar, for necessary action. The writ petition is disposed of accordingly".

consideration before this Court his affidavit is of paramount importance.

Let the matter be listed after three weeks as prayed on behalf of the State Counsel."
