The 12^th March 2018

No. Plan. 1/Est.12-02/2011-1226/P&D—In exercise of the powers conferred under the

proviso to Article-309 of the Constitution of India, the Governor of Bihar is hereby pleased to

make the following Rules to regulate appointment and service conditions at the Bihar Local Area

Subordinate Engineering (civil) Cadre—

Part-I

1. Short title, extent and commencement.—

(1)

These Rules may be called the “Bihar Local Area Subordinate Engineering (Civil)

Cadre Recruitment Rules, 2018 ”

(2)

It shall extend to the whole of the State of Bihar.

(3)

It shall come in force at once.

2. Definition.— In these Rules, unless anything requires in the subject or context —

(i)

“Government ” means the Government of Bihar;

(ii)

“Department” means Planning and Development Department, Government of

Bihar;

(iii)

“Appointing Authority” means the Secretary/ Principal Secretary, Planning and

Development Department or any other officer authorized by the department for

this purpose;

(iv)

“Commission” means the Bihar Technical Staff Selection Commission

or

the

Bihar Staff Selection Commission till it starts functioning;

(v)

“Cadre” means the Bihar Local Area Subordinate Engineering (civil) Cadre;

(vi)

“Member of Cadre” means, all persons, regularly appointed and working under

the provisions of these Rules.

3. Constitution of the cadre.— “Junior Engineer (Civil)” shall be the post of basic

category under the Bihar Local Area Subordinate Engineering (civil) Cadre. The pay scale and

grade pay for this post, shall be determined by the Government, from time to time.

4. Sanctioned strength.—The sanctioned strength of this Cadre shall be determined by

the State Government, from time to time.

5. Reservation.—The provisions of the Bihar Reservation of Vacancies in posts and

services (for Schedule castes, Scheduled Tribes and other Backward Classes) Act, 1991 (Act-

3,1992) (as amended from time to time) and the Rules made thereunder and the horizontal

reservation for women issued by Resolution No.-963 date 20-01-2016 and the roaster and

reservation as prescribed by the State Government, from time to time, shall be applicable to

the appointments.

Part-II

Appointment in the cadre.

6. Appointment.—First appointment in this Cadre will be, by direct recruitment, to the

posts of Junior Engineer (Civil). There will be no entry to this post on the basis of promotion.

7. The appointing authority shall calculate the categorywise vacancies on 1^st April of every

year and accordingly, the reservation categorywise requisition will be sent through the department

to the Commission by 30^th April of every year.

8. On the basis of requisition made under Rule-7, the Commission, in such a manner as it

may deem proper, shall advertise reservation categorywise vacancies of this cadre for appointment

to be filled by direct recruitment.

9. Qualifications.—

(1)

Qualifications for appointment in this cadre shall be as follows—

(i)

A candidate must be a citizen of India;of the Gvernment.

(ii)

For the subordinate Engineering Cadre, Diploma or equivalent qualification

holder in civil engineering.

(iii)

Technical eligibilities/ qualification for selection—

(a)

Diploma holder in Civil Engineering from the Institutes recognized by

AICTE, who have been granted Diploma by the concerned Technical

Education Board/University.

(b)

Diploma conferred in Civil Engineering in Non-Distance Mode by Deemed

University established under the provisions of the UGC Act provided that the

said Deemed University has received sanction of U.G.C. to conduct the

syllabus of Diploma in Civil Engineering.

(2)

Age of applicant must be minimum 18 (eighteen) years as on first August of the

year of requisition. Maximum age shall be within the reservation categorywise

Age limit determined by the State Government (General Administration

Department) from time to time but exemption of maximum 10 (ten) years of

period of contractual appointment in the maximum age-limit will be admissible to

the Junior Engineers (Civil), already employed on contract basis.

10. Procedure of selection.—

(1)

Selection to the posts of basic category of this cadre i.e Junior Engineer (Civil)

shall be made by the Commission on the basis of percentage of marks obtained in

Diploma or equivalent qualification. Such candidates having experience of

working on the post of Junior Engineer (Civil) on contract basis under the

Government

of

Bihar

or

in

any

undertaking/

Corporation/

Body/

Authority/Autonomous body under the Government of Bihar, who fulfill the

qualifications of the recruitment in this cadre, shall be given preference by giving

additional marks according to sub rule (2) (b)of this Rule.

(2)

Merit list of candidates shall be prepared on the basis of the following—

Full Marks

(a)

On the basis of percentage of marks obtained in Diploma (Civil)

or equivalent qualification -75

(b)

Maximum weightage for the working experience on contract

basis -25

(Weightage of per working year shall be 5 marks Maximum limit of

which will be up to 25 marks.

For Part of any year, obtained proportionate marks by dividing by 365

to the no. of working days in that year multiplying by number 5, will

be added)

Total- 100 Marks

(3)

Determination of working period on the contract basis shall be made on the basis

of payment certificate issued by their respective controlling officers. For this, the

period up to cut off date mentioned in the advertisement published by the

Commission shall be calculated for the working experience.

(4)Appointment of the Civil Diploma holder candidates as Junior Engineer (civil)

shall made in the following manner:—

(a)

As per Rule-5 of Bihar Local Area Subordinate Engineering (Civil) Cadre

Recruitment Rules, 2018, 40% seats of total vacant posts shall be reserved for the

candidates holding Civil Diploma from the Government Polytechnic Institutes

under the state as per categorywise reservation merit list which will be filled

reservation categorywise on the basis of merit list prepared under procedure

determined by above Rule 10 (2).

(b)

Remaining vacancies shall be filled reservation categorywise on the basis of

merit list prepared under procedure determined in Rule 10 (2) on the basis of

determined eligibilities/ qualifications determined by Rule-9 (1) (iii) of Bihar

Local Area subordinate Engineering (Civil) Cadre Recruitment Rules, 2018.

(c)

After filling vacant posts of para (b) through general procedure, the remaining

reserved posts of para (a) will be filled in order of reservation categorywise merit,

by selection of candidates passing from the Government Polytechnics Institutes

under the state.

11. The Commission shall prepare final merit-list of selected candidates according to

Rule-10 and shall recommend to the Government for appointment. The panel of candidates

recommended by the Commission shall be valid for one year.

Par-III

Promotion and seniority

12. Promotion.—Promotion from Junior Engineer (Civil) to higher posts will be under the

provision determined in the Bihar Engineering Service Cadre Rules.

13. Determination of Seniority.— seniority to the posts of Junior Engineer (Civil) shall

be determined by the department in accordance with the merit order recommended by the

Commission. Seniority of already appointed and working Junior Engineers (Civil) shall be

unaffected.

Part-IV

Miscellaneous

14. Discipline, Control and Appeal.—

(1)

The provisions of the Bihar Government servants (Classification, Control and

Appeal) Rules,2005 (as amended from time to time) shall apply to the members of

the Bihar Local Area subordinate Engineering (civil) Cadre in the matters of

discipline, controls and appeals.

(2)

Service conditions particularly not provided under these rules, shall be governed

by the Bihar Service Code and other decisions issued by the State Government,

from time to time.

15. Removal of Difficulties.— If any difficulty arises in giving effect to any of the

provisions of these Rules, the Government may, after consultation with the Law Department, by

order published in the Official Gazette, make such provisions which is not inconsistent with the

provisions of these Rules, and may appear necessary or expedient for removing the difficulty.

16. Residual matters.—

(1)

All residual matters of this cadre shall be under the jurisdiction of Planning and

Development Department, Bihar, Patna.

(2)

In case of any doubt in interpretation of any rule of these Rules, the same will be

referred to the Department and the decision of the Department, after consultation

with Law Department, shall be final.

17. Repeal and savings.—

(1)

The existing rules & regulations in this context are hereby repealed.

(2)

Notwithstanding such repeal, anything done or any action taken under the

provisions of existing rules/ regulations shall be deemed to be done or taken under

the provisions of these Rules as if these Rules were come into force on the day on

which such thing was done or such action was taken.
