The 4^th April 2018

No. 2@cS0 1&101@12&74—In exercise of the powers conferred under the provision to

Article-309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the

following Rules to amend the Bihar Public Health Engineering Department Subordinate

Engineering (Civil/Mechanical) cadre Recruitment Rules, 2016" :-

Part-I

Short title, extent and commencement—

(1)

These Rules may be called the Bihar Public Health Engineering Department

Subordinate Engineering (Civil/Mechanical) cadre Recruitment (amendment)

Rules-2018—

(2)

It shall extend to the whole of the State of Bihar.

(3)

It shall come in force at once.

Substitution of Rule-5 of Bihar Public Health Engineering Department

Subordinate Engineering (Civil/Mechanical) cadre Recruitment Rules, 2016:-

Rule-5 of the said Rules, 2016 shall be substituted by the following:-

"5.

Reservation—The provisions of the Bihar Reservation of vacancies in

posts and services (for Scheduled Casts, Scheduled Tribes and other

Backward classes) Act,1991 (Act-3,1992) (as amended from time to time)

and the Rules made thereunder shall be applicable to the appointment in

this cadre."

Substitution of clause (iii) of Subrule (1) of Rule- 9 of Bihar Public Health

Engineering Department Subordinate Engineering (Civil/Mechanical) cadre

Recruitment Rules, 2016— Clause (iii) of Subrule (1) of Rule- 9 of the said

Rules, 2016 shall be substituted by the following—

" (iii)- Technical qualification/eligibilities for selection—

(a)

Diploma holder in Civil/Mechanical Engineering from the

Institutes recognized by AICTE, which have been given sanction

to conduct Diploma courses from AICTE /University, OR

(b)

Diploma in Civil/Mechanical Engineering by Non-Distance Mode

Diploma from Deemed University established under UGC Act

provided that the said DEEMED University has obtained the

sanction of the UGC,, to conduct the Syllabus of diploma in Civil/

Mechanical Engineering.''

Substitution of Rule- 10 of The Bihar Public Health Engineering Department

subordinate (Civil/Mechanical) Cader Recruitment Rules, 2016. Rule- 10 of the

said Rules, 2016 shall be substituted by the following :-

"10.

Procedure of selection—(1) Selection to the posts of basic category of Junior

Engineer (Civil/Mechanical) of this cadre shall be made by the Commission on

the basis of percentage of marks obtained in Diploma or equivalent qualification.

Such candidates having experience of working on the post of Junior Engineer

(Civil/Mechanical) on contract basis under the Government of Bihar or in any

Undertaking/Corporation/Body/

Authority/

Autonomous

Body

under

the

Governmet of Bihar, who fulfil the qualifications of the recruitment in this cadre,

shall be given preference by giving additional marks according to sub rule (2) (b)

of this Rule.

(2)

Merit list of candidates shall be prepared on the following grounds—

Full Marks

(a)

On the basis of percentage of marks obtained in

Diploma or equivalent qualification -75

(b)

Maximum weightage for the working experience

on contract basis (weightage of per working year shall

be 5 marks maximum limit of which will be up to 25

marks. For part of any year, obtained proportionate mark

by dividing by 365 to the no. of working days in that year

multiplying by number 5, will be added) - 25

Total - 100 Marks

(3)

Determination of working period on the contract basis shall be made on the basis

of Payment Certificate issued by their respective Controlling Officers. For this, the

period up to the cut-off date mentioned in the advertisement published by the

Commission may be calculated for the working experience.

(4)

Appointment of the Civil/Mechanical Diploma holder candidates as Junior

Engineer (Civil/Mechanical) shall be made in the following manner—

(a)

As per Rule-5 of Bihar Public Health Engineering Department

Subordinate Engineering (Civil/Mechanical) Cadre Recruitment Rules,

2016, 40% seats of total vacant posts shall be reserved for the candidates

holding Civil/Mechanical Diploma from the Government Polytechnic

Institutes under the state which will be filled up reservation category-wise

on the basis of merit list prepared under the proccedure determind by

above Rule 10 (2).

(b)

Remaining vacancies shall be filled reservation catagory wise on the basis

of procedure determind in rule 10 (2) and thequalification/eligibilities

determind by Rule-9 (1) (iii) of Bihar Public Health Engineering

Department Subordinate Engineering (Civil/Mechanical), Cadre

Recruitment Rules, 2016.

(c)

After filling vacant posts of clause (b) of this subrule through

general procedure, the remaining reserved posts of clause (a) of this

subrule will be filled by selection in order of reservation categoriwise

merit amongest the candidates passing from the Government Polytechnics

under the state."

5. Rule- 11 of Bihar Public Health Engineering Department Subordinate Engineering

(Civil/Mechanical) Cadre Recruitment Rules, 2016 shall be substituted by the following :-

"11. The Commission shall prepare final merit list of selected candidates according to

Rule-10 and shall recommend to the Government for appointment. The panel of candidates

recommended by the Commission shall be valid for one year."
