No. 1Pa/Sa-1-601/2014/6130@ P.R.—In exercise of the powers conferred under proviso to
Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following
Rules for regulating the recruitment and conditions of service of the clerical cadre in the regional
offices under the control of the Panchayati Raj Department :—
1. Short title, extent and commencement.—
(1)
These Rules may be called as the “Panchayati Raj Department Regional Clerical
Cadre (Recruitment and Conditions of Service) Rules, 2018.”
(2)
It shall extend to the whole of the State of Bihar.
(3)
It shall come into force with immediate effect.
2. Definitions .- In these rules, unless otherwise required in the subject or context:—
(i)
"Cadre" means clerical cadre of regional offices under the control of Panchayati
Raj Department;
(ii)
"Regional Offices" means offices of the Divisional Deputy Director (Panchayat),
District Panchayat Raj Officer, District Panchayat Raj Training Institute and
Mukhiya-Sarpanch Training Institute;
(iii)
"Commission" means Bihar Staff Selection Commission;
(iv)
"Appointing Authority" means Principal Secretary/Secretary of the Panchayati Raj
Department;
(v)
"Appointed Date" means the date of coming into force of these Rules;
(vi)
"Member" means a person appointed in this cadre and it includes all persons already
appointed in this cadre before coming into force of these Rules;
(vii)
"Appointment on compassionate ground" means appointment of any one of the
dependents of the government servant, who died in harness, on compassionate
ground according to relevant circulars directions and instructions of the General
Administration Department.
3. Structure of the cadre.– The cadre structure of the clerical cadre shall be hereunder.
The cadre strength and Pay Scale/ Pay Level of the aforementioned posts shall be the such as
it may be sanctioned by the State Government/Finance Department, from time to time.

4. Recruitment.—
(1)
85% posts of Lower Division Clerk shall be filled by direct recruitment and 15%
posts shall be filled from amongst office attendants holding minimum Intermediate
qualification. Out of 85% posts for direct recruitment, 10% posts shall be reserved
for appointment on compassionate ground.
(2)
Direct recruitments, shall be made in the category of Lower Division Clerk on the
recommendation of the Commission.
(3)
The Appointing Authority shall calculate the vacancy on the basis of position as on
1st April each year and shall make requisition available to the Commission by 30th
April.
(4)
The Commission shall advertise vacancies and after selecting successful candidates
on the basis of Competitive Examination, shall recommend names of the candidates
in order of merit to the concerned Appointing Authority. The merit list shall remain
valid for one year from the date of receipt of recommendation.
(5)
After verification of certificates and previous antecedents the Appointing Authority
shall appoint the candidates on probation for two years.
5. Qualification.—
(1)
The minimum educational qualification for direct recruitment shall be the
intermediate (10+2) pass or equivalent, with knowledge of computer operation and
computer typing.
(2)
Minimum age for recruitment shall be 18 years and maximum age shall be the same
as may be determined by the State Government (General Administration
Department), from time to time.
6. Reservation.— It shall be necessary to comply the provisions related with
reservation/roster notified by the State Government from time to time in the recruitment and
promotion.
7. Recruitment by promotion.—
(1)
The Appointing Authority shall prepare seniority list of office attendants holding
intermediate or equivalent qualification.
(2)
Promotion will be given according to seniority on the basis of recommendation of
the Departmental Promotion Committee.
8. Probation.— Each recruitment shall be on probation for two year. On being not
satisfactory service in the probation period it may be extended for one year by the Appointing
Authority with reasons to be recorded in writing. If the service is not found satisfactory even in the
extended period also, the person concerned shall be terminated from service.
9. Departmental Examination.—
(1)
The Departmental Examination will be conducted by the Central Examination
Committee of the Board of Revenue.
(2)
The subject and sullybus for the departmental examination shall be decided by the
central examination committee, Board of Revenue.
10. Confirmation.— A probationer shall be confirmed after satisfactory completion of the
probation period and passing of the Departmental Examination as well as the computer
competency test.
11. Seniority.—The inter-se seniority of the members of the cadre shall be according to the
merit list determined by the Commission;
Provided that the inter-se-seniority of the members of the cadre, determined before coming
into force of these Rules shall remain unchangeable:
Provided further that persons appointed on compassionate ground shall be junior to such
persons who have been appointed on the basis of Competitive Examination in the concerned
requirement year:
Provided further also that person appointed by promotion in a recruitment year shall be
Junior to persons appointed through Competitive Examination in the concerned requirement year;

12. Promotion.—
(1)
Promotion from basic category to higher category may be given on completion of
Kalawadhi determined by the General Administration Department, from time to
time, and on the recommendation of the Departmental Promotion Committee.
(2)
The Departmental Promotion Committee shall be constituted by issuance of separate
departmental order.
13. Residual Matters.— With respect to such matters which are not specifically covered
under these rules, the members of the cadre will be governed by the Rules, Regulations or orders
applicable to the employees of equivalent level of the State Government.
14. Removal of Difficulties.— The Department may issue such general or special after
consultation of the Law Department directions which are consistent with the provisions of these
Rules, from time to time, which may be necessary for removal of difficulties arising in
implementation of any of the provisions of these rules.
15. Interpretations—Where any doubt arises with respect to interpretation of any provision
of these rules, the matter shall be determined by the Panchayati Raj Department in consultation with
the Law Department and such determination shall be final.
16. Repeal and Saving—
(1)
All resolutions and instructions issued earlier by the Department with respect to this
Cadre are hereby repealed.
(2)
Notwithstanding such repeal, any work done or any action taken under said
resolutions, instructions shall deemed to be done or taken under these Rules as if
these Rules were in force on the date such work was done or such action was taken.
