The 13^th December 2018

S. O. 276 dated 17^th December 2018—In compliance of the order dated 04-12-2018

passed by Hon'ble Supreme Court, New Delhi in writ Petition (Civil) No.-699/2016 (Ashwini

Kumar Upadhyay Vs. Union of India and Anr.) the State Government of Bihar, in

consultation with the High Court Of Judicature at Patna, in modification of the Law

Departmental Notification memo no.-2574 dated 14.03.2018 issued in this context,

designates the court of ADJ.-III for the trial of Criminal cases triable by the sessions courts

and the court of senior most ACJM for the trial of Criminal cases triable by a magistrate in

each district as the Special Court for the trial of the Criminal Cases relating to the (sitting

and former) Members of Parliament (M.Ps) and State Legislatures (M.L.As & M.L.Cs) of

The State of Bihar, whose Jurisdiction will be the respective local limits of the concerned

district.

If in any district, ADJ-III is not available, the court of ADJ-II and ADJ-II is also

not available, the court of ADJ-I is designated as the special court for the trial

of aforesaid cases.

The departmental notification memo no.-2574 dated 14.03.2018 already issued

shall be deemed to be amended to this extent.

This notification shall come into force with immediate effect.
