sec-211 of the Motor Vehicle Act, 1988, (Act 59,1988) the Governor of Bihar desires to make
amendment in the Bihar Motor Vehicle Rule, 1992 by the following draft which is hereby published
for the information of the persons to be affected by it as required by section 212 of the Act and it is
hereby given notice that the said draft will be available on the website of Transport Department
transport.bih.nic.in. for 15 days for inviting objection and suggestions related to the said draft.
Draft of Notification
In exercise of the powers conferred by sec-211 of the Motor Vehicle Act 1988, (Act
59,1988) the Governor of Bihar is pleased to make the following amendment in The Bihar Motor
Vehicle Rule, 1992 the Prior publication of which required under section 212 of the Act has been
done through Notification No.- ......... dated ………....
1.
Short name, extension & commencement. (1) These Rule may be called the Bihar
Motor Vehicle (Amendment) Rule 2019.
(2)
It shall extend to the whole of State of Bihar.
(3)
It shall come into force on the date of its final publication in the Bihar
Gazette.

To encourage the operation of software based commercial vehicle including
Taxi and Motor Bike Taxi, rule 74 (c) of Bihar Motorbike rule, 1992 is
substituted by following :-
"(c)
Fee for special permit which is issued under subsection 8 of section 88 of MV
Act, 1988 shall be as follows :-
Types of Vehicle
Payable Fee
(1) For every seven days or any part thereof
Rs. 200
Fee for temporary permit which is issued under subsection 87 of MV Act, 1988
shall be as follows :-

Rule- 31 and Rule- 82 of Bihar Motor Vehicle Rule, 1992 which was amended
by rule- 3 of notification no.- 2703, dated-22.05.2017 of Transport Department
is substituted by following respectively :-
"31. Badge of conductors of the stage carriages :-
(1)
A conductor of stage carriage shall display on his left chest a badge in the form
illustrated in the Second Schedule, inscribed with the particulars specified in
the said schedule.
(2)
No conductor of a stage carriage shall display the badge held by him if his
conductor's licence is suspended or revoked by an authority or if his
conductor's licence has ceased to be valid by efflux of time.
(3)
A conductor shall not hold more than one such badge issued by an authority in
the state.
(4)
If at any time a conductor's licence is suspended or cancelled by a competent
authority or by any court or ceases to be valid, the conductor shall, within
seven days, surrender the badge to the authority by which it was issued.
(5)
Fee for issue of badge of driver/conductor:-
(i)
Fee for badge of driver . - Rs.100
(ii) Fee for badge of conductor. - Rs.100
82.
Renewal of permits or countersignature:-
(1)
An application for renewal of a permit or a countersignature of a permit shall
be made in the form prescribed under rule 70, to the Trasport Authority by
which the permit or countersignature of a permit was issued and shall be
accompanied by the permit or the countersignature, as the case may be, and the
fee prescribed under rule 74.

(2)
Subject to the provisions of sub-section (9) of Section 52 and sub-section (4) of
Section 81, the Transport Authority may renew the permit or the
countersignature, as the case may be.
(3)
The Original Transport Authority which renews a permit may unless any
Transport Authority by which the permit has been countersigned has, by
general or special resolution, otherwise directed, like-wise renew the
countersignature of the permit, and shall intimate the fact of renewal of permit
and its countersignature to the Transport
Authority by which the permit was
originally countersigned.
(4)
Unless the countersignature is renewed under this rule, it shall be of no effect
beyond the date of expiry stated therein.
(5)
The Original Transport Authority which renews a permit to be operative in any
other region or regions in accordance with the provisions of rule 81 shall
intimate, the fact of renewal of permit to the Transport Authority of that region
or regions.
(6)
The Original Transport Authority which renews a permit to be operative in any
other region or state by way of a countersignature on it, shall intimate, the fact
of renewal of permit, to the Transport Authority by which the permit has been
countersigned.
(7)
The Transport Authority which renews a countersignature of a permit under
sub- rule (2), shall intimate the fact of renewal of countersignature to the
Transport Authority by which the permit was issued.
(8)
The following Late fee shall be payable if an owner of vehicle fails to apply for
renewal within 15 days from the date of expiry of a Temporary Permit/
permanent Permit :-
