CHAPTER -1
1.
Short title, extent and commencement.—
(i)
These Guidelines will be known as Guidelines (2017) in connection with the
conditions for Service of Employees of Secondary and Senior Secondary Schools
(+2 colleges) affiliated by Bihar School Examination Board,
(ii)
This will extend to the whole of the state of Bihar.
(iii) It shall come into force from the date it is notified in the official gazette.
CHAPTER-2
2.
Definitions- In these Guidelines, unless there is anything contrary in the subject or
context.—
(i)
"Act" means Bihar School Examination Board Act, 1952
(ii)
"Chairman" means chairman of Bihar School Examination Board.
(iii)
"Academic Director" means Academic Director of Bihar School Examination
Board.
(iv)
"Secretary" means Secretary of Bihar School Examination Board.
(v)
"Director" means- Director of Secondary Education.
(vi)
"Regional Deputy Director" means- An officer of Regional Deputy Director
level posted in divisional headquarter of the state.
(vii)
"District Education Officer" means – In-charge of Education Department at
the district level.
(viii) "Deputy Director" means- Deputy Director of Secondary Education at the
headquarter.
(ix)
“State or Government” means the State Government of Bihar.
(x)
"Recognised Senior Secondary school (+2 colleges)/Secondary School"
means - Senior Secondary school/Secondary School Recognised by Bihar
School Examination Board or by the dissolved Bihar Intermediate Education
Council or affiliated to Bihar school Examination Board receiving grant from
the Government will be treated as previously recognised/affiliated +2 schools
or Inter college / Senior Secondary School.
(xi)
"Principal" means- Teacher appointed as Head of (+2) Higher Secondary
School (Inter College)

(xii)
"Headmaster" means- Teacher appointed as Head of Senior Secondary School
recognised or affiliated to Bihar School Examination Board.
(xiii) "Teacher" means- a person including Principal/Headmaster appointed for
teaching in a Secondary or Senior Secondary School.
(xiv) "B.Ed. degree" means- teachers training from a recognised training institution
prior to enactment of National teacher education Council Act or after the
enactment of the said Act, teacher training degree from a training institution
recognised by National Teacher Education Council.
(xv)
"Non-teaching staff category" means- persons other than teachers appointed
as Laboratory Assistant, Librarian and other non-teaching staff of Secondary or
Senior Secondary Schools.
(xvi) "Managing Committee" means- Managing Committee for managing
Secondary/Senior Secondary schools recognised by or affiliated to Bihar
School Examination Board.
(xvii) "Permanent Post" means- A sanctioned post with prescribed fixed pay scale
without any time limit.
(xviii) "Temporary post" means- A post with fixed pay for a limited period.
(xix) "Duty" means- Service rendered on a sanctioned post on permanent basis or on
probation or on temporary basis.
(xx)
"Month" means- Month or English calendar.
(xxi) "Probation" means- Service rendered on probation by Principal/Head
master/Teacher/Non-teaching staff on a vacant sanctioned cadre post.
(xxii) “Manager/Correspondent” Means – A person authorised by the Society/Trust
to act on its behalf for that school.
(xxiii) "Language" means the language taught in secondary and senior secondary
sections ie. Hindi and English.
Note:- 1. Words importing the singular number will also include the plural number
and vice versa.
2. Words importing the masculine gender will also include the feminine
gender.
CHAPTER -3
3. Appointments.—
(1)
All appointments to all categories of employees except Group 'D' employees
as per gradation of the State Government shall be made by the Managing
Committee either by direct recruitment or by promotion through a Selection
Committee constituted by the School Society/Trust/GB/ in accordance with
and upon such conditions as the Managing Committee may decide, which
shall be consistent with the norms of the Board/the State Government of
Bihar. Appointment of Group ‘D’ employees will be made by the
principal/Headmaster through a duly constituted Selection Committee.
(2)
Procedure for appointment
Except Group ‘D’ .—
(a)
When a vacancy occur or a new post is sanctioned the Principal/Head
Master will submit a note to the Managing Committee to take
necessary steps to fill the vacancy. The Managing Committee will first
decide whether the post is to be filled by promotion or direct
recruitment and for which will obtain the approval of the
Trust/Society/Governing Body. In case of difference of opinion, the
decision of the Trust/Society/Governing Body will be final and
binding.
(b)
If the post is to be filled by promotion the Managing committee will
cause preparation of list of all those persons who are in the service of
the school and are holding a substantive appointment in the just

immediate lower grade in the cadre and fulfil the prescribed
qualifications and experience etc. for the post to be filled up.
(c)
The list along with all the papers relating to qualifications, experience
and character roll of previous three years of all eligible candidates will
be placed before the appropriate Selection Committee for its
recommendation. The recommendations of the Selection Committee
will be placed before the appropriate appointing authority for order.
(d)
If it is decided to fill the post by open advertisement the post (s) shall
be advertised in at least two (one Hindi & one English) leading daily
newspapers of the State giving all the details including the current
reservation roster of the State Government.
(e)
The information about all the candidate for each post will be prepared
under the supervision of the member authorised by Managing
committee in a tabular form and scrutiny will done by a Three Member
committee of the Managing Committee. This information in the tabular
form will be placed before the concerned Selection Committee at the
time of interview.
(f)
The Selection Committee will prepare a panel strictly according to
merit consisting of two more names than the number of available
vacancy/vacancies and submit it in a sealed cover to the Managing
committee of the School.
(g)
The Managing Committee will order for appointment from the panel
submitted by the Selection Committee in such number as the number
of vacancy exist in the same sequence as in the panel by taking
approval from Trust/Society/Governing Body.
(h)
The Panel will be valid for one year. Time period of the panel may be
extended up to 3 years by taking decision in committee if managing
committee needs so.
(3)
Making of Panel.—Panels will be prepared for Senior Secondary Teachers
separately and subject-wise on the basis of following marks
(i)
For Senior Secondary School Teachers.—
(a) Total marks of Post Graduation -% of marks obtained
(b) Total marks of Graduation -% of marks obtained
(c) Total marks of Senior Secondary/Intermediate/+2 Examination-

Grand total of above five percent (%) of marks will be divided by 5
and the resultant will be the merit point. Five additional points will be added
to a Graduate with Honours in subject/group of subjects for appointment.
In case of up-gradation from Secondary School to Senior Secondary
working teachers with requisite qualifications and 5 years teaching experience
will entitle for 5 additional points.
(ii) For Secondary School Teachers.—
(a) Total marks of Graduation -% of marks obtained
(b) Total marks of Senior Secondary/Intermediate/+2 Examination -

Appointment of candidates possessing B.Ed qualification and
have passed Teacher Eligibility Test conducted by the Bihar
Government, will be made.
If more than one candidate get similar merit point then the person
whose date of birth is earlier will get priority. If the date of birth
will be same, priority will be decided on the basis of alphabetical
order of the first letter of the name.
Note- Employment on compassionate basis of the successor/ dependent of
teaching and non-teaching employee who have died in harness will be
made against the available vacancy of teaching and non-teaching
employee provided they possesses the prescribed eligibility and give
their clear consent for the same. Employment will be made by the
managing committee following the conditions prescribed by the
General Administration Department of the state Government in the
matter of appointment on compassionate basis.
(4)
The Selection Committee .—
(a) For the recruitment of the Head of the school (Principal/Head
Master) .—
(i) The President of the Society/Trust for institutions managed by
society and trust
or
The Chairman of the Managing Committee/governing body for
institutions managed by GB
(ii) An Educationist, nominated by trust/society/governing body
(iii) A person nominated by Board as member for Managing
Committee.
(iv) A person with experience of school administration nominated by
Society/Trust/Governing Body
(v) Principal of a constituent college, nominated by Society/Trust/GB
Provided that among the above 5 members one must
belong to SC/ST/OBC and one as female member.
(b)
For recruitment of teachers and librarian.—
(i) The President/Chairman of the Society/Trust/governing body.
(ii) The Head of the school (Principal/Head Master).
(iii) A person nominated by Board as member for Managing
Committee.
(iv) A subject expert nominated by Society/Trust/governing body
(v) Principal of a constituent college, nominated by Society/Trust/
governing body
Provided that among the above 5 members one must
belong to SC/ST/OBC and one as female member.
(c)
For recruitment of Clerical Staff/Lab. Asstt.—
(i) The President/Chairman of the Society/Trust/governing body.
(ii) The Head of the school (principal/Head Master).
(iii) Person nominated by Board as member for Managing Committee.
(iv) Principal of a constituent college, nominated by Society/
Trust/governing body Provided that among the above 4 members
one must belong to SC/ST/OBC and one as female member.
(d) For recruitment of Group ‘D’ staff.—
(i)
The Head of the School (Principal/Head Master).
(ii) A member of Managing Committee nominated by Society/trust/
governing body

(iii) Member belonging to SC/ST/OBC nominated by the Society/
trust/governing body provided that among the above 3 one
member will be necessarily a female mamber.
(5)
Quorum in the meeting of the Selection Committee will be one less than
number prescribed for the concerned committee but presence of the member
nominated by Board for managing committee and of SC/ST/OBC member
will be essential.
(6)
The Selection Committee shall regulate its own procedure and in the case of
any difference of opinion amongst the members of the Selection Committee
on any matter, it shall be decided by the trust/society/governing body.
(7)
The appointment of every employee of a school shall be made by its
Managing Committee/governing body/Adhoc managing committee.
Provided: Where any selection made by the Selection Committee is
not acceptable to the managing Committee, the managing committee shall
record its reason for such non acceptance and refer the matter to the
trust/society/governing body to decide the same.
(8)
Employees shall be appointed subject to the provisions of this guideline and
they shall have to comply with all the requirements of the provisions
contained herein.
4. Requirements.—
(A) For Senior Secondary Schools.—Each Senior Secondary school with Secondary
classes should have at least 20 teachers including Principal. Out of them -Eight
will be Trained Graduate Teachers (TGTs) for Secondary classes-language-2 (two
Teachers), Mathematics-1 (one teacher), Natural Science-2 (two teachers), Social
Science -1(one teacher), Physical Education-1 (one teacher) and Arts - 1(one
teacher). 11 Post-Graduate Teachers (PGTs) for Senior Secondary classes –
Language -2(Two teachers), Mathematics -1(one teacher), Natural Science -
3(three teachers – Physics-1, Chemistry-1, Biology(Botany/Zoology)-1), Social
Science -2(two teachers), Commerce -2(two teachers) and Computer - 1(one
teacher).
Every Senior Secondary School should have five non-teaching staff
(technical) which will include Laboratory Technician (three), Computer Assistant
(one) and Librarian (one). For administrative work each school will have two non-
teaching (others) staff members – Office Assistants. Every Senior Secondary
School should have at least four Group ‘D’ Staff members – Caretaker (one),
Office Attendant (two) and Guard (one).
Provided that for senior secondary classes there are 30 and more
admissions in any subject and no post has been sanctioned managing committee
may sanction post in that subject with prior permission of Bihar School
Examination Board and may appoint the teacher as per rules.
(B) For Secondary Schools.—Each Secondary school should have at least 11 teachers
including the headmaster. Out of them apart from Headmaster – Ten will be
Trained Graduate Teachers (TGTs) – Language (two teachers), Mathematics (one
teacher), Natural Science (three teachers – Physics -1, Chemistry-1, Biology
(Botany/Zoology)-1), Social Science (one teacher), Physical Education (one
teacher), Computer (one teacher), and arts (one teacher).
Every Secondary School should have 4 non-teaching staff (technical)
which include laboratory Technician (two), Computer Assistant (one) and
Librarian (one). For administrative work each school will have two non-teaching
(others) staff members – Office Assistants. Every Secondary School should have
at least three Group ‘D’ Staff members.

(c) For Inter colleges with recognitions/recommendation/permission to establish by
the erstwhile council (dissolved).—
For Inter colleges recognised by the Council as per directions of the
State Government in the year 1994, in view of notification issued by the Council
(dissolved) at each College apart from one post of Principal there shall be one post
of teacher each in the recognised subject of Arts and Science and two post in
commerce and as per notification, 7 posts of class III of non teaching employee
and 8 post of class IV employees will be treated as sanctioned post.
But if in any Inter College teacher had earlier been appointed on the
2nd post on the basis of direction issued earlier or on the basis of number / strength
of the students for arts and science subject sanctioned, then the 2nd post on which
teacher had been appointed earlier will also be treated as sanctioned.
Such eight subjects which had been deleted and had been included in
the original subject by the direction of the State Government, in such original
subject if two teachers are already appointed, the third post will also be treated as
sanctioned and upon which, the teacher of the deleted subject will be adjusted but
with their retirement the third post will be deleted automatically.
Subject recognised by the Council (dissolved) in which practical
examination is held, for each recognised subject one post of Laboratory technician
will be treated as sanctioned.
Presently at the Intermediate level as per syllabus prescribed, the
number of subjects has been reduced but the number of students are increasing
and as such adjustment of teaching and non teaching employees appointed at
Intermediate colleges earlier and of their posts will be made at the present together
with the subject of the curriculum with the post.
On the basis of number of students, and number of teachers working
prior to dissolved council, additional posts will be sanctioned in the subject
presently being taught with prior permission of Board.
In such recognised college/secondary and senior secondary schools
where student in any subject had been deficient continuously for three years, such
subjects at such institution will be deleted and the post of teacher of the said
subject at such institution will be treated automatically abolished after retirement
of the appointed teacher.
5. Training.—
(i)
All
untrained
teachers
appointed
and
working
from
earlier
in
recognised/affiliated secondary and senior secondary (including intermediate)
schools should have to obtain B.Ed qualification within the period of 3 years
from the commencement of this guideline.
(ii)
Responsibility of training will lies on managing committee/institution.
(iii)
Teachers will be entitled for leave with pay for training once.
(iv)
Managing committee may appoint teacher purely on temporary basis in place of
teacher deputed for training so that teaching of the subject should not be
affected.
(v)
Teachers may obtain B.Ed. qualification through distance education for
institutions recognised by NCTE and for such cases leave with pay will be
granted as per requirement.
(vi)
All Such teachers who fails to obtain training qualification within the limited
time, one more year may be provided to them to complete the training but in
case of failure there shall be binding on managing committee to terminate their
services.
(Note: All such teachers whose services are left for 3 years or less should be free
from mandatory training requirement.)
(vii)
Training regarding computer and lab techniques may be orgainsed for 3rd grade
employees by managing committee.

6. Promotion.—Post of Principal/Headmaster may be filled up by direct recruitment or by
promotion from amongst the teachers of the school having prescribed qualifications and experiences
on seniority cum merit basis on satisfactory service.
7. Cadre.—
i. Teachers cadre including Principal/Headmaster
ii. Non-teaching staff technical cadre
iii. Non-teaching staff other than technical (others) cadre
iv. Group D Cadre
8. Pay Scale.—Pay scale, increment, DA and other facilities of Principal/HM, teacher and
other staff will be fixed with the approval of trust/society/governing body. Pay scale of government
analogous post with same nomenclature may be taken as such by the trust/society/governing body.
9. Reservation.—
(i) For all the categories reservation policy of the State Government of Bihar will be
applicable.
(ii) For all categories separate roaster register will be maintained.
(iii) Every school must have to follow State’s reservation policy cadrewise.
(iv) For those schools where there are appointed personnel, further vacancies will be
filled on reservations per State Government’s Reservation Rules.
(v) In each cadre 3% posts will be filled by physically challenged as prescribed by the
State Government.
Note: Every physically challenged person selected on merit will be appointed.
10. Age.—For appointment and retirement the prescribed age by the government for
analogous posts and changes made by government time to time will be applicable for all cadres.
11. Medical Certificate and Character Certificate etc.—Every employee shall be required
to produce the following certificates on appointment in the school:
(a)
Medical Certificate of fitness from a hospital established or maintained by the
Government or local authority.
(b) Two certificates from educationists or any other respectable members of
Society, not related to the candidate, certifying the character and conduct to the
satisfaction of the school authorities.
(c)
Original degree/diploma, certificates along with certificate(s) of experience, if
any with attested photocopies thereof. Original certificates will be returned after
verification.
12. Probation.—
(a)
Except in the case of a purely temporary vacancy or leave vacancy or for a
specific post of temporary nature, every employee shall on initial appointment
be on probation for a period of one year from the date of his/her joining the
duties. The period of probation may be extended by the trust/society/ governing
body by a further period not exceeding one year. Services of an employee
during probation may be terminated by the trust/society/governing body without
assigning any reason by giving one month’s notice in writing or one month’s
salary including all allowances.
(b) If an employee desires to be relieved during the period of probation, it will be
necessary for him to give one month’s notice in writing or one month’s salary
including all allowances unless and otherwise the trust/society/governing body
permits relaxation under special circumstances.
(c)
Trained / untrained teacher and head master and employees appointed prior to
Advertisement No. 31/2012 of Bihar School Examination Board (senior
secondary) will be treated permanent.
13. Confirmation.—
(a)
If the work and conduct of an employee during the period of probation are
found to be satisfactory, he/she will become eligible for confirmation on the
expiry of the period of probation or the extended period of probation as the

case may be, with effect from the date of expiry of the said period provided
he/she fulfils the other requisite conditions.
(b)
The employee shall be informed of his confirmation within 3 months of the
completion of probation period. If the employee has not been informed within
3 months he/she shall be treated as confirmed. Decision regarding confirmation
will be taken by the trust/society/governing body.
14. Termination of service Due to Abolition of Posts etc.—
(a)
If an employee at any time after confirmation intends to resign he/she will have
to give three months notice in writing or three months salary including all
allowances to the Managing Committee.
(b)
The trust/society/ governing body shall be competent to terminate the services
of a confirmed employee only in case of abolition of a post due to closing down
of school or a class or reduction in the number of sections of a class or
discontinuance of a teaching subject by giving three months notice in writing or
three months salary including all allowances.
(c)
Society/trust / governing body shall have the power to relax the period of notice
or payment of salary in special circumstances.
15. Retirement.—Not withstanding anything contained in these rules or otherwise every
employee including Head of institution shall retire from service on attaining the age of
superannuation prescribed by the government from time to time. Presently the age of retirement will
be 60 years.
16. Working Days and Working Hours.—
(a)
The working days and holidays will be as per State Government Shools.
(b)
The working hours will be such as may be specified from time to time by the
Principal/Head master. Normally the working hours will confirm to the State
Government School.
(c)
As and when required an employee may be assigned any special duty even if it
is to be done beyond normal working hours in the interest of school.
(d)
An employee is also required to conduct and organise co-curricular programmes
and perform other duties even beyond the normal working hours.
17. Maintenance of Record by the Teachers.— A Teacher is expected to maintain the
following documents and also any other record as may be specified from time to time-
(a)
Attendance Register of the class for which he/she is the Class Teacher.
(b)
Personal Log Book and Class Log Book, Programme of Instruction and Lesson
Plans.
(c)
Cumulative result of his class.
(d)
Attendance Diary of optional subjects in case of teacher teaching such optional
subjects.
(e)
Stock Register of properties held by him/her.
(f)
CRB (Cumulative Record Book) of the class for which he/she is a class teacher.
(g)
Fee collection book of the class.
18. Attendance of Employees.—
(1)
Every employee is expected to reach the school punctually and sign the
attendance register on arrival before the working of the school begins and also
mark the time of departure.
(2)
An employee who has not signed the attendance register as above is liable to be
considered absent from duty for that date.
19. Contributory Provident Fund-Pension Scheme.—Employee will be required to become
members of the Contributory Provident Fund Scheme as required under the Employees Provident
Fund and Miscellaneous Provisions Act, 1952 if adopted by the school managment.
20. Representations.—
(a)
Representation to the Managing Committee/governing body/adhoc managing
committee, Chairman of the Society or Manager may be made only through
Principal/Head Master in case of teachers/other employees.

(b) The Principal/Head Master may submit his representation to the Managing
Committee/governing body/adhoc managing committee/Chairman of the
Society/trust directly.
21. Permission to enhance Qualifications.—
(a)
No teacher shall be permitted to apply for enhancing qualifications before
completing two years service.
(b).
After completion of two years of service application for enhancement of
qualification may submitted to chairman/persident of the trust/society/
governing body with following norms and procedures and the trust/society/
governing body will decide upon it and communicate to the candidate within
one month.
22. Application for other Posts.—Any employee with giving written information to
principal shall apply for employment elsewhere but after selection he/she has to resign from posts by
following the norms and procedures.
23. Leave.—
(a)
Every employee shall be entitle to 16 days of casual leave as are admissible
to the employee of a corresponding status in Government Schools.
(b)
Lady teacher will get maternity leave and in every month special leave as
provided under Rule by the State Government. Male teachers may get
fraternity as per rules of the state government.
24. Grant of Leave.—
(a)
Leave cannot be claimed as a matter of right.
(b)
Except Head of the School every employee will take leave from
Principal/Head Master. Principal/Head Master Manager/Correspondent will
take leave from the co-ordinator of the adhoc managing committee/
managing committee/governing body.
(c)
Grant of any leave shall depend on the exigencies of the institution and shall
be at the discretion of the sanctioning authority.
25. Code of Conduct for employees.—
(1)
Every employee shall be governed by the Code of Conduct. The following
acts shall constitute breach of code of conduct:
(i)
Habitual late coming and negligence of duty
(ii)
Use of abusive language, quarrelsome and riotous behaviour.
(iii)
Insubordination and defiance of lawful order
(iv)
Disrespectful behaviour, rumour mongering and character assassination.
(v)
Making false accusations or assault either provoked or otherwise.
(vi)
Use of liquor or narcotics on the school premises.
(vii)
Embezzlement of funds or misappropriation of school property or theft or
fraud.
(viii)
Mutilation/destruction of school records and property.
(ix)
Conviction by a court of law for criminal offence.
(x)
Possession in school premises of weapons, explosives, and other
objectionable materials.
(xi)
Indulging in or encouraging any form of malpractice connected with
examination or other school activities.
(xii)
Obstructing other members of the staff through unlawful act and indulging
in any sort of agitation to coerce or embarrass the school authorities.
(xiii)
Financial irregularities.
(xiv)
Taking active part in politics.
(xv)
Propagating through teaching lessons or otherwise communal or sectarian
outlook or inciting or allowing any student to indulge in communal or
sectarian activity.
(xvi)
Making sustained neglect in correcting class work or home work.
(xvii) Taking private tuitions.

(xviii) Absenting from work even though present in the school premises or absent
without leave (except in case of sudden illness or accident or any other
incident in the family)
26. Service Books and Confidential Rolls.—
(a) Service Book containing factual record of the employee, salary scale, increments,
promotion, leave record, any disciplinary action or reward etc. shall be
maintained for each employee in the prescribed form by Principal/headmaster of
the school.
(b) Service
book
of
principal/headmaster
shall
be
maintained
by
the
chairman/president of the trust/society/governing body/coordinator of the adhoc
committee.
(c)
Confidential rolls should be maintained in the prescribed form and should be kept
confidential. In the confidential rolls result of exam and the evaluation of
educational activities of the candidate should be maintained. Confidential rolls of
other employees should be maintained by Principal/Headmaster and for
principal/HM, it will be maintained by chairman of the trust/society/governing
body/coordinator of the adhoc committee.
(d) Any adverse entry in confidential roll should be communicated to the employee
concerned. The employee concerned may represent against the adverse entry.
The representation will be considered by the Trust/society/governing body and
necessary actions will be taken.
(e)
Personal files shall be maintained by the school for each employee. The original
certificate/ degrees shall be returned to the employees after verification and
Photostat copies kept in the personal files.
27. Disciplinary procedure
Suspension.—
(1)
Any employee can be suspended only after the decision of the
Trust/Society/Governing body/Adhoc managing committee may place an
employee under suspension where:
(a)
The disciplinary proceedings against him is contemplated or pending.
(b)
A Case against him in respect of any criminal offence is under
investigation or trial.
(c)
He is charged with embezzlement::
(d)
He is charged with cruelty/physical punishment or mental harassment
towards any student or any employee of the school.
(e)
He is charged with misbehaviour towards any parent guardian, student
or employee of the school.
(f)
He is charged with a breach of any other Code of Conduct.
(2)
No order for suspension shall remain in force for more than six months unless
the Committee, for reasons to be recorded by it in writing directs the
continuation of the suspension beyond the period of six months and in no case
suspension shall remain in force for more than one year.
(3)
Subsistence allowance as per rules of government shall be provided.
(4)
No payment of subsistence allowance shall be made unless the employee
furnishes a certificate to the effect that he/she is not engaged in any other
employment, business, profession or vocation.
(5)
Where suspended employee is exonerated after disciplinary proceedings or
where any criminal prosecution against a suspended employee ends with an
honourable acquittal, the salaries and allowances of such employee minus the
subsistence allowance received by him shall be paid to him for the suspension
period.
28. Penalties.—The following penalties may for good and sufficient reasons, including the
breach of one or more of the provisions of the Code of conduct may be imposed upon an employee.

(a)
Minor penalties.—
(i)
Censure
(ii) Recovery from pay, the whole or any part of any pecuniary loss
caused to the school by negligence or breach of orders.
(iii) Withholding of increments of pay
(b)
Major Penalties.—
(i)
Reduction in rank
(ii)
Compulsory retirement
(iii)
Termination from service
29. Procedure of Imposing Minor Penalty.—No order in case of a minor penalty shall be
made except after informing the employee of the proposal to take action against him/her and the
allegation on which such action is proposed to be taken and except after giving to the employee an
opportunity to make any representation against the proposed action.
30. Procedure for Imposing Major Penalty.—
(1)
No order imposing on any employee major penalty shall be made except after an
inquiry is held in the manner specified below:
(a)
The disciplinary authority shall frame definite charges on the basis of
the allegations on which the inquiry is proposed to be held and a copy
of the charges together with the statement of the allegations on which
they are based shall be furnished to the employee and he shall be
required to submit within such time as may be specified by the
disciplinary authority but not later than two weeks, a written statement
of his defence and also to state whether he desires to be heard in person.
(b)
On receipt of the written statement of defence or where no such
statement is received within the specified time, the disciplinary
authority may itself make inquiry into such of the charges as are not
admitted or if it considers it necessary to do so, appoint an inquiry
officer for the purpose.
(c)
At the conclusion of the inquiry, the inquiry officer shall prepare a
report of the inquiry recording his findings on each of the charges
together with the reasons thereof.
(d)
The disciplinary authority shall consider the report of the inquiry and
record its findings on each charge and if the disciplinary authority is of
opinion that any of the major penalties should be imposed.
(e)
Furnish to the employee a copy of the report of the enquiry officer.
(f)
Give him notice in writing stating the action proposed to be taken in
regard and calling upon him to submit within the specified time, but not
less than two weeks, such representation as he may wish to make
against the proposed action.
(g) After considering the representation, made by the employee against the
penalty the disciplinary authority shall record its findings as to the
penalty, which it proposes to impose on the employee and send its
findings and decision to the Trust/Society/Governing body /Adhoc
Committee for its approval and while doing so the disciplinary authority
shall furnish to the employee all relevant records of the case including
the statement of allegation, charges framed against the employee,
representation made by the employee a copy of the inquiry report, and
the proceedings of the disciplinary authority.
(h) Decision with regard to the imposition of a major penalty shall be made
by the disciplinary authority after the receipt of the approval of the
trust/society/Managing Committee.

31. Disciplinary Committee.—
(a)
Any member of the Committee, nominated by chairman of society/trust/
governing body/Co-ordinator Adhoc committee.
(b)
The Principal/HM except if he himself is not under disciplinary proceedings.
(c)
One teacher who is a member of School Managing Committee/adhoc
Committee.
Note - The governing body/trust/society/Adhoc managing committee will have the
power to inflict minor/major punishment upon teaching and non teaching
employees working at recognised inter college/secondary and senior secondary
school. But in case of major punishment of reversion/dismissal from service
prior permission of the Board will be necessary.
CHAPTER – 4
32.
MINIMUM QUALIFICATIONS FOR HEADS AND TEACHERS.—The Board has
prescribed the following minimum qualification for Heads of Senior Secondary/Secondary School
and for teachers to teach various subjects in Classes IX to XII.
(1)
Principal of Senior Secondary School.—
A. (i)
Masters Degree or Honours Degree of a Foreign University
recognised as equivalent to the Master’s Degree of an Indian
University of Honours Degree of such Indian Universities as may
be recognized equivalent to the Master’s Degree with minimum
45% marks.
(ii) B.Ed or a Diploma in Education or its equivalent from a recognised
institution/university.
(iii) Minimum
10
years
of
teaching
experience
in
Senior
Secondary/Secondary School.
(iv) At least 3 years experience of administrative charge of a recognised
Senior Secondary School/Inter College having intermediate or +2
classes.
(v) At least 5 years experience of administrative charge of a recognised
Secondary School.
(vi) Preference will be given to candiates with M.Ed qualifications.
(2)
Head Master of Secondary School.—At least master Degree (or its
equivalent) with minimum 45% marks and B.Ed. or its equivalent with 8
years experience of teaching of Secondary/Senior Secondary Classes.
OR
At least Bachelor’s Degree with minimum 45% marks from a recognised
University and B.Ed. from a recognised University/Institute; and 10
years
experience of teaching Secondary School classes (up to class X).
(3)
Teachers.—
1. PGT (To teach classes XI – XII) Senior Secondary School/college
teacher
(i)
English.—
(a)
Master Degree in the subject with minimum 45% marks.
(b)
B.Ed degree/Diploma in Education.
(c)
Passed Secondary teacher eligibility test conducted by the
Bihar Government.
(ii)
Modern Indian Languages and Classical Languages.—
(a)
Master Degree with minimum 45% marks in the subject
of equivalent Degree from a recognised Institution.
(b)
B.Ed degree/Diploma in Education.
(c)
Passed Secondary teacher eligibility test conducted by the
Bihar Government.

(iii) Mathematics: (Either 1 or 2 ) .—

passed Secondary teacher eligibility test conducted by the Bihar
Government.
(xii)
Computer Science.—B.Sc. Computer Science/BCA/Bachelor of
information Technology with
minimum 45% marks.
Or
Graduate Degree in any subject with Mathematics as a subject and 3
years Diploma in computer Engineering/IT from an Institution
recognized by AICTE/University
Or
Graduate Degree in any subject with Mathematics as a subject and
at least one year Diploma in Computer Applications from an
Institution recognized by AICTE/University
Or
‘A’ level from DOEACC

AND
Graduate with Bachelor of Education (B.Ed.) or its equivalent and
passed Secondary teacher eligibility test conducted by the Bihar

(xiii)
Librarian.—Graduate with diploma in Library Science from a
recognized institute.
(xiv)
Junior Librarian.—Senior Secondary/intermediate with 50%
marks or equivalent with Certificate in Library Science from a
recognized Institute.
3.
Vocational Subjects Teachers.—A person possessing post graduate degree
in the concerned area e.g. M.Com. for Commerce based vocational courses,
M.Sc. (Agriculture) for Agriculture based vocational courses, M.Sc. (Home
Science) for Home Science based vocational courses, five years Arts
Diploma in the area concerned for Fine Art based Vocational courses,
M.Music/Dancing for Music/Dancing will be qualified to teach the
concerned subject.
For technological subjects, a person having 3 years diploma course
of a Polytechnic with minimum 45% marks and 2 years experience, or a
Bachelor of Engineering with minimum 45% marks may be treated as
qualified to teach the subject.
4.
Exemption from Minimum Qualifications.—The above minimum
qualifications cannot be condoned.
33. (A)
Masters Craftsmen may also be engaged by the schools as part time
instructors for practical training.
The Services of the existing staff be utilised fully. It would be advisable to
entrust the teaching of the General Foundation Course under core course to
the existing post graduate teachers.
(B)
Counsellor in School.—
(1) Every secondary and senior secondary school shall appoint a person on full
time basis for performing the duties of a Counsellor having the following
qualification.
Graduate/Post Graduate in psychology.
Or
Post Graduate in Child Development.
Or
Graduate/Post Graduate with Diploma in Career Guidance and Counselling.
(2)
School having enrolment of less than 300 students in classes from IX to XII
can appoint a counsellor on part-time basis.
(C) The qualification for non-teaching staff will be as per minimum qualifications and
experience prescribed for the corresponding categories of the posts for schools run
under the State Government.
CHEPTER - 5
34. INTERPRETATION.—On any question as to the interpretation of any provision of
these guideline the decision of the Chairman shall be final and binding.
35. REPEAL AND SAVING.—
(1) The existing provisions regarding affiliation regulations and any notification or
orders issued there under are hereby repealed by these guidelines provided that.
(i)
Such repeal shall not affect the previous operation of the said regulations
or any notifications or orders made, or anything done, or action taken
there under.
(ii)
Any Proceeding under the same Regulations pending at the
commencement of these guidelines shall be continued and disposed of, as
far as may be, in accordance with the provisions of these guidelines as if
such proceedings are under these guidelines.

(iii) Nothing in these guidelines shall be construed as depriving any person to
whom these guidelines apply, or any right of appeal which had accrued to
him under the regulations, notifications or orders in force before the
commencement of these guidelines.
(iv) An appeal pending at the commencement of these guidelines against an
order made before such commencement shall be considered and orders
thereon shall be made in accordance with these guidelines as if such
orders were made and the appeals were preferred under these guidelines.
(2) As from the commencement of these guidelines any appeal or application for
review against any order made before such commencement shall be preferred
to or made under these guidelines as if such orders were made under these
guidelines.
36. JURISDICTION TO FILE SUITS.—
(i)
The legal jurisdiction for the suits to be filed against the Board shall not be
in a court below Sessions & District Judge in Patna.
(ii)
In case of dispute at colleges/schools recognised by the Board, all disputes
will be disposed by the "Bihar Anudanit Shikshan Sansthan Authority".
(iii)
Amounts from internal resource of recognised inter colleges/secondary and
senior secondary schools as well as the fees received from the students and
70% of the usufruct of land of college/school will be spent upon teaching
and non teaching employees and 30% of it will be spent on development of
the college/school.
(iv)
The power to audit the income and expenditure of the college/school will be
with the Board/state government. The head of the institution shall get
prepared internal audit report prepared and submit it to the Board and the
government.
(v)
Each institution will have two accounts. In one account, amounts received
from aid will be maintained which shall be operated (1) principal cum
secretary (2) senior most teacher who is not related with the principal and in
the other account amounts received from internal resources and other sources
shall be maintained. This account will also be operated by the principal cum
secretary and the senior most teacher. All these expenditure will be made
with the approval of the governing body/Adhoc committee /managing
committee. It will be essential to send the audit details of income and
expenditure to the Board each year.
