No. 06/Vidhayi-03-01/2019-9248—In exercise of powers conferred by Section-211
of Motor Vehicle Act, 1988 (Act No 59/88), Governor of Bihar desires to make amendment
in the Bihar Motor Vehicle Rule, 1992 by the following draft which is hereby published for
the information of the persons to be effected by it as required by section-212 of the Act and
it is hereby given notice that the said draft will be available on the website of Transport
Department - transport.bih.nic.in for seven days for inviting objection and suggestions
related to the said draft.
Draft of Notification
In exercise of powers vested under Section - 212 of Motor Vehicle Act, 1988 (Act
No 59/88), Governor of Bihar is pleased to amend the following provisions of Bihar Motor
Vehicle Rules, 1992 (as amended from time to time) the Prior Publication of which required
under section 212 of the Act has been done through Notification No- 06/Vidhayi-03-01/

1. Short Name, extension & effect:-
(i) These Rules shall be called as Bihar Motor Vehicle (Amendment) Rules,
2019.
(ii) It will be effective with immediate effect.
(iii) It will extend to the whole State of Bihar.

2. Rule -163 b, sub rule (2) & (3) of Bihar Motor Vehicle Rules, 1992 will be
substituted as follows:-
163 b(2): Validity of Pollution under Control (PUC) Certificate: Any
Authorized Agency issuing PUC Certificate for Motor Vehicles, being more
than one year old from its first Registration, can issue PUC Certificates valid for
maximum of six months,
Provided PUC Certificate for BS-IV or BS-VI Vehicles can be issued
with validity of twelve (12) months.
163 b (3): Size & Procedures of PUC Certificates; PUC Certificates can be
issued online only, by Authorized Agency /Agencies, which must be in A 4
size.
3. Rule-163 d of Bihar Motor Vehicle Rules, 1992 will be substituted as follows:-
163 d : Establishment of PUC Centers ; “ Any person “ , “ Service Centers of
Authorized Motor Vehicle Companies” , “ Motor Vehicle Fuelling Centers (
Petrol Pump , Diesel Pump , etc ) & “ Any Registered Company registered
under ‘Companies Act , 2013 “ can request online , for establishment of PUC
Centre under Rule - 115 (sub rule 2,3,4 & 5 ) with a purpose of testing emission
of gases & smokes of Motor Vehicles followed by issuing PUC Certificates.
4. Rule 163 e, sub rule 1, 2(i), 2(ii), 3 (i), 3(iii) & 4 will be substituted as follows:-
163 e : Issuance of License & its Renewal.— (1) Application for Sanction &
Renewal will be submitted online to the Licensing Authority, respectively in
Form LTSA or LTSR.
2(i) With Application for License, requisite fee will be deposited online,
prescribed under Rule 163 g , sub rule (4).
2(ii) With Application for renewal of License, requisite fee will be deposited
online, prescribed under Rule 163 g, sub rule (4) .
3(i) Applicant must be doing business for maintenance & servicing of Motor
Vehicles. Applicant himself or their staff should be a Degree holder/
Diploma holder in Mechanical/Electrical or Automobile Engineering/
12thPass (with science) or having I T I pass in any trade related with
Motor vehicle.
3(iii) The place, at which vehicles are proposed to be tested, must be in
ownership of Applicant or under lease/rent, & having sufficient
infrastructure for testing within the premises.
The applicant can operate “MOBILE PUC Centre “, but in
addition to compliance of other parameters for that vehicle upon which
“MOBILE PUC Centre “, has been set up, it should be registered as a
commercial vehicle within State of Bihar . That Motor Vehicle must be
complying provisions of MV Act, 1988 (as amended in 2019) CMV
Rules, 1989, Bihar Motor Vehicle Rules, 1992 & must be paying Motor
Vehicle Taxes as prescribed under Bihar Motor Vehicle Taxation Act,
1994. License for “MOBILE PUC Centre “ can be granted for specific
district.

Licensing Authority after receiving applications under Rule 163 e (i)
and being satisfied that provisions of sub rule (2) & (3) of this rule
are complied, can grant License or its renewal.
If applicants are not capable to fulfill above mentioned criteria,
but Licensing Authority is satisfied with other eligibilities, Provisional
Approval can be granted. Within one month (30 days) to three months

(90 days) from receiving such Provisional Approval by applicant,
required equipment smoke meter or gas analyzer can be set up within
premises for testing. Afterwards, getting it verified, Licensing
Authority can grant & issue Licenses.
5. Rule 163 f, sub rule (4) will be substituted as follows:-
163 f (4) : Fee payable to State Transport Commissioner under this rule will be
as follows :-
(a) Fee for issuing License to PUC Centre for testing
vehicles
