The Bihar Land Mutation (Amendment) Rules, 2020

No.- 8/Niyam Sanshodhan-07-08/2016 (Khand-I) 405(8)/Ra—In exercise of the

powers conferred by section-22 of the Bihar Land Mutation Act, 2011 (Bihar Act 23, 2011),

the State Government hereby amend the Bihar Land Mutation Rules, 2012 (as amended,

2017) and make the following Amendment Rules:-

Chapter-I

1. Short title, extent and commencement.-

(1) These rules may be called " The Bihar Land Mutation (Amendment) Rules, 2020.

(2) It shall extend to the whole of the State of Bihar.

(3) It shall came into force on the date of publication in the Official Gazette.

2. Definitions .- In these rules, unless and untill anything repugnant to the subject or

context, the definitions of words given in section-2 of the Bihar Land Mutation Act, 2011

shall be applicable to the words as used in the Bihar Land Mutation Rules, 2012.

Chapter-II

3. The following sub-rule 3 (a) and 3 (b) shall be added after sub-rule (3) of the

Bihar Land Mutation (Amendment) Rules, 2017 .-

3(a) - The applicant shall be provided a token number through SMS on his/her

mobile phone after receipt of application/petition for online land

mutation.

3(b)- The veracity of the required all such annexed papers and documents of

the application/petition received for online mutation shall be examined

by a centralised system constituted at circle level within three working

days and in case of application, along with all required papers, being

found proper shall be forwarded to the concerned Circle Officer

recording its recommendation on the application.

The following sub-rule (7) and (8) shall be added after sub-rule (6) of rule 3

of the Bihar Land Mutation (Amendment) Rules, 2017 :-

(7) As prescribed under sub-rule 3 (b), case record of online mutation

(including number and year) shall be opened up within 03 (three)

working days and the applicant shall be informed of this through SMS.

The applicant may perceive the case number upon online Portal.

(8) After the opening up of the case record of online mutation application,

the case shall be endorsed by the Circle Officer to the revenue

Karmachari for inspection and the revenue Karmachari shall put up the

report with opinion to the respective Circle Inspector/Revenue Officer

within 07 (seven) working days. The Circle Inspector/Revenue Officer,

after recording the opinion on the inspection report of the revenue

Karmachari, shall put up the record before the Circle Officer within 03

(three) working days.

The following sub-rule 3 (a) shall be added after sub-rule (3) of rule 5 of the

Bihar Land Mutation (Amendment) Rules, 2017 :-

3(a)

The Circle Officer shall cause the general and specific notice to be

issued within 03 (three) working days based on the inspection report of

Circle Inspector/Revenue Officer. Otherwise, thereafter it would shift to

the Log in of Computer Operator for print in the form of automatically

generated PDF. The signature of Circle Officer on the general and

specific notice, issued in such manner, shall be deemed acceptable.

Sub rule 6(i) and 6(ii) of rule 6 of the Bihar Land Mutation (Amendment)

Rules, 2017 shall be substitutited by the following:-

6(i) Online mutation applications/petitions, in which objections have not

been received, shall be disposed of within 35 (thirty five) maximum

working days from the date of receipt of the petition by passing such

order, as the Circle Officer may deem lawfully proper.

6(ii) Online land mutation applications/petitions, in which objections have

been received, shall be disposed of within a maximum of 75 (seventy

five) working days from the date of receipt of the petition by passing

such order as the Circle Officer may deem lawfully proper, after hearing

the respective parties and providing them reasonable opportunity of

producing evidences, as the case may be.

7. The following sub-rule (9) shall be added after sub-rule (8) of rule 15 of the

Bihar Land Mutation (Amendment) Rules, 2017 :-

(9) The applicant /petitioner may submit the application in prescribed

format-XIX to the respective Circle Officer for rectification of clerical

mistakes crept in Mutation Register and problems manifested in

disposal of rent receipt.
