THE BIHAR STATE HIGHER EDUCATION COUNCIL (AMENDMENT-2)
ORDINANCE, 2020
AN
Ordinance
To revive the The Bihar State Higher Education Council (amendment) ordinance
2020 (Bihar ordinance No. 12, 2020)
Preamble- Bihar State Higher Education Council (amendment) ordinance 2020
(Bihar ordinance No. 12, 2020) has been promulgated for amendment in sub section (2) of
section 6 of Bihar State Higher Education Council Act 2018 (Bihar Act 01, 2020). This
ordinance could not be enacted in previous Legislature of the State of Bihar. It will lapsed
by 07.01.2021.
WHEREAS, The Legislature of the state of Bihar in not in session,
AND WHEREAS, The Governor of Bihar is satisfied that the circumstances exist
which render it necessary for him to revive the Bihar State Higher Education Council
(amendment) ordinance 2020 (Bihar ordinance No. 12, 2020).
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article
213 of constitution, The Governor of Bihar, is pleased to promulgate the following
ordinance :-
1. Short title, extent and commencement.—
(1) This Ordinance may be called the Bihar State Higher Education Council
(Amendment-2) Ordinance, 2020.
(2) it shall extend to the whole of the State of Bihar.
(3) It shall be deemed to have come into force on the 23th September 2020.
2. Amendment of Section 6 of Bihar Act 01, 2020.— Sub section (2) of section 6
of The Bihar State Higher Education Council Act 2018 (Bihar Act 01, 2020) shall be
substituted by the following :-
" (2) The appointment to the post of Vice Chairman shall be made by the State
Government. The Vice-Chairman shall hold his office for a period of five
years and shall be eligible for reappointment subject to maximum of two
terms."
3. Repeal and Savings.—
(1) The Bihar State Higher Education Council (amendment) ordinance 2020
(Bihar ordinance No. 12, 2020) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the
Bihar State Higher Education Council (amendment) ordinance 2020
(Bihar ordinance No. 12, 2020) shall be deemed to have been done or
taken under the provisions of this ordinance.
