सं. 100/िबहा.-िव.प./14/2020-एम.एल.ए. (1)- यतः, िबहार राǛ की िवधान सभा के सद˟ों Ȫारा िवधान

पįरषद के िलए िनवाŊिचत ŵी िवनोद नारायण झा, का ̾थान, उनकी पदाविध, जो िक 21.07.2022 सिहत उस तारीख

तक थी, के समाɑ होने से पूवŊ िबहार िवधान सभा मŐ उनके िनवाŊिचत होने के कारण, 11.11.2020 से įरƅ हो गया है;

और

यतः, इस Ůकार Šई įरİƅ को भरने के Ůयोजन से एक उप िनवाŊचन आयोिजत िकया जाना है;

अतः, अब, लोक Ůितिनिधȕ अिधिनयम, 1951 (1951 का 43) की धारा 151, धारा 39 की उपधारा (1) और

धारा 56 के अनुसरण मŐ, भारत िनवाŊचन आयोग ,rn~}kjk%&

(अ) िबहार राǛ के िवधान सभा सद˟ों से यह अपेƗा करता है िक वे 01 फरवरी 2021 (सोमवार) से पूवŊ तथा उƅ

अिधिनयम और तȠीन बनाए गए िनयमों और उनके तहत जारी िकए गए आदेशों के उपबɀों के अनुसार राǛ की

िवधान पįरषद मŐ उƅ įरİƅ को भरने के Ůयोजन से एक ʩİƅ िनवाŊिचत कर दŐ;

(आ) उƅ िनवाŊचन के संबंध मŐ fuEufyf[kr िनयत करता हैः-

(क) नाम िनदőशन करने की अİȶम तारीख

- 18 जनवरी, 2021 (सोमवार) ;

(ख) नाम िनदőशन की संवीƗा की तारीख

19 जनवरी, 2021 (मंगलवार) ;

(ग) अɷिथŊताएं वापस लेने की अİȶम तारीख

21 जनवरी, 2021 (गुŜवार) ;

(घ) वह तारीख, िजसको यिद आवʴक Šआ तो मतदान होगा,

28 जनवरी, 2021 (गुŜवार) ; और

(ड.) वह तारीख िजससे पूवŊ िनवाŊचन सɼɄ हो जाएगा

01 फरवरी, 2021 (सोमवार) ; और

(इ) िनवाŊचन के िलए 09.00 बजे पूवाŊ˥ से 04.00 बजे अपरा˥ तक का समय, ऐसे समय के ŝप मŐ िनयत करता है

िजसके दौरान यिद आवʴक Šआ तो िविनिदŊʼ तारीख को मतदान होगा।

No.100/BR-LC/14/2020-MLA (1): - Whereas, the seat of Sh. Vinod Narain Jha

in the Legislative Council of the State of Bihar, elected by the members of the

Legislative Assembly of the State, has become vacant on 11.11.2020 by the reason of

his election to Bihar Legislative Assembly, before the expiration of his term of office

which was up to and including 21.07.2022; and

WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so

caused;

NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39

and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election

Commission of India hereby-

(A)

calls upon the members of the Legislative Assembly of the State of Bihar to

elect, before 01^st February, 2021 (Monday), and in accordance with the provisions of

the said Act and of the rules and orders made thereunder, a person for the purpose of

filling the said vacancy in the Legislative Council of the State;

(B) appoints with respect to said election, -

(a) the 18^th January, 2021 (Monday), as the last date for making nominations;

(b) the 19^th January, 2021 (Tuesday), as the date for the scrutiny of the

nominations;

candidatures;

(d) the 28^th January, 2021 (Thursday), as the date on which a poll shall, if

necessary, be taken; and

(e) the 01^stFebruary, 2021 (Monday), as the date before which the election

shall be completed; and

shall, if necessary, be taken on the date specified above, for the election.
