"The order dated 01-12-2010 has to be construed according to the

guidelines issued on 23-03-2006 amending the A.C.P. Rules 2003 which

provides in clause 5 that the period of service spent in the work charge

establishment was required to be taken into account for computing eligibility

of A.C.P. No further discussion is required to hold that the order dated

01-12-2010 to the extent contrary to the same is not sustainable with regard to

the second category of persons.

Insofar as the third category is concerned, it can be subdivided into two

categories- daily wage and work charged establishment. The latter are again

covered by the 2006 amendment of the A.C.P. Rules and the order is

unsustainable to that extent.

Insofar as daily wagers are concerned, there appears no difference between

them and work charged employees as both are not in regular service. There

does not appear to be sufficient justification to discriminate between the two

classes for grant of A.C.P. "

The relevant Provision of the ACP Scheme, which has been incorporated

with effect from 20.03.2006 is being extracted as under.

4. (iid) fu;fer dk;ZHkkfjr deZpkfj;ksa ds ,0lh0ih0 izksUufr ds fy, dk;ZHkkfjr lsokof/k dh x.kuk dh

tk;sxhA**

It is quite clear that the State Government's policy itself is that period spent

by the employees under work charge establishment is to be

calculated/counted for considering their eligibility in terms of length of

service for grant of benefits under the ACP Scheme after their

regularization. Hence the period, which was spent by them under work

charge establishment, is also to be considered as length of service for the

said purpose.

With the aforesaid modification in the order, the LPA stands disposed of.

We are making it clear that we have not decided in the present LPA as to

whether the writ petitioner/respondent were in the work charge

establishment or not. It will be open for them to make a claim on such issue

if they were actually under work charge establishment. In such a case, the

State Government will consider the same on merit in accordance with law."
