ENGINEERING (MECHANICAL) CADRE RECRUITMENT AND SERVICE
CONDITION RULES-2021
No-Building-3/Estt.-Misc.-17/2013@2024¼Hk½—In exercise of Powers conferred
under the proviso to Article-309 of the Constitution of India, the Governor of Bihar is
hereby pleased to make the following Rules to regulate the recruitment and Service
Condition of Bihar Building Construction Department Subordinate Engineering
(Mechanical) cadre:-
Part-I
1.
Short title, extent & Commencement:-
(1)
These Rules may be called the ''BIHAR BUILDING CONTRUCTION
DEPARTMENT
SUBORDINATE
ENGINEERING
(MECHINIAL)
CADRE RECRUITMENT AND SERVICE CONDITION RULES-2021''
(2)
It shall extend to the whole of the State of Bihar.
(3)
It shall come in force at once.
2.
Definitions- In these Rules, unless anything is not contrary to the subject or
context:-
(i)
''Government" means the Government of Bihar;
(ii)
''Department" means Building Construction Department, Government of
Bihar;
(iii)
"Appointing Authority" means the Engineer-in-Chief-cum-Additional
Commissioner-Special Secretary of Building Construction Department or any
other officer authorized by the Department for this purpose.
(iv)
"Commission" means Bihar Technical Service Commission;
(v)
"Cadre" means Bihar Building Construction Department Subordinate
Engineering (Mechanical) Cadre;
(vi)
"Member of Cadre" means, all persons, regularly appointed and working
under the provisions of these Rules.
3.
Constitution of the cadre- "Junior Engineer (Mechanical)" will be the post of
basic category under the Bihar Building Construction Department Subordinate
Engineering (Mechanical) Cadre. The pay scale and grade pay as determined by
the Government, from time to time for this post, shall be payable.
4.
Sanctioned strength- The sanctioned strength of this Cadre shall be determined
by the State Government, from time to time.
5.
Reservation- The provisions of the Bihar Reservation of Vacancies in post and
services (for Scheduled casts, Scheduled Tribes and other Backward Classes)
Act-1991 (Act-3, 1992) (as amended from time to time) and the Rules made
there under and the horizontal reservation for women issued by Resolution
No.963 dated 20.01.2016, the horizontal reservation for Economically Weaker
Section issued by General Adminstration Department Notification No.2622 dated
26.02.2019 and the horizontal reservation for Disabled candidate issued by
General Adminstration Department Notification No.13062 dated 12.10.2017 and
the roaster and reservation as prescribed by the State Government, from time to
time, shall be applicable to the appointment of this cadre.

Part-II
Appointmnet in the Cadre
6.
Appointment- First appointment in the Cadre will be by direct recruitment to
the post of Junior Engineer (Mechanical). There shall be no entry on this post on
the basis of promotion.
7.
The appointing authority shall calculate the vacancies category wise on 1st April
of every year and accordingly, the reservation category wise requisition will be
sent through the department to the Commission by 30th April of every year.
8.
On the basis of requisition made under Rule-7, the Commission, by such manner
as it may deem proper, shall advertise the reservation category wise vacancies of
this Cadre for filling by direct recruitment.
9.
Qualifications/Eligibilities - (1) Qualifications for appointment in this cadre
shall be as follows:-
(I) A Candidate must be a citizen of India.
(II) For the Subordinate Engineering Cadre, diploma or equivalent qualification
holder in Mechanical Engineering.
(III)
Technical Qualification/Eligibilities for selection:-
(a)
For the 90% (Ninety percent) posts of the total sanctioned strength of
Junior Engineer (Mechanical):-
(i)
Diploma in Mechanical Enginerring from the institutes recognized by
AICTE, New Delhi or equivalent qualification.
(ii) Diploma in Mechanical Engineering by Non-Distance Mode from Deemed
University under the provision of UGC ACT provided that the said Deemed
University has received sanction of UGC for conducting Diploma course in
Mechanical Engineering.
(b)
For the 10% (Ten percent) posts of the total sanctioned strength of
Junior Engineer (Mechanical):-
(a)
Diploma in Electrical Enginerring from the institutes recognized by
AICTE, New Delhi or equivalent qualification.
(b)
Diploma in Electrical Engineering by Non-Distance Mode from
Deemed University under the provision of UGC ACT provided that
the said Deemed University has received sanction of UGC for
conducting Diploma course in Electrical Engineering.
(2) Age of applicant must not be less than 18 (eighteen) years as on the first August
of the requisition year. Maximum age shall be within the reservation category
wise Age-limit determined by the State Government (General Administrative
Department) from time to time. But relaxation of maximum 10 (ten) years will
be admissible to the Junior Engineers (Mechanical), already employed on
contract basis, in the maximum age-limit.
10.
Procedure of Selection- (1) Selection to the posts of basic category of Junior
Engineer (Mechanical) of this cader shall be made by the Commission on the
basis of percentage of marks obtained in Diploma or equivalent Qualification.
Candidates having working experience on the post of Junior Engineer
(Mechanical) on contract basis under the Government of Bihar or in any
undertaking/body/corporation/Authority/autonomous
body
under
the
Government of Bihar, who fulfil the qualifications of the recruitment in this
cadre, shall be given weightage by giving additional marks according to sub rule
(2)(b) of this Rule.

(2) Merit list of Candidates shall be prepared on the following basis:-
Full Marks
(a) On the basis of percentage of marks obtained in
Diploma (Mechanical) or equivalent qualification

(b) Maximum weightage for the working experience
on contract basis (weightage of per working year
shall be 5 marks maximum limit of which will be
up to 25 marks. For part of any year, obtained
proportionate mark by dividing by 365 to the no
of working days in that year multiplying by
number 5, will be added).

Total -
100 Marks
(3) Determination of working period on the contract basis shall be made on the basis
of Payment Certificate issued by their respective controlling officers. For this,
the period up to the cut off date mentioned in the advertisement published by the
Commission shall be calculated for the working experience.
(4) Appointment of the Mechanical/Electrical Diploma holder candidates as Junior
Engineer (Mechanical) shall be made in the following manner:-
(a)
As per Rule-5 of these Rules, reservation category wise, 40% posts of
total vacant posts shall be reserved for Mechanical/Electrical Diploma
holder candidates from the Government Polytechnic Institutes under
the State which will be filled up on the basis of Merit list prepared
reservation category wise under the determined procedure by Rule
10(2).
(b)
Remaining vacant post shall be filled on the basis of merit list
prepared reservation category wise under the determined procedure in
Rule-10(2) as per eligibilities/qualifications mentioned in Rule-
9(1)(iii).
(c)
After filing vacant posts of para-(b) through general procedure, the
remaining reserved posts of para-(a) will be filled from remaining
merit-list on the basis of category wise merit of candidates passing
from the Government Polytechnics of the State.
11.
The Commission shall prepare final merit-list of selected candidates according to
Rule-10 and shall recommend it to the Government for appointment. The panel
of candidates recommended by the Commission shall be valid for one year.
Part-III
Promotion and seniority
12.
Promotion- Promotion from Junior Engineer (Mechanical) to higher post will be
made under the provision made in the Bihar Engineering service Cadre Rules.
13.
Determination of Seniority- Seniority of the Junior Engineers (Mechanical)
shall be made by the Department in accordance with the merit list recommended
by the Commission. Seniority of already appointed and working Junior
Engineers (Mechanical) shall be unaffected.

Part-IV
Miscellaneous
14.
Discipline, Control and Appeal-(1) The provisions of The Bihar Government
servants (Classification, Control and Appeal) Rules-2005 (as amended from time
to time) shall apply to the member of The Bihar Building Construction
Department subordinate Engineer (Mechanical) Cadre in the matters of
discipline, controls and appeals.
(2)
Service conditions particularly not provided under these rules, shall be
governed by the Bihar Service Code and other decisions issued by the
State Government, from time to time.
15.
Removal of Difficulties:- If any difficulty arises in giving effect to any of the
provisions of these Rules, the Government, after consultation with the Law
Department may, by order published in the Official Gazette, make such
provisions not in-consistent with the provisions of these Rules, as may appear to
it to be necessary or expedient for removing the difficulty.
16.
Residual matters- (1) All residual matter of this cadre shall be under the
jurisdiction of Building Connstruction Department.
(2)
In Case of any doubt in the interpretation of any rule of these Rules, the
same will be referred to the Department and the decision of the
Department, after consultation with Law Department, shall be final.
17.
Repeal and savings- (1) The present Rules and Regulations in this context are
hereby repealed, but Jnior Engineer covered by previous Rules will be governed
by these Rules with effect from its notification.
(2)
Notwithstanding such repeal, anything done or any action taken under the
said Rules/Regulation shall be deemed to be done or taken under these
Rules as if these Rules were come into force on the day on which such
thing was done or such action was taken.
