THE BIHAR STATE HIGHER EDUCATION COUNCIL
(AMENDMENT) ACT, 2021
AN
ACT
To amend the The Bihar State Higher Education Council Act 2018 (Bihar Act
01, 2020)
Preamble- Bihar State Higher Education Council Act, 2018 (Bihar Act 01, 2020)
have been enacted to implement Central Government Sponsored Rashtriya Uchttar Shiksha
Abhiyan Scheme in the State of Bihar. In Sub Section(2) of Section-6 of the Bihar State
Higher Education Council Act, 2018 (Bihar Act 01, 2020) it is mentioned that the
appointment to the post of Vice Chairman shall be made by the State Government. The Vice
Chairman shall hold his Office for a period of Five Years and Shall not be eligible for re-
appointment.
Since Bihar State Higher Education Council will play very important role in proper
development of higher education under New National education Policy. Hence it will be in
the interest of State to make provision for re-appointment of qualified and experienced
person to the post of Vice Chairman of State Higher Education Council in this Act.
Now therefore, be it enacted by the Legislature of the State of Bihar in the seventy
second year of the Republic of India as follows :-
1. Short title, extent and commencement.— (1) This Act may be called the Bihar
State Higher Education Council (Amendment) Act, 2021.
(2) it shall extend to the whole of the State of Bihar.
(3) It shall deemed to have come into force on the 23rd September, 2020.
2. Amendment of Section 6 of Bihar Act 01, 2020.— Sub section (2) of section 6
of The Bihar State Higher Education Council Act 2018 (Bihar Act 01, 2020) shall be
substituted by the following :-
" (2) The appointment to the post of Vice Chairman shall be made by the
State Government. The Vice-Chairman shall hold his office for a period of five
years and shall be eligible for reappointment subject to maximum of two terms."
3. Repeal and Savings.—
(1) The Bihar State Higher Education Council (Amendment-2) Ordinance,
2020 (Bihar Ordinance No.-02, 2021) in hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken under the
Bihar State Higher Education Council (Amendment -2) Ordinance, 2020
(Bihar Ordinance No.-02, 2021) shall be deemed to have done or taken
under the provisions of this Act.
