No. 3/M-1098/2021/1098—In exercise of powers conferred by Proviso to Article-309

of the Constitution of India the Governor of Bihar is hereby pleased to make the following

Rules for amendment in Public Health Engineering Circle Level Clerical Cadre (Recruitment

& Service Conditions) Rule, 2016 under Govt. of Bihar, in light of General Administration

Department Resolution Memo 7095 Dt.15.07.2021

1. Short title, extent & Commencement.—

(i) This Rule may be called the Bihar Public Health Engineering Circle Level

Clerical Cadre (Appointment & Service Condition) (First amendment)

Rule, 2021

(ii) It shall extend and be effective equally on all the Mufassil Offices Under

Public Health Engineering Department, Govt. of Bihar.

(iii) It will come into force from the date of issue of Resolution memo 7095

Dated 15.07.2021 of General Administration Department.

2. Sub-rule(1) of Rule -05 of the said Rules is substituted by the following :-

(i)

85% posts of Lower Division Clerk shall be filled by direct recruitment

and 15% posts shall be filled from amongst Group D employees passed

intermediate (10+2) with Computer Typing or equivalent passed

qualification. Such Govt. employees who died in harness, the appointment

of their dependents would be considered after fulfillment of requisite

parameters against the posts available for direct recruitment, for which the

recommendation of the Commission will not be required.

But after the appointment of the dependents of the deceased

employees, who died in harness, the requisition for remaining vacancies of

that Calendar year will be sent to the commission up to the month of

December of previous Calendar Year.

(ii)

It will be necessary to get approval of the Department before the

appointment on Compassionate ground on the post of Lower Division

Clerk.
