The 9th March 2022

No. : M-1-01/2022-05—WHEREAS, the seats of 24 (Twenty four) members of the Legislative

Council of the State of Bihar, elected from 24 (Twenty four) Local Authorities’ Constituencies, specified in

column (1) of the TABLE below, as per the numbers shown in the corresponding entries in column (2) of the

TABLE, have fallen vacant, on the dates mentioned in the corresponding entries in column (3) of the TABLE;

and

WHEREAS, a biennial election has to be held for the purpose of filling the 24 (Twenty four)

vacancies so arising; and

WHEREAS, the term of office of the member(s) to be elected to the State Legislative Council from

the said Local Authorities’ Constituency shall be subject to the decision of the Hon’ble Supreme Court of India

in SLP(C) No. 17123/2015 (Election Commission of India Vs Devesh Chandra Thakur & Others);

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of Section

16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Bihar is hereby

pleased to call upon each of the said Local Authorities’ Constituencies, specified in column (1) of the TABLE

below, to elect the number of members, specified against that Constituency in column (2) of the said TABLE,

to the Legislative Council of the State, for the purpose of filling the above vacancies, in accordance with the

provisions of the said Act and of the rules and orders made thereunder.

NOW, THEREFORE, in pursuance of Section 30 and Section 56 of the Representation of

the People Act, 1951 (43 of 1951), the Election Commission of India hereby –

(A) appoints, with respect to the said election, -

(a) the 16^th March, 2022 (Wednesday), as the last date for making nominations;

(b) the 17^th March, 2022 (Thursday), as the date for the scrutiny of nominations;

(c) the 21^st March, 2022 (Monday), as the last date for the withdrawal of

candidatures;

(d) the 04^th April, 2022 (Monday), as the date on which a poll shall, if necessary,

be taken; and

(e) the 11^th April, 2022 (Monday), as the date before which the election shall be

completed; and

(B) fixes the hours from 08:00 am to 04:00 pm, as the hours during which the poll shall,

if necessary, be taken on the date specified above for the election.
