Section 26 of Bihar State Madarsa Education Board Act, 1981(Bihar Act No.32, 1982),

His Excellency the Governor of Bihar has been pleased to frame the following Rules to

regulate the service condition of teaching and non-teaching staffs of Non-Government

Recognised Aided Madarsas (upto Moulvi Standard) is as follows:-

1. Introduction:- The recruitment of the teaching and non-teaching staffs of Non-

Govt. Recognized Aided Madarsas located in the State of Bihar is being made by the

Managing Committee of the respective Madarsa. This rule is being framed in order to

regulate and to make transparency in making recruitment and service condition of the

employees of such Madarsas.

2. Short title, extent and commencement-

(i) These Rules may be called the Bihar State Non-Government Recognised

Aided Madarsa (up to Moulvi standard) Teaching and Non-teaching Staffs Service

Condition Rules, 2022.

(ii) It shall extend to the whole of the State of Bihar.

(iii) It shall come into force from the date of publication in the official Gazette.

3. Definitions –In these Rules, unless there is anything repugnant in the subject or

context –

(i) ‘Government’ means Government of Bihar;

(ii) ‘Department’ means Education Department;

(iii)‘Act’ means Bihar State Madarsa Education Board Act, 1981;

(iv)Director (Oriental) means Special Director, Secondary Education incharge

Sanskrit and Madarsa.

(v)‘Board’ means Bihar State Madarsa Education Board constituted under the

Act, 1981;

(vi) ‘Chairman’ means Chairman of the Bihar State Madarsa Education Board;

(vii) ‘Secretary’ means Secretary of the Bihar State Madarsa Education Board;

(viii) ‘Local People’ means the residents (adult) of the feeding area (Poshak

Kshetra) in which the Madarsa is situated;

(ix) ‘Recognition’ means Non-Government Recognized Aided Madarsa (up to

Moulvi standard) from the Education Department, Government of Bihar, Patna;

(x) ‘Madarsa’ means Non-Government Recognized Aided Madarsa (up to

Moulvi standard) from the Education Department, Government of Bihar, Patna;

(xi) ‘Head Moulvi’ means legally appointed / promoted Head Moulvi of Non-

Government recognized Aided Madarsa (up to Moulvi Standard);

(xii) ‘Assistant Teacher’ means legally appointed Assistant Teacher of a Non-

Government recognized Aided Madarsa (up to Moulvi Standard);

(xiii) Clerk means legally appointed Clerk of Non-Government Recognized Aided

Madarsa (up to Moulvi standard);

(xiv)School Peon means legally appointed School peon of of Non-Government

Recognized Aided Madarsa (up to Moulvi standard).

(xv) ‘Managing Committee’ means Managing Committee of Non-Government

Recognized Aided Madarsa (up to Moulvi standard) constituted under relevant Rules;

(xvi) Non-Govt. Recognized Aided Madarsa (Upto Moulvi standard) means:-

(a) Non-Govt. recognized Aided Madarsa up to Tahtaniya standard (Class I to

(b) Non-Government recognized Aided Madarsa upto Wastaniya standard

(Class I to VIII);

(Class I to X);

(d) Non-Government Recognized Aided Madarsa upto Moulvi standard

(Class I to XII )

(xvii) Oriental language/learning means:- Arabic, Persian, Hadith, Fiqh, Deeniyat,

Mantiq-wa-Falsafa, Tareekh-E-Islam etc.

(xviii) ‘Modern Subject’ means:-

(i) Science subject group

(ii) Computer

(iii) Social Studies (History, Geography, Civics etc.)

(xix) Training means- Having degree of B.Ed/D.L.Ed from any training Institute

recognized by the Union or any State Govt. prior to enforcement of National Council of

Teacher Education (In Short N.C.T.E) and after enforcement of N.C.T.E.such training

Institute recognized by N.C.T.E. or the degree of B.Ed/D.L.Ed from any recognized

institute from the State/Union Territory where the N.C.T.E. is not applicable.

(xx) Merit marks means the merit marks prepared for the purpose of recruitment.

(xxi) Recognized University means – University constituted under the relevant

statute or recognized by University Grants Commission.

(xxii) Appellate Authority means- Appellate Authority constituted under the

provisions of Bihar State Madarsa Education Board Act, 1981.

4. Constitution of Service/Cadre – There shall be following three sub cadre in

Non-Government recognized Aided Madarsas:-

(i) Post of Teachers of Oriental language/learning.

(ii) Post of Teachers of Modern Subject/learning.

(iii) Post of Non-Teaching Staffs.

5. Hierachy and sanctioned strength of Teaching and Non-Teaching Staffs of

Non Government Recognized Aided Madarsa –

(i) There shall be total 7 Units of three sub-cadres of sanctioned

strength/Hierarchy of teaching and Non-teaching Staffs of Non-Govt. Recognized Aided

Madarsas (up to Wastania standard) which is as follows:-

(A) Total post of teachers from oriental language/learning: 04.

(i) Head Moulvi-

One post

(ii) Alim Assistant-

One post

(iii) Moulvi Assistant-

One post

(iv) Hafiz-

One post

(B) Total post of teachers of Modern Language/learning: 02 Intermediate

Trained- Two post.

(C) Post of Non-Teaching Staffs: 01

(i) School Peon- One Post

(ii) There shall be total 12 Units of three sub-cadres of sanctioned

strength/Hierarchy of teaching and Non-teaching Staffs of Non-Govt. Recognized Aided

Madarsas (up to Fauquania standard) which is as follows:-

(A)

6. Qualification for recruitment:-

(i)

The candidate must be citizen of India and permanent resident of the

respective district of the State of Bihar where the Madarsa is located.

(ii)

Head Moulvi (upto Wastania standard):-

Minimum 5 years teaching experience from any recognized Madarsa.

(iii) Head Moulvi (up to Fauqania/Moulvi standard)- Minimum 10 years

teaching experience from any recognized Madarsa.

(iv) Fazil Assistant:-

Minimum 45% marks in Fazil from any recognized University.

(v)

Alim Assistant-

Minimum 45 % marks in Alim from any recognized University.

(vi) Moulvi Assistant:- Minimum 45% marks in Moulvi from any recognized

Board.

(vii) Qualification of Teachers of Modern Language / Learning (which includes

English, Hindi, Urdu, Science , Computer and Social Studies):

(A) Post of Intermediate trained teacher:- Intermediate and D.L.Ed/ B.Ed.

(B) Post of Graduate Trained Teacher- Degree of graduation in concerned subject

and B.Ed..

(viii) Hafiz- Minimum 40% marks in Moulvi or Kuran Hifz from any

recognized Board.

(ix) Clerk- Minimum 40% marks in Intermediate or equivalent qualification

(being declared by the Department from time to time) and Diploma in Computer

Application (In short D.C.A) from any recognized University.

(x)

School Peon:- Minimum 40% marks from any recognized Board or

equivalent qualification (being declared by the Department from time to time)

with having proficiency in cycling.

7. Age:- The minimum age prescribed for recruitment for the post of

Graduation/Alim or above shall be 21 years. The Minimum age prescribed for

other posts shall be 18 years . The maximum age shall be same as has been

prescribed by the State Govt. (General Administration Department).

8. Procedure of Recruitment: - The Managing Committee of the Madarsa shall be

empowered to make recruitment after complying the following procedure:

(A) (i) Promotion on the post of Head Maulvi: Promotion on the post of Head

Moulvi shall be made after completion of minimum prescribed experience/time

period with having qualification of Fazil/Post graduation.

(ii)Promotion on the post of Fazil Teacher : Promotion on the post of Fazil

Teacher shall be made after completing minimum 5 years experience on the post

of Alim Teacher besides having the degree of fazil. In case of having more than

one candidate the promotion shall be made on the basis of seniority. In case of

non-availability of Alim qualified teacher direct recruitment shall be made on the

post of Fazil Teacher.

(iii) Promotion on the post of Moulvi Assistant: Promotion on the post of

Moulvi Assistant shall be made after completing minimum 4 years experience on

the post of Alim Teacher besides having the degree of Alim. In case of having

more than one candidate the promotion shall be made on the basis of seniority. In

case of non-availability of Moulvi Assistant qualified teacher direct recruitment

shall be made on the post of Alim Teacher.

(iv) Promotion on the post of Graduate Teacher- Promotion on the post of

Graduate teacher shall be made after completing minimum 4 years experience on

the post of Intermediate Teacher besides having the degree of Graduation. In

case of having more than one candidate the promotion shall be made on the basis

of seniority. In case of non-availability of qualified Intermediate trained teacher

direct recruitment shall be made on the post graduate teacher.

(v) Direct recruitment shall be made on the post of Hafiz, Moulvi Assistant and

Intermediate trained teacher.

(vi) Promotion on the post of clerk shall be made from the post of School peon

after having minimum 6 years experience as School peon and having

qualification of Intermediate. In case of having more than one candidate

promotion shall be made on the basis of seniority. Direct recruitment on the post

of clerk shall be made in case of non-availability of desirable qualified School

peon.

(vii) Direct recruitment shall be made on the post of School peon.

(B) The direct recruitment of Assistant Teacher, clerk and School peon shall be

made through the web portal (software) being prepared by the Department for the

respective district. The application format recruitment along with information

regarding vacancies in the respective district of all Non-Govt. Recognized Aided

Madarsas (Upto Moulvi standard) shall be displayed on the web portal (Software).

(i)

The application shall be obtained from the qualified candidates through

web-protal. The Advertisement inviting application for recruitment shall be

published in at least two leading Urdu and Hindi newspapers of the State and

the said information shall also be downloaded on web-portal.

(ii) Upon receipt of application forms from the intending candidates a merit

list and select list shall be prepared by the web-portal. The validity of merit list

shall be for one year.

(iii) The concerned Managing Committee of the School shall cause notice to

the candidates placed in the select list through web-portal to appear in

counselling at the fixed date, time and place. While fixing the date and time of

counselling it would be kept in mind that the candidates ought to have been

granted at least 10 days time to appear in counseling.

(iv) The entire process of counseling shall be held in the concerned Madarsa

under the supervision of an officer of Bihar Education Service nominated by

the District Education Officer.

(v)

If the candidate happens to be kith and kin of the Head Moulvi, Member

of Managing Committee, Chairman or Secretary of the Bihar State Madarsa

Education Board or any authorised representative in that event an intimation

must be furnished by such authority specifying the actual relationship to the

Board prior to counselling and he will keep himself aloof from the process of

counselling (It should have been entire selection process). Otherwise, the

appointments of his kith and kin shall be treated to be illegal, but other

appointments shall not be affected

(vi) In course of counselling the original certificates and marks sheets of

educational, Training and experience certificates of the candidates shall be

looked and examined and only after being satisfied the niyojan patra shall be

issued by the Secretary of the Managing Committee within three days.

(vii) The Managing Committee of the Madarsa shall send proposal seeking

approval of the appointment and promotion to the Bihar State Madarsa

Education Board, Patna. The Bihar State Madarsa Education Board shall

scrutinise the recommendation on the basis of the data available on the web-

portal.

(viii) The Bihar State Madarsa Education Board shall take decision upon the

recommendation received from the ends of the Managing Committee and

communicate the same within a month. In case of rejection or modification in

the recommendation an specific reason in writing will be assigned. The

Department/Board shall provide Grants-in-Aid to ensure payment of salary

only after the recommendation of appointment or promotion is approved by the

Board.

(ix) The Managing Committee of the Madarsa being aggrieved from the

decision of the Bihar State Madarsa Education Board may prefer an appeal

before the Appellate Authority being nominated by the Education

Department,Govt. of Bihar within 60 (sixty) days from the date of impugned

decision.

(C) The Managing Committee shall consider to fill up the vacant post of Assistant

Teachers/School Peon by way of promotion from the eligible candidates.

Thereafter a list of all such candidates shall be sent to the Madarsa Board for

seeking approval. The Managing Committee shall take steps for promotion only

after obtaining approval from the Board. The Board will issue guidelines to

determine inter-se-seniority of teachers/School peon separately.

(D) The Bihar State Madarsa Education Board shall maintain a data of teacher/non-

teaching Staffs Madarsawise.

9. The Merit marks and merit list shall be determined in the following

manner:--

(i) The computation of merit marks for recruitment as Assistant Teacher shall be

done on the basis of average (Percentage) marks obtained in educational and

training qualification where the recruitment is not being made on the basis of

training qualification in such event the merit marks shall be computed on the

basis of the marks obtained on the basis of minimum educational

qualification.

(ii) The merit marks for recruitment as clerk shall be computed on the basis of

percentage of marks obtained from Intermediate or equivalent examination.

(iii)The merit marks for recruitment of peon shall be computed on the basis of

percentage of marks obtained in Secondary or equivalent examination.

(iv) In case of merit marks being equal of the aforesaid post the candidates

having higher qualification and in case of having equal qualification of more

than two candidates then the candidate senior in age and in case of having

more than two candidates in same age the candidate whose name comes first

on the basis of English alphabet will be placed above and will be given

preference.

(v) The candidates having qualified C.T.E.T./T.E.T. shall be given preference in

recruitment of Wastania standard. Likewise the candidate having qualified

STET shall be given preference for recruitment for Fauquania and Moulvi.

10. Probation period : - The period of two years shall be treated to be probation

period from the date of recruitment.

11. Confirmation:-

The Managing Committee shall confirm the services of the

probationer employee after two years subject to the condition that his services are

found satisfactory during probation period.

12. Service condition:-

(i) The State Govt. shall provide Grants-in-aid for payment of monthly salary

ensure payment of salary of Head Moulvi, Assistant Teacher, Clerk and School

Peon validity appointed against sanctioned post. The monthly salary shall be

same as is being prescribed by the State Govt. from time to time.

(ii) The teaching and non-teaching staffs of Madarsa shall superannuate after

attaining 62 years of age.

(iii)The staffs of the Madarsa must have reached Madarsa in time and put their

signature on the attendance register. Besides, the employees shall put their

signature on the attendance register at the time of departure otherwise the

employee shall be treated to be absent.

(iv) The syllabus prescribed by the Board must have been completed in the

academic session. The concerned Assistant Teacher must have engaged

minimum two classes on every teaching day. The employee found absent

during the inspection of Madarsa by the officials of the Education Department

or the Board, their salary shall be deducted of the inspection date, the

compliance whereof is mandatory.

(v) The disposal of work assigned by the Board or State Govt. shall be essential.

13. Disciplinary action:-

(i) The Managing Committee will have jurisdiction to take disciplinary action on

the complain of beating or torture to the Children.

(ii) The Head Moulvi shall initiate disciplinary action against the employee on the

ground of deliberate absence of habitual late comers.

(iii) In case of any sort of misconduct being prima facie proved against any

teaching or non-teaching staffs the following disciplinary action shall be

taken.

(iv) The Committee shall be competent to take disciplinary action and award

major or minor punishment to any teaching / non-teaching staff of the

Madarsa. The Committee may impose to any employee the following

punishment: -

(A) Minor Punishment

(I) Censure

(II) Withholding of promotion

(III) Full or partial recovery from the salary of the employee for the financial

loss caused to the Govt. owing to negligence or disobedience.

(B) Major Punishment:-

(I) Compulsory retirement.

(II) Removal from service which shall not be a disqualification for future

employment.

(III) Dismissal from service which shall ordinarily be a disqualification for

future employment.

Provided that, in every case in which the charge of acceptance from any person of

any gratification, other than legal remuneration, as a motive or reward for doing or

forbearing to do any official act is established, the penalty mentioned in clause (A) or

clause (B) shall be imposed.

Provided further that in any exceptional case and for special reasons to be

recorded in writing, any other penalty may be imposed.

(v)

In case of unsatisfactory service or charge of misconduct is reported against any

probationer he shall be provided opportunity to explain the charges and in case his

reply is not found satisfactory he shall be terminated from service.

(vi)

In course of disciplinary action the Managing Committee shall put such employee

under suspension so that he may not be able to make interpolation in the record or

cause any loss to the property of the Madarsa.

(vii) The Committee shall provide an adequate opportunity for giving due written

explanation to the person concerned for his conduct and in that matter, the decision

of the Committee shall be final.

(viii) In case of any serious allegation against any teacher, the Head Moulvi and in case

of Head Moulvi or Non-teaching staffs the Chairman and Secretary of the

Managing Committee shall prepare a detailed statement of allegations and the

committee shall take appropriate decision. The statement of allegations shall be

specific and all the relevant facts shall be incorporated therein to enable the

delinquent to easily understand/grasp the charges. If the Managing Committee

realises that the charges are prima facie so grave that the continuance of employee

shall be detrimental in general interest and discipline in that event the departmental

proceeding shall be initiated after putting the delinquent employee under

suspension.

(ix)

In case the proceedee is exonerated from the charges the period of suspension shall

be treated to be on duty and he would be entitled for entire salary and allowances

for that period. If the committee considers to inflict major punishment in that event

the period of suspension shall not be treated to be on duty.

(x)

If the committee considers to impose major punishment in that event after

imposing the said punishment an intimation shall be sent to the Bihar State

Madarsa Education Board.

(xi)

The person being aggrieved from the decision of the Managing Committee may

prefer an appeal before Bihar State Madarsa Education Board within 60 days from

the date of passing of the impugned order and the Board shall take appropriate

decision after hearing all the respective parties. The Secretary of the Bihar State

Madarsa Education Board shall communicate the decision. The person being

aggrieved from the decision of the Board may prefer an appeal before the

Appellate Authority (Authorized by the Education Department, Govt. of Bihar to

hear appeal from time to time) within 60 days from the date of passing of the

impugned order.

14. Leave: - The Teaching and Non-teaching staffs of Non-Govt. Recognized Aided

Madarsa in addition to fixed leave they will be entitled for the following leave:-

(i) Casual Leave - In every calendar year twelve (12) days casual leave will be

admissible to every teaching and non-teaching staffs of Non-Government

Recognised Aided Madarsa. The casual leave of Head Moulvi of the Madarsa

will be sanctioned by the Secretary of Madarsa Managing Committee whereas

the Head Moulvi of the Madarsa will sanction the casual leave of all teaching

and non-teaching staffs of the Madarsa. Maximum seven casual leave can be

sanctioned at one time and the fixed leave coming during casual leave cannot be

counted in casual leave.

(ii) Earned Leave - (A) Every teaching and non-teaching staffs of Madarsa shall

earn leave for 03 (Three) days in a year. The teaching and non-teaching

employee of Madarsa shall earn leave during working period of every calendar

year the maximum period whereof would be 120 days. The leave earned for

more than 20 days shall expire automatically.

(B) Every teaching / non-teaching staff of the Madarsa will earn twenty (20) days

leave on half pay for working period of every calendar year. It will not lapse. It

can be converted into full pay on medical certificate and will be half of this

leave. Earn leave of Head Moulvi / Principal of the Madarsa will be sanctioned

by Secretary of Madarsa Managing Committee and Head Moulvi of the

Madarsa will sanction the earn leave of all teachers and non-teaching staffs of

the Madarsa.

(iii) Study leave - Confirmed teaching and non-teaching staffs of the Madarsa, after

completion of 03 (Three) years of their service, can get three years study leave

without pay in their whole tenure. It shall be sanctioned by the Board on the

recommendation of Managing Committee of the concerned Madarsa. Study

leave will not affect the service condition of the teaching / non-teaching staffs.

(iv) Maternity leave – Ninety days (90 days) maternity leave will be admissible to

female teacher/staff for first two children only. The Secretary of Madarsa

Managing Committee will sanction in case of woman Head Moulvi while the

Head Moulvi of the Madarsa will sanction the maternity leave in case of woman

teaching / non-teaching staff.

(v) Special leave - In every month two days special leave will be admissible for

woman teaching / non-teaching staff and it will be sanctioned by the Head

Moulvi of the Madarsa. The Secretary of Madarsa Managing Committee will

sanction the special leave of the woman Head Moulvi

15. Miscellaneous: -

(i) Maintenance of Service Book:- Service book of every teaching and non-

teaching staff shall be maintained in every Madarsa.The Service book of teachers of

Madarsa shall be attested by the Secretary of the Managing Committee whereas the

service book of the non-teaching staffs shall be attested by the Head Moulvi of the

Madarsa.The details of concerned employee shall be maintained in the service book

like the employees of the Govt. School.

(ii) Annual Confidential Report:- Annual confidential report of each teaching/non

teaching employee of every Madarsa shall be maintained every year. The Annual

confidential remarks shall be recorded at the end of every academic session.

The Secretary of the Committee shall record Annual remarks of Head Moulvi and

he will send it to the Secretary of the Madarsa Board along with resolution of the

Committee and his comments. Likewise the Annual remarks of the teaching and

non-teaching staffs shall be recorded by the Head Moulvi and the same will be

transmitted to the Secretary of the Board along with the resolution of the committee

and comment of the Head Moulvi.

In case of recording adverse remarks against any teaching and non-teaching

employee in any particular year then in that event the same will be communicated

to the concerned employee within three months in the beginning of next session. In

case the concerned employee feels that such adverse remarks are not based on

facts/substance, he may prefer appeal before the Chairman of the Board who in turn

will take appropriate decision after hearing the aggrieved person. In case of being

aggrieved from the decision of the Board or Chairman of the Board the aggrieved

may prefer an appeal before Appellate Authority (Being authorized by the State

Govt. to hear appeal) and the Appellate Authority will be obliged to take

appropriate decision after hearing the respective parties.

16. Power to remove difficulties:-

(i) The State Govt. may clarify any of the provisions of these Rules and will

remove the difficulties in implementing the same.

(ii) The Board shall determine the subjects and the equivalent degree for

recruitment of Assistant Teacher after obtaining concurrence from the State Govt.

(iii) In case of any anomaly erupted in any provisions of the Rules the same would

be rectified after obtaining concurrence from the Finance Department as well as

General Administration Department.

17. Repeal and Savings:-

(1)

From the date of commencement of these Rules, all previous Rules,

Resolutions, Orders, and Instructions etc. relating to Services condition of teaching

and non-teaching staffs are hereby repealed.

(2)

Notwithstanding such repeal, anything done or any action taken under the

previous Rules, Resolutions, Orders, Instructions prior to commencement of these

Rules shall be deemed to be done or taken under these Rules as if these Rules were

in force on that day on which such thing was done or such action was taken.
