No.76/BR-LA/2020/38/CEMS-III--WHEREAS,
the
General
Election
to
the
Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India
vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the
date of counting of votes was 10 November, 2020.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951,
every contesting candidate at an election has to, within 30 days from the date of election of
returned candidate, lodge a true copy of the account of his election expenses with the
District Election Officer;
AND, WHEREAS, the result of the said election along with 38- Jhanjharpur
Assembly Constituency was declared by the concerned Returning Officer on 10th
November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th
December, 2020;
AND WHEREAS, as per the report dated 18th December, 2020, vide letter no. 63
submitted by the District Election Officer, Madhubani, Bihar and forwarded by the Joint
Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-38)
Jhanjharpur-, dated 23 December, 2020 Sh. Raj Kumar Saday, a contesting candidate of
Bihar from 38- Jhanjharpur Assembly Constituency of Bihar, has failed to lodge account
of his election expenses, in the manner, as required under law;
AND WHEREAS, on the basis of the reports of the District Election Officer,
Madhubani, Bihar and the Chief Electoral Officer, Bihar, a Show- Cause notice, dated 25th
June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961
by the Election Commission of India to Sh. Raj Kumar Saday, for not lodging the account
of Election Expenses;
AND WHEREAS, as per the sub rule(6) of Rule 89 of the Conduct of Election
Rules, 1961, through the above said Show- Cause Notice, dated 25th June, 2021, Sh. Raj
Kumar Saday, was directed to submit his representation in writing with explaining the
reason for not lodging the account and to lodge account of election expenses within 20 days
from the date of receipt of the notice;
AND WHEREAS, the said notice was received by candidate on 28th September,
2021, at the address given by candidate. The acknowledgment receipt has been submitted to
the Commission by the District Election Officer, Madhubani, vide its letter no.
925/District. Nirva, dated 02th November, 2021;
AND WHEREAS, the District Election Officer, Madhubani, in his
Supplementary Report, vide its letter No. 925/ Nirva, dated 02 November, 2021 has reported
that Sh. Raj Kumar Saday, has neither submitted any representation nor any statement of
account of election expenses till date. Further, after receipt of the due notice to the Election
Commission of India, he has furnished neither any reason nor explanation for the said
failure;
AND WHEREAS, the Commission is satisfied that Sh. Raj Kumar Saday, has
failed to lodge the account of election expenses and has no good reason or justification for
the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951
provides that :-
“If the Election Commission is satisfied that a person:
i. has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
ii. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare
him to be disqualified and any such person shall be disqualified for a period of three years
from date of the order”;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the
People Act, 1951, the Election Commission of India hereby declares Sh. Raj Kumar
Saday, resident of Ward No.- 12, Vill- Hasauli Kalyanpur, Post- Bhith Bhagwanpur,
Distt.- Madhubani, a contesting candidate from 38-Jhanjharpur, Assembly Constituency of
the State of Bihar in the General Election to the Legislative Assembly of Bihar, 2020 to be
disqualified for being chosen as and for being a member of either House of the Parliament
or the Legislative Assembly or the Legislative Council of a State or Union Territory for a
period of three years from the date of this order.
