ORDER
Nirvachan Sadan, Ashoka Road, New Delhi-110001/dated 04 August, 2022,
13th Shravana, 1944 (Saka)
No. 76/BR-LA/2020/112/CEMS-III— WHEREAS, the General Election to the Legislative
Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No.
ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was
10 November, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate at an election has to, within 30 days from the date of election of the returned
candidate, lodge a true copy of the account of his election expenses with the District Election
Officer;
AND, WHEREAS, the result of the said election along with 112-Maharajganj Assembly
Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the
last date for lodging the account of Election Expenses was 10th December, 2020;
AND WHEREAS, as per the report dated 24th December, 2020, vide letter no. 271 submitted
by the District Election Officer, Siwan, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar
vide their letter No. Expenditure-21/2020(Vol.-112)Maharajganj-163, dated 06, January 2021,
Sh. Vishwanath Yadav, a contesting candidate of Bihar from 112-Maharajganj Assembly
Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as
required under law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Siwan, Bihar and
the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued under sub
rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to
Sh. Vishwanath Yadav, for not lodging the account of Election Expenses;
AND WHEREAS, as per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961,
through the above said Show-Cause Notice, dated 25th June, 2021, Sh. Vishwanath Yadav was
directed to submit his representation in writing with explaining the reasons for not lodging the
account and to lodge account of election expenses within 20 days from the date of receipt of the
notice;
AND WHEREAS, the said notice was received by the candidate on 05th August, 2021 at the
address given by the candidate. The acknowledgment receipt has been submitted to
the Commission by the District Election Officer, Siwan, vide its letter no.148-1/.Nirva, dated:
08th December, 2021;
AND WHEREAS, the District Election Officer, Siwan, in his Supplementary Report, vide its
letter No. 148-1/Nirva., dated 08th December, 2021 has reported that Sh. Vishwanath Yadav has
neither submitted any representation nor any statement of account of election expenses till date.
Further, after receipt of the due notice of the Election Commission of India, he has furnished neither
any reason nor explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Sh. Vishwanath Yadav has failed to lodge
the account of election expenses and has no good reason or justification for the failure,
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and

has no good reason or justification for the failure, the Election Commission
shall, by order published in the Official Gazette, declare him to be disqualified and
any such person shall be disqualified for a period of three years from the date of the
order”;
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Sh. Vishwanath Yadav, resident of
Vill+Post- Bangra, P.S- Maharajganj, Dist.- Siwan, a contesting candidate from 112-Maharajganj,
Assembly Constituency of the State of Bihar in the General Election to the Legislative Assembly of
Bihar, 2020 to be disqualified for being chosen as and for being a member of either House of the
Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a
period of three years from the date of this order.
