"13. In view of such procedural irregularity, the consequential findings of the
Disciplinary Authority based on such illegal and unfair procedure is unsustainable. In this
connection, this Court would only reiterate the law as laid down by the Apex Court in the
case of Punjab National Bank and Others-Versus-Kunj Behari Misra, (1998) 7 Supreme
Court Cases 84. The punishment imposed by the Disciplinary Authority under
communication dated 04.12.2012 being outcome of a procedure in violation of Rule 18 of
Bihar CCA Rules, 2005 as also the law in this regard in the case of Kunj Behari Misra
(supra) is, therefore, quashed.
14. In view of quashing of the order of punishment, the consequential order issued
by the Joint Secretary (respondent No 3) reiterating the illegal order of the Disciplinary
Authority and without considering the illegal procedure adopted by the Disciplinary
Authority and communicating rejection of petitioner’s appeal under Letter dated 03.05.2013
bearing Memo No.-7088 are also unsustainable and are hereby quashed.
15. The writ petition is allowed.
16. As a result of quashing of the impugned order, the petitioner would be entitled to
all consequential benefits.
17. However, this order would not preclude the respondent-authorities from
proceeding against the petitioner by following the procedure prescribed under Bihar CCA
Rules, and in accordance with law."

ßIn my opinion, the findings recorded by the Hon'ble High Court cannot be faulted
to the extent that the letter no. 972 dated 13.02.2012 of the District Magistrate, Nalanda was
nowhere discussed by the Inquiry Officer in his inquiry report. If this letter was not part of
the departmental proceeding, then the same could not have been based for recording
difference. However, the Presenting Officer did bring on record D.D.C. letter no. 3234 dated
12.12.2011 and D.M. letter no. 784 dated 04.02.2012. If these two documents are

substantially same and similar as that of letter no.972 dated 13.02.2012 of the D.M. Nalanda
then a point can be raised that no substantial prejudice is caused to the delinquent. However,
the grounds of appeal prepared as draft and kept at page-1175-1173/C, does not sugest the
same. Under the given facts, there is very little scope of success if the state proposes to go in
appeal againts the Single Judge order. The penalty imposed is minor in nature and liberty is
already given to continue the proceeding afresh against the delinquent, if desired by the state
in accordance with law.Þ
