ORDER
Nirvachan Sadan, Ashoka Road, New Delhi-110001—Dated 17 August, 2022/26th Shravan,
1944 (Saka)
No-76/BR-LA/2020/229/CEMS-III-- WHEREAS, the General Election to the
Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India
vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the
date of counting of votes was 10 November, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951,
every contesting candidate at an election has to, within 30 days from the date of election
of the returned candidate, lodge a true copy of the account of his election expenses with
the District Election Officer;
AND, WHEREAS, the result of the said election along with 229- Bodh Gaya (SC)
Assembly Constituency was declared by the concerned Returning Officer on
10th November, 2020. Hence, the last date for lodging the account of Election Expenses
was 10th December, 2020;
AND WHEREAS, as per the report dated 16th December, 2020, vide letter no. 2477
submitted by the District Election Officer, Gaya, Bihar and forwarded by the Joint Chief
Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-229) Bodh Gaya (SC)
- 7961, dated 31, December 2020, Sh. Rabindra Rajbanshi, a contesting candidate of Bihar
from 229-Bodh Gaya (SC) Assembly Constituency of Bihar, has failed to lodge account of
his election expenses, in the manner, as required under law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Gaya,
Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was
issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election
Commission of India to Sh. Rabindra Rajbanshi, for not lodging the account of Election
Expenses;
AND WHEREAS, as per the sub rule (6) of Rule 89 of the Conduct of Elections Rules,
1961, through the above said Show-Cause Notice, dated 25th June, 2021, Sh. Rabindra
Rajbanshi, was directed to submit his representation in writing with explaining the reason
for not lodging the account and to lodge account of election expenses within 20 days from
the date of receipt of the notice;
AND WHEREAS, the said notice was received by the candidate on 02nd September,
2021 at the address given by the candidate. The acknowledgement receipt has been
submitted to the Commission by the District Election Officer, Gaya, vide its letter
no.528/.Nirva, dated 09th October, 2021;
AND WHEREAS, the District Election Officer, Gaya, in his Supplementary Report,
vide its letter No. VII-137/20-619/Nirva., dated 25th November, 2021 has reported that Sh.
Rabindra Rajbanshi, has neither submitted any representation nor any statement of
account of election expenses till date. Further, after receipt of the due notice of the
Election Commission of India, he has furnished neither any reason nor explanation for the
said failure;
AND WHEREAS, the Commission is satisfied that Sh. Rabindra Rajbanshi, has failed
to lodge the account of election expenses and has no good reason or justification for the
failure,

AND WHEREAS, Section 10A of the Representation of the People Act, 1951
provides that:-
“If the Election Commission is satisfied that a person-
i. has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
ii. has no good reason or justification for the failure.
the Election Commission shall, by order published in the Official Gazette, declare him to
be disqualified and any such person shall be disqualified for a period of three years
from the date of the order”;
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People
Act, 1951, the Election Commission of India hereby declares Sh. Rabindra Rajbanshi,
resident of Vill- Pitaura, PO-G.B.Kendua, PS- Sirdala, Dist.- Nawada, a contesting
candidate from 229-Bodh Gaya (SC) Assembly Constituency of the State of Bihar in the
General Election to the Legislative Assembly of Bihar, 2020 to be disqualified for being
chosen as and for being a member of either House of the Parliament or the Legislative
Assembly or the Legislative Council of a State or Union Territory for a period of three years
from the date of this order.
