The 8th October, 2022

No.-M./Yojana-08/2016-3326--Bihar state is rich in various types of water

resources, in which ponds/ tanks, Ox-bow lakes, wetlands, rivers, reservoirs are

prominent. There are 37

reservoirs in Bihar, which are spread in over 26, 000

hectares.

From fisheries point of view, "Reservoir" is an important water-source which has great

potential for fisheries development. There are about 30, 000

water bodies (ponds/tanks,

Ox-bow Lakes, wetlands and lakes etc.) under the control of Fisheries Directorate in the

state, which are leased out to the block-level Fishermen Cooperative Societies under the

"Bihar Jalkar Management Act". The management of reservoirs located in some districts

of the state (Banka, Nawada, Jamui, Lakhisarai, Munger, Sasaram etc.) are under Water

Resources Department. The settlement of these reservoirs is done with private persons by

the said department, but the production/productivity is extremely unsatisfactory.

Therefore, there is a need for a specific policy for better management of these reservoirs.

For the past several decades, the implementation of several schemes of the State

Government in other water-sources has resulted in an increase in fish productivity and

production, but due to lack of Fisheries Rights in reservoirs with the Animal and

Fisheries Resources Department, fisheries development is low compared to that of other

states. The entire water source of the reservoirs can be utilized for fish production by

having fisheries rights with the Animal and Fisheries Resources Department. In May-

2020, “No Objection Certificate” for "pen culture" in the reservoirs of the state has been

given by the Water Resources Department. Most of the reservoirs present in the state are

of small and medium size, whose fish productivity is only 4.92 kg/ha/year, whereas the

fish productivity of small and medium reservoirs of the country is about 50 kg/ha/year

while the production capacity of these reservoirs is 250 kg/ha/year. In such a situation,

for the holistic fisheries development of the reservoirs of the state, "Bihar State

Reservoir Fisheries Policy 2022" is being notified so that overall development of

reservoir fisheries can be done through scientific management.

2. Main Objectives of Reservoir Policy: -

i. To augment the fish production and productivity in the reservoirs of the state

through scientific management.

ii. To promote its conservation and long-term sustainable fisheries by

incorporating reservoir fisheries management techniques.

6

बहर गजट [सधरण 11 [Ç त$बर% 222

iii. To develop skills and entrepreneurship in the management of reservoir

fisheries.

iv. To generate rural employment through fisheries activities alongwith sports

fishery, boating etc., in the reservoirs.

v. To generate additional revenue for the State and to contribute in the growth of

the State's Gross Domestic Product.

3. Fisheries Management in Reservoir: -

Mainly the following works will be done for the development of Reservoir

Fisheries: -

i. Stocking of fingerlings of Native species in the reservoirs.

ii. Cage and pen based fish culture.

iii. Construction of infrastructure (hatcheries, rearing ponds, landing centers, feed

mills, sheds etc.) on suitable land/terrain near reservoirs.

4. Classification of the Reservoirs: -

The classification of the reservoirs is done on the basis of the average water holding

area in the reservoirs as follows, which is in accordance with the reservoirs’ classification

of the Government of India: -

(a) More than 10 ha and less than 1000 ha

- Small reservoir.

(b) More than 1000 ha and less than 5000 ha

- Medium reservoir.

(c) 5000 ha and above

- Large reservoir.

5. Fisheries Rights in Reservoirs: -

Animal and Fisheries Resources Department will be given fisheries rights in all the

reservoirs of the state. Under the Reservoir Policy, the management of the reservoirs

received from the Water Resources Department will not be covered under the Bihar

Jalkar Management Act. Animal and Fisheries Resources Department will issue

guidelines for fisheries development and proper management of all such reservoirs. In

case of the reservoirs which will be built/developed by the Water Resources Department

in future, the transfer of 'fisheries rights' to Animal and Fisheries Resources Department

will be done after obtaining a no-objection certificate from the Water Resources

Department. After the transfer of fisheries rights the responsibility of enhancing fish

production and productivity through fisheries development in all such reservoirs will be

the responsibility of the Animal and Fisheries Resources Department.

a) Implementation of fisheries development scheme and other fisheries activities fish

harvesting can be done in reservoir without affecting the original objective of the

reservoirs.

b) For stocking fish fingerlings in reservoir, Animal and Fisheries Resources

Department will prepare infrastructural facilities like nursery/rearing ponds, fish

hatchery, shed etc. near the reservoir.

c) For fisheries development, infrastructure facilities and infrastructure structures

such as link pathway/roads, electricity, common space, nursery/rearing units, fish

hatchery, fish landing center, sheds etc. will be constructed in such a way that the

irrigation/supply of drinking water, maintenance and repair as per requirement

etc. activities of reservoir are not obstructed.

d) For the management of the fisheries development in reservoirs a "Coordination

Committee" will be formed at the district level, which will have the following

members: -

1. Executive Engineer, Water Resources Department

- Chairman

2. Deputy Director of Fisheries (Range)

- Member

7

4.District Fisheries Officer-cum-Chief Executive Officer

- Member-Secretary

5. Assistant Engineer (Fisheries)

- Member

6. Concerned Circle Officer

- Member

7. Fisheries Extension Officer

- Member

The meeting of the above Committee will be held in every three months or as

required.

Functions of the Coordinating Committee -

(a) The Committee constituted will recommend for no-objection certificate/ transfer

of fisheries rights of other constructed/developing Reservoirs owned by the

Water Resources Department.

(b) Take necessary initiatives to remove the inter-departmental bottlenecks in the

implementation of the fisheries development schemes.

(c) Will mark the suitable sites for the construction of fisheries infrastructure in the

area near the Reservoir.

(d) Will assist in the selection of suitable sites (notch, curve and nose) for

installation of cage/pen in the Reservoir.

(e) Appropriate recommendations/decisions can be taken as per the local situation

to deal with the emergency situation (flood] drought etc).

(f) Any other work.

6. Reservoir Fisheries Operational Strategy: -

The following procedures will be adopted for Reservoirs fisheries operational

strategy in the reservoirs located in Bihar -

i. Under the "Integrated Reservoir Management Model" of reservoir fisheries

development, stocking of fish fingerlings in the open reservoir (main water

spread area) and cage & pen based fisherieswill be carried out in the marginal

area (‘curve’, ‘notch’ and part of ‘nose’ water area) of the reservoir.

ii. The settlement of reservoirs will be done through open bid. The settlee/leasee

with whom the reservoirs have been settled through open bid will stock fish

fingerlings as per set standards and carry out cage/pen based fish culture

through which fish production and productivity of the reservoirs can be

enhanced.

iii. Guidelines regarding cage/pen based fisheries in the reservoir will be issued

separately.

iv. The amount of reserve deposit for small, medium and large sized reservoir

will be Rs.1000/ha, Rs.500/ha and Rs.250/ha respectively which will be

reviewed from time to time.

v. The bid will commence with the fixed reserve deposit and the successful

concerned leasee will deposit the highest bid amount. This amount will be

deposited by the District Fisheries Officer in the income head of the Water

Resources Department.

vi. The responsibility of stocking fingerlings and other fisheries developments

like cage/pen culture etc in all such leased/leased out through open-bid,

reservoirs will be of the concerned lessee.

vii. The action related to the bid of the reservoir will be executed by the concerned

District Fisheries Officer. After the recommendation of the Deputy Director of

Fisheries (Range), it will be necessary to obtain due approval of Director

8

बहर गजट [सधरण 11 [Ç त$बर% 222

Fisheries, before issuing the parwana (fishing license) for the leased out of

reservoirs through open bid.

viii. The Department will have the right to keep any such reservoir for training,

research, brood collection and dissemination etc. purpose. As required the

Department will also get these works done by establishing coordination with

the lessee of the settled reservoir. University and Fisheries Research Institute

will be involved in training, research, and extension etc. in reservoirs.

ix. Fishing will be prohibited upto 500 meters in the up-stream and down-stream

from the dam of large reservoirs. Similarly, in medium and small reservoirs,

fishing will be prohibited upto 100 meters up-stream and down-stream from

the dam. This restriction can be altered in consultation with the local Engineer

of the Water Resources Department. But fishing will be prohibited in all the

canals emanating from the reservoirs. Also, the system of fishing being

implemented in these canals by the Water Resources Department will remain

the same.

x. For integrated fisheries development, the Department will construct any

permanent structure, other than nursery/rearing pond, fish hatchery, landing

center, shed etc. on the basis of consultation and after obtaining due

permission from the Water Resources Department.

xi. The fisheries activities, fish harvesting and other related activities in reservoir

shall be carried out in such a way that there is no obstruction or damage is

caused to the structure and operation of the dam.

xii. In order to increase fish productivity and production in the reservoir, cage and

pen will be installed in suitable parts of the reservoirs. For this, curve, notch

and nose water-spread area of the reservoir will be identified. Depending on

the availability of modern materials for the construction of cage and pen,

different sizes and types of cages/pens are installed. Usually, the size of a cage

is 6m by 4m by 4m (4 to 6 cages are interlocked to form a group of cages

which is called a battery). Normally 2.5 to 3.0 tonnes of fish is produced per

cage. Similarly, 3 to 5 acres of water-spread area is constructed in a pen, in

which 3 to 4 tonnes per hectare of fish are produced. With the successful

implementation of this policy, about upto Rs 225 Crores additional income to

State Gross Domestic Product will be generated from the installation of cages

and pens in the reservoirs.

xiii. The main objective of the construction of reservoirs is to provide water for

irrigation in the fields. In case of non-availability of sufficient quantity of

water in the event of drought, even if the fisheries is affected, water will be

made available in the canals on priority basis as per the requirement. No

dispute/obstruction whatsoever will be entertained on this by the lessee and

user Department.

xiv. In case of excessive rainfall and accumulation of maximum water in the

reservoir, water is flowed out by opening the sluice gates. In this situation, in

case the cages/pens get damaged and accumulates as a blockage in the sluice

gates there may be a possibility of obstruction of water flow. To deal with that

emergency situation, it will be the responsibility of the lessee to make

arrangement as required, to remove the cages/pens without delay.

xv. For the inclusion of scientific fisheries technology in the State's reservoirs,

conservation of fish-biodiversity and proper fisheries management, the

Animal and Fisheries Resources Department will be able to establish a

separate "Reservoir Division" as previously.

7. Lease period: - The settlement period of all types of reservoirs will be for five

fisheries years (1st July to 30th June). In case of non-satisfactory work and violation of

conditions by leasee, after verification, the settlement through lease/open bid will be

cancelled by giving notice and with the approved of Director Fisheries, and thereafter

9

बहर गजट [सधरण 11 [Ç त$बर% 222

again the settlement through open bid will be undertaken and outstanding amount (if any)

will be recovered by filing of Certificate case under Public Demand Recovery Act.

8. Conservation Strategy in Reservoir Fisheries: -

i. In the Reservoirs, there shall be ban on fishing of brooders of Indian Major Carp

(IMC) fishes and other such species which are to be conserved by the

Department from 15th June to 30th August.

ii. Endangered and on the verge of extinction fish species in the water resources of

the state ¼namely- Chakka chakka, Chagunius sp, Chagunio, Channa Species,

Chitala

chitala,

Acuticephala,

Hemibagrus,

pavo,

Sisorhabdophorus, Ctenops, Nobilis, Daniodangila, Glyptothorax telchitta,

Puntius chola, Puntius sarana, Rhinomugil corsula, Silonia silondia½ shall be

conserved and re-established in particular reservoir.

iii. In the reservoirs, there shall be a ban of capture, fishing and sale of Indian

Major Carp fishes below 250 mm in length in order to give these fish at least

one opportunity to breed.

iv. In the reservoirs, there shall be a ban of operation of gill nets below 100 mm of

stretched mess size.

v. There will be a ban on catching/killing of fish with poison, poisonous

chemicals, dynamite and other explosives in the reservoirs.

vi. There will be a ban on the installation of any kind of fence, net-bamboo

trap/fencing, gill net etc. obstructions across the water inlet drainage and in the

canals (head regulator) emanating from the reservoirs.

vii. Animal and Fisheries Resources Department can declare any part of the

reservoir as a protected area only after obtaining prior permission of the Water

Resources Department.

viii. Unauthorized fishing in the reservoir shall be considered illegal.

ix. There will be prohibition of industrial effluents and sewage discharge into the

reservoir.

x. No exotic-fishes shall be reared or introduced in the reservoir without prior

permission of the Animal and Fisheries Resources Department, so that the

genetic purity of native species remains intact.

9. Enforcement Measures in Reservoir: -

i. Animal and Fisheries Resources Department can nominate Fisheries Extension

Officer as “Authorized Officer” in the form of enforcement officer.

ii. These officers will have the right to inspect the fishes, boat, net, equipment,

fish hatchery, nursery/rearing pond, shed, landing platform etc. of the reservoir.

iii. The authorized officers will ensure that there is no illegal poaching in the

reservoir and take necessary legal action as required.

10. Evaluation: -

The assessment of fisheries development in the reservoirs can be done by the

Animal and Fisheries Resources Department after every five years through an

autonomous reputed organization.

By order of the Governor of Bihar,

Dr. N. Saravana Kumar,

Secretary to the Government.
