No.76/BR-LA/2020/79/CEMS-III--WHEREAS, the General Election to the Legislative
Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press
Note No. ECI/PN/64/2020, dated 25 September, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951,
every contesting candidate at an election has to, within 30 days from the date of election
of the returned candidate, lodge a true copy of the account of his election expenses with
the District Election Officer;
AND, WHEREAS, the result of the said election along with 79-Gaurabauram
Assembly Constituency was declared by the concerned Returning Officer on
10th November, 2020. Hence, the last date for lodging the account of Election Expenses
was 10th December, 2020;
AND WHEREAS, As per the letter of Chief Electoral Officer, Bihar dated 23rd
December, 2020 vide letter no. Exp-21/2020(Vol.-79)Gaurabauram/7794, on the basis of
scrutiny report submitted by the District Election Officer, Darbhanga, Bihar, Shri Khwaza
Mohammad Fakharuddin , a contesting candidate from 79-Gaurabauram Assembly
Constituency of Bihar, has failed to lodge account of his election expenses, in the manner,
as required by law under Rule 89 sub-rule (1).
AND WHEREAS, on the basis of the reports of the District Election Officer,
Darbhanga, Bihar Show-Cause Notice no. 76@fcgkj-fo- l@2020@lhbZ,e,l&III dated 25th June, 2021
was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the
Election Commission of India to Shri Khwaza Mohammad Fakharuddin , for not lodging
the account of Election Expenses;
AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules,
1961, through the above said Show-Cause Notice, Shri Khwaza Mohammad Fakharuddin
was directed to submit his representation in writing with explaining the reasons for not
lodging the account and to lodge account of election expenses within 20 days from the
date of receipt of the notice;
AND WHEREAS, District Election Officer, Darbhanga, vide its letter no. 12/Nir.
dated 5.01.2022 informed to the Commission that the said notice was received by Shri
Khwaza Mohammad Fakharuddin on 14.07.2022;
AND WHEREAS, the District Election Officer, Darbhanga, in his Supplementary
Report, vide its letter No. 585/Nir. Dated 24.05.2022 has reported that Shri Khwaza
Mohammad Fakharuddin , has neither submitted any representation nor any statement of
account of election expenses. Till date further, after receipt of the due notice of the
Election Commission of India, he has neither furnished any reason nor explanation for the
said failure;
AND WHEREAS, the Commission is satisfied that Shri Khwaza Mohammad
Fakharuddin , has failed to lodge the account of election expenses and has no good reason
or justification for the failure,
AND WHEREAS, Section 10A of the Representation of the People Act, 1951
provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
vi. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare
him to be disqualified and any such person shall be disqualified for a period of three
years from the date of the order”;
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People
Act, 1951, the Election Commission of India hereby declares Shri Khwaza Mohammad
Fakharuddin , resident of Village- Lavtoliya, Laxminia, Post- Beri, Thana-Kusheshwar
Asthan, District- Darbhanga, a contesting candidate from 79-Gaurabauram Assembly
Constituency during General Election to the Legislative Assembly of Bihar 2020, to be
disqualified for being chosen as and for being a member of either House of the Parliament
or the Legislative Assembly or the Legislative Council of a State or Union Territory for a
period of three years from the date of this order.
