The 30^th November, 2022

No. 11/Utpad Niti-01-03/2021/9059—In exercise of the powers

conferred under Section-95 of Bihar Prohibition and Excise Act, 2016 the

Government of Bihar is pleased to make the following rules to amend the Bihar

Prohibition & Excise Rules, 2021 as further amended vide notification no.

11/Utpad Niti-01-03/2021/2458 dated 05th April 2022:-

1. Short title extent and commencement.-(1) These rules may be called

The Bihar Prohibition & Excise (Amendment) Rules, 2022.

(2) These rules shall come into force on the date of their publication in

the official gazette.

(3) It shall extend to the whole of the State of Bihar and shall apply to all

pending cases.

2. Amendment of Rules 14 (Disposal of Seized/Confiscated things) of

Bihar Prohibiton and Excise Rules, 2021 : -A proviso after “Explanation” to

Rule 14 of Bihar Prohibition and Excise Rules, 2021 (as further amended vide

notification dated 05th April 2022) shall be inserted as per the following :-

“Provided

a) where no person/owner has appeared before the Collector or the

Officer authorized by him, in the confiscation proceeding despite

sufficient notice and

b) Where the order of confiscation, therefore, is made ex-parte, and

c) Where 90 days have passed since the seizure of the article and no

person/owner has approached either the Collector or the Officer

authorized by him or the Excise Commissioner,

the Excise Commissioner, upon a report by the Collector, may direct the

Collector or the Officer authorized by him to proceed with the public auction in

all such cases.”
