The 30 November 2022

No. 3/M- 78 /2022/21262—In exercise of powers conferred by proviso to Article

309 of the Constitution of India, the Governor of Bihar makes the following Rules for

attaining computer competency by the employees of the State Government-

1. Short title, extent & commencement.—

(1) These Rules may be called the Bihar Government Servants (Computer

Competency Test Examination) Rules, 2022.

(2) It shall extend to the whole State of Bihar.

(3) It shall come into force at once.

(4) It shall be applicable to the Assistant of Bihar Secretariat Service,

employees of Supervisory cadres (including Junior Engineer) and those

employees of other services/cadres, where there is a provision of passing

in computer competency test examination in their respective service/

cadres rules.

2. Definitions.— In these Rules -

(a) ‘State Government’ means, Bihar State Government;

(b) ‘BIPARD’ means, Bihar Public Administration and Rural Development

Institute;

(c) 'Due date' means, the date of commencement of these rules;

(d) 'Examinstion' means, Computer Competency Test Examination.

3. Computer Competency Test Examination.—

(a)

Assistant of Bihar Secretariat Service, employees of Supervisory cadres

(including Junior Engineer) and those employees of other services/cadres,

where there is a provision of passing in computer competency test

examination in their respective service/cadres rules, shall, notwithstanding

any other provision contained in respective service/ cadre Rules, have to

pass in computer competency test examination conducted by Bipard.

(b)

The employees, whose services has already been confirmed but are

required to pass the computer competency test examination for getting

next annual increment, have to pass the Computer Competency Test

Examination conducted by Bipard to have the next annual increment.

(c)

Such withholding of increment shall be effective till the passing in the

examination. The withheld increments will be released with arrears after

submission of certificate of passing of examination.

(d)

Notwithstanding above provisions, the provision of relaxation in passing

of examination at a certain age in respective service/cadre rules shall

remain effective. The provisions of "Bihar Government Servant

Exemption from passing of Departmental Examination Rules, 2018" shall

remain applicable to this examination also.

(e)

It shall not be necessary to pass this examination by those employees who

have already passed in subject- Functional knowledge of Computer (Code-

02) of the departmental examination conducted by Central Examination

Committee, Board of Revenue, Bihar.

(f)

It shall not be necessary to pass this examination by those employees who

have already passed the Computer Competency Test Examination

conducted by DOEACC / NIELIT.

(g)

The syllabus of this examination will be same as the syllabus of subject-

Functional knowledge of Computer (Code-02) of the departmental

examination conducted by Central Examination Committee, Board of

Revenue, Bihar.

(h)

Bipard will make arrangement for training for this examination and its

conductance. Training fee and examination fee will determined by Bipard.

(i)

Government employees will appear in the examination after taking

training. But Government employees may appear in the examination even

without taking training.

4. Overriding effect.— Notwithstanding any provision contained contrary to the

provision of these Rules, in a Service/Cadre Rules of the State Government the provision of

these Rules shall have overriding effect.

5. Repeal and Savings.—

(i)

The relevant provision of respective service/ cadre Rules shall be deemed

to be repealed.

(ii) The Bihar Government Servants (Computer Competency for recruitment

and confirmation) Rules, 2011.

(iii) Notwithstanding such repeal, anything done or any action taken in the

exercise of any power conferred by or under the said Rules shall be

deemed to have been done or taken in the exercise of the power conferred

by or under these Rules.
