सं. 100/रा.स.-िबहार/13/2021(1) –यतः, िबहार राºय कì िवधान सभा के िनवाªिचत सदÖयŌ Ĭारा राºय सभा म¤ िनवाªिचत डॉ. महेÆþ
ÿसाद का Öथान िजनकì पदाविध 02.04.2024 सिहत उस तारीख तक थी के समाĮ होने से पूवª उनकì मृÂयु होने के कारण 27.12.2021से åरĉ हो
गया है; और
यतः, इस ÿकार हòई åरिĉ को भरने के ÿयोजन से उप-िनवाªचन कराना है;
अतः, अब लोक ÿितिनिधÂव अिधिनयम 1951 (1951 का 43) कì धारा 147, धारा 39 कì उपधारा (1) और धारा 56 के अनुसरण म¤
भारत िनवाªचन आयोग एतद्Ĭारा-
(अ) िबहार राºय कì िवधान सभा के िनवाªिचत सदÖयŌ से यह अपे±ा करता है िक वे 01 जून, 2022 से पूवª तथा उĉ अिधिनयम और तĦीन
बनाए गए िनयमŌ और उनके तहत जारी िकए गए आदेशŌ के उपबÆधŌ के अनुसार राºय सभा म¤ उĉ åरिĉ को भरने के ÿयोजन से एक Óयिĉ
िनवाªिचत कर द¤।
(आ) उĉ िनवाªचन के संबंध म¤:-
(क) नाम िनद¥िशत करने कì अिÆतम तारीख
– 19 मई, 2022 (गुŁवार);
(ख) नाम िनद¥शन कì संवी±ा कì तारीख
–20 मई, 2022 (शुøवार);
(ग) अËयिथªताएं वापस लेने कì अिÆतम तारीख
– 23 मई, 2022 (सोमवार);
(घ) वह तारीख िजसको यिद आवÔयक हòआ तो मतदान होगा
–30 मई, 2022 (सोमवार);और
(ड.) वह तारीख िजससे पूवª िनवाªचन सÌपÆन करा िलया जाएगा
– 01 जून, 2022 (बुधवार); िनयत करता है; और
(इ) 09:00 बजे पूवाªĹ से 04:00 बजे अपराĹ तक का समय उस समय के łप म¤ िनयत करता है िजसको, यिद आवÔयक हòआ तो, िविनिदªĶ
तारीख को मतदान होगा ।

No. 100/CS-BR/13/2021(1): - WHEREAS, the seat of Dr. Mahendra Prasad, in
the Council of States, elected by the elected members of the Legislative Assembly of
Bihar, has become vacant on 27.12.2021 by the reason of his death, before the
expiration of his term of office which was up to and including 02.04.2024; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so
caused;
NOW, THEREFORE, in pursuance of Section 147, sub-section (1) of Section 39
and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election
Commission of India hereby-
(A)
calls upon the elected members of the Legislative Assembly of Bihar to elect,
before 01st June, 2022 and in accordance with the provisions of the said Act and
of the rules and orders made thereunder, a person for the purpose of filling the
said vacancy in the Council of States;
(B)
appoints, with respect to the said election;
(a) the 19th May, 2022 (Thursday), as the last date for making nominations;
(b) the 20th May, 2022 (Friday), as the date for the scrutiny of the
nominations;

(c) the 23thMay, 2022 (Monday), as the last date for the withdrawal of
candidatures;
(d)
the 30th May, 2022 (Monday), as the date on which a poll shall, if
necessary, be taken; and
(e)
the 01st June, 2022 (Wednesday), as the date before which the election
shall be completed; and
(C)
fixes the hours from 09:00 am to 04:00 pm, as the hours during which the
poll shall, if necessary, be taken on the date specified above for the election.

(।) नीचे कì सारणी के ÖतÌभ (1) म¤ िविनिदªĶ अिधकारी को åरटिन«ग आिफसर के łप म¤ पदािभिहत करता है; और
(।।) उĉ सारणी के ÖतÌभ (2) म¤ िविनिदªĶ अिधकारी को åरटिन«ग आिफसर कì उसके कृÂयŌ के पालन म¤ सहायता के िलए सहायक åरटिन«ग
आिफसर िनयुĉ करता है ।

powers conferred by sub-section (1) of Section 22 of the Representation of the People
Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the
Government of the State of Bihar, hereby-
(i)
designates the officer, specified in column (1) of the TABLE below, to be
the Returning Officer; and
(ii)
appoints the officer, specified in column (2) of the said TABLE, to be the
Assistant Returning Officer to assist the Returning Officer in the performance of
his functions;
