The 13^th January, 2023

No. 394--The Section 37 of The Bihar Prohibition and Excise Act, 2016 Provides

that one time offender of liquor consumption shall be released on the payment of

prescribed penalty but repeat offender shall be liable to penalty or imprisonment or

both. Unique Identification Authority of India has been requested to provide facility for

Aadhaar Authentication to identify the repeat offenders under the said provision.

Whereas, the Government of India has vide its Office Memorandum, Ministry of

Electronics and Information Technology, File no. 13(18)/2022-EG-II, dated 4^th january’

2023, conveyed the approval of Unique Identification Authority of India to the

Department of Prohibition, Exicse and Registration under the Govt. of Bihar, for using

Aadhaar Authentication on voluntary basis for identifying repeat offenders under

section-37 under the Bihar Prohibition and Excise Act, 2016 using Yes/No or/and e-KYC

authentication facility, in terms of Rule-5 of the Aadhaar Authentication for Good

Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 (hereinafter referred

to as “the said rules”) read with sub-clause-b of Sub-Section 4 of Section 4 of the

Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act,

2016 (Hereinafter referred to as “the said act”).

Now, therefore in pursuance of the powers conferred by Sub-clause (ii) of clause

(b) of Sub-section (4) of Section-4 of the said Act and rule-5 of the said Rules, the

Government of Bihar, being authorized by Government of India in this behalf, hereby

authorize the Department of Prohibition, Excise and Registration to perform Aadhaar

authentication, on voluntary basis, for indentifying repeat offenders under section-37

under Bihar Prohibition and Excise Act, 2016, using Yes/No or/and e-KYC authentication

facility.
