THE BIHAR MUNICIPAL (AMENDMENT) ACT, 2022
(Bihar Act 05, 2023)
AN
Act
To amend the Bihar Municipal Act, 2007 (Bihar Act 11,2007).
Be it enacted by the legislature of the state of Bihar in the seventy
third year of the Republic of India as follows:-
1.
Short title, extent and commencement. - (1) This Act may be
called the Bihar Municipal (Amendment) Act, 2022.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force from the date of its publication in the
official gazette.
2.
Amendment of Section-435 of Bihar Act 11, 2007:-
(i)
Sub-Section (3) of Section 435 of the Bihar Municipal Act, 2007
shall be substituted by following:-
“(3) The Municipal Officer or the authorized officer shall issue fifteen
days prior notice for the removal of such permanent encroachment and
obstruction. In case of failure to satisfy the municipal officer or authorized
officer
with
reasons
regarding
such
permanent
encroachment
or
obstruction within fifteen days, the encroachment may be removed by
passing an order to remove encroachment/obstruction by the municipal
officer or authorized officer and the concerned encroacher may be punished

with Penalty and the cost of removal of such encroachment will be
recovered from the encroacher. In case of not recovered the amount of
Punishment and penalty, then as arrears of holding from such encroacher.
Provided that the municipal officer or the authorized officer may
remove the temporary encroachment and obstruction by giving twenty four
hours notice."
