In view of the above we are of the considered opinion that as injustice has

been done to the appellant without any fault on her part even though durning the

process of selection she has submitted the correct certificate that she belonged to the

OBC and was not of the creamy layer, she ought to have been offered the

appointment.

Thus, appeal succeeds and is allowed. The appellant is directed to be

appointed as Commercial Tax Officer giving all consequential benefits which had

been given to the person selected in place of her except the back wages.

However, this order is being passed in the peculiar facts and circumstances of

the case and shall not be treated as a precedent in any other case.

Before parting with the case, we would like to appreciate the effort and

gesture shown by the respondent authorities particularly the learned chief secretary.
