ORDER
Nirvachan Sadan, Ashoka Road, New Delhi-110001, Dated 11 January, 2023/21 Pausa, 1944 (Saka)
No. 76/BR-LA/2020/106/CEMS-III— WHEREAS, the General Election to the Legislative
Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No.
ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was
10 November, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate at an election has to, within 30 days from the date of election of the returned
candidate, lodge a true copy of the account of his election expenses with the District Election
Officer;
AND, WHEREAS, the result of the said election along with 106-Ziradei Assembly
Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the
last date for lodging the account of Election Expenses was 10th December, 2020;
AND WHEREAS, As per the report dated 24th December, 2020, vide letter no. 271
submitted by the District Election Officer, Siwan, Bihar and forwarded by the Joint Chief Electoral
Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-106) Ziradei/157, dated 06th January,
2021, Shri Markenday Kumar Upadhayay urf Bullet Baba, a contesting candidate from 106-
Ziradei Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the
manner, as required under law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Siwan,
Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued
under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission
of India to Shri Markenday Kumar Upadhayay urf Bullet Baba, for not lodging the account of
Election Expenses;
AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules,
1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Markenday Kumar
Upadhayay urf Bullet Baba was directed to submit his representation in writing with explaining the
reasons for not lodging the account and to lodge account of election expenses within 20 days from
the date of receipt of the notice;
AND WHEREAS, the said notice was received by him on 22nd July, 2021, at the address
given by Shri Markenday Kumar Upadhayay urf Bullet Baba, The acknowledgment receipt has
been submitted to the Commission by the District Election Officer, Siwan, vide its letter no. 165-
1/Nirvachan dated 08th December, 2022;
AND WHEREAS, the District Election Officer, Siwan, in his Supplementary Report, vide
its letter No. 165-1/Nirvachan dated 08th December, 2022 has reported that Shri Markenday
Kumar Upadhayay urf Bullet Baba, has neither submitted any representation nor any statement of
account of election expenses till date. Further, after receipt of the due notice of the Election
Commission of India, he has furnished neither any reason nor explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Shri Markenday Kumar Upadhayay
urf Bullet Baba, has failed to lodge the account of election expenses and has no good reason or
justification for the failure,
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 provides
that:-
“If the Election Commission is satisfied that a person-
i. has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
ii. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare
him to be disqualified and any such person shall be disqualified for a period of three
years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People
Act, 1951, the Election Commission of India hereby declares Shri Markenday Kumar Upadhayay
urf Bullet Baba, resident of Village+Post- Bhansakhaal, Thana- Ziradei, Jila- Siwan, a
contesting candidate from 106-Ziradei Assembly Constituency in General Election to the
Legislative Assembly of Bihar, 2020 to be disqualified for being chosen as and for being a member
of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State
or Union Territory for a period of three years from the date of this order.
