No-76/BR-LA/2020/39/CEMS-III--WHEREAS, the General Election to the Legislative
Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press
Note No. ECI/PN/64/2020, dated 25 September, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951,
every contesting candidate at an election has to, within 30 days from the date of election
of the returned candidate, lodge a true copy of the account of his election expenses with
the District Election Officer;
AND, WHEREAS, the result of the said election along with 39-Phoolparas Assembly
Constituency was declared by the concerned Returning Officer on 10th November, 2020.
Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;
AND WHEREAS, As per the report dated 18th December, 2020, vide letter no. 63
submitted by the District Election Officer, Madhubani, Bihar and forwarded by the Joint
Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-39)
Phoolparas/7789, dated 23rd December, 2020, Shri Sanjay Kumar Singh urf Sahil Kumar
Singh, a contesting candidate from 39-Phoolparas Assembly Constituency of Bihar, has
failed to lodge account of his election expenses, in the manner, as required under law;
AND WHEREAS, on the basis of the reports of the District Election Officer,
Madhubani, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice la-
76@fcgkj@foŒlŒ@2020@39@lh-bZ-,e-,l-&III, dated 25th June, 2021 was issued under sub rule (5) of
Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to
Shri Sanjay Kumar Singh urf Sahil Kumar Singh, for not lodging the account of Election
Expenses;
AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules,
1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Sanjay
Kumar Singh urf Sahil Kumar Singh was directed to submit his representation in writing
with explaining the reasons for not lodging the account and to lodge account of election
expenses within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by his brother Shri Vindeswar Singh
on 28th September, 2021, at the address given by Shri Sanjay Kumar Singh urf Sahil Kumar
Singh, The acknowledgment receipt has been submitted to the Commission by the District
Election Officer, Madhubani, vide its letter no. 931/Nirvachan dated 08th November, 2021;
AND WHEREAS, the District Election Officer, Madhubani, in his Supplementary
Report, vide its letter No. 1706/Nirvachan dated 23th December, 2022 has reported that
Shri Sanjay Kumar Singh urf Sahil Kumar Singh, has neither submitted any representation
nor any statement of account of election expenses till date. Further, after receipt of the
due notice of the Election Commission of India, he has furnished neither any reason nor
explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Shri Sanjay Kumar Singh urf Sahil
Kumar Singh, has failed to lodge the account of election expenses and has no good reason
or justification for the failure,
AND WHEREAS, Section 10A of the Representation of the People Act, 1951
provides that:-

“If the Election Commission is satisfied that a person-
i. has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
ii. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare
him to be disqualified and any such person shall be disqualified for a period of three
years from the date of the order”;
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People
Act, 1951, the Election Commission of India hereby declares Shri Sanjay Kumar Singh urf
Sahil Kumar Singh, resident of Village- Sikariya, Ward No.-1, Post- Ramchandra, P.S.-
Madhepur, Dist.- Madhubani, a contesting candidate from 39-Phoolparas Assembly
Constituency in General Election to the Legislative Assembly of Bihar 2020, to be
disqualified for being chosen as and for being a member of either House of the Parliament
or the Legislative Assembly or the Legislative Council of a State or Union Territory for a
period of three years from the date of this order.
