The 17^th March, 2023

No.-08/niyam sanshodhan-07-01/2021-209(8)/Ra.--In exercise of the powers

conferred under section 189 of The Bihar Tenancy Act, 1885, the State Government

hereby makes the following rules to amend The Bihar Tenancy Rules, 1885 (as amended

from time to time).-

1. Short title, extent and commencement.-(1) This rule may be called the "Bihar

Tenancy (Amendment) Rules, 2023."

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force from the date of publication in the Official Gazette.

2. Substitution of Rule-23(2)(i) of the Bihar Tenancy Rules, 1885.-Rule-

23(2)(i) of the said Rule shall be substituted by the following:-

"Any raiyat having interest on the land may file a petition for the measurement

of his raiyati land in the prescribed form-36 (as amended) before the Circle

Officer of the area through offline or online medium. It shall be mandatory to

attach a copy of the evidence related to the right on the land by the raiyat along

with the application form for the measurement. The prescribed measurement

fee is required to be deposited in the Anchal Nazarat through offline or online

method by the interested raiyat along with the application form for

measurement of private raiyati land under the procedure mentioned above.

Provided that the measurement of any Khesra (Plot) allotted to landless

families/persons of eligible category will be done free of cost. After

verification of the application received for the measurement of land, the Circle

Officer, after being satisfied, will pass an order on record to the Amin for the

measurement of the requested land. Intimation of the date fixed for the

measurement of land will be given to the applicant or the interested landholder

through electronic method as well as by traditional method. In case the

measurement is not possible due to any unavoidable reason on the fixed date,

the applicant or the interested landholder will be informed about the next date

fixed for measurement by electronic method as well as by traditional method.

After depositing the measurement fee, the Circle Officer will ensure the

measurement report be uploaded online in case of online application and

providing offline in case of offline application, within a maximum of 30

working days.

In such cases, where the application for immediate measurement is received,

the Circle Officer will ensure that the land is measured within a maximum of

10 (ten) working days.

3. Addition of new sub-rule (2)(i)(a) after rule of 23(2)(i) of Bihar Tenancy

Rules, 1885.-The following new sub-rule 23(2)(i)(a) shall be added after rule 23(2)(i) of

The Bihar Tenancy Rule.-

23(2)(i)(a) For the measurement of raiyati land located in Municipal

Corporation, Municipal Council and Nagar Panchayat area, per Khesra `1000/- and

maximum `4000/- (If the number of plots is four or exceeding four) measurement fee is

fixed, which will be deposited offline or online by the applicant.

In rural areas, per khesra `500/- and maximum `2000/- (If the number of

plots is four or exceeding four) measurement fee is fixed, which will be deposited offline

or online by the applicant.
