Amendments made in “The Bar Council of Bihar Election Rules, 1968” adopted

vide Resolution No. 51/2023/2.4.2023 of General Body of Bihar State Bar Council

and approved vide Resolution No. 43/2023 dated 15^th and 16^th April, 2023 by the

General Council of Bar Council of India.

Definitions:

Interpretation Added.

(b1) Assistant Returning Officer(s): The Bar Council, in consultation with the Bar

Council of India may appoint one or more assistant Returning Officer(s) to assist, add and

advise the Returning Officer. However, the number of Assistant Returning Officer(s) shall

not exceed five at any time.

(b2) Assistant Observer(s): The Bar Council, in consultation with the Bar Council

of India may appoint one or more Assistant Observer(s) to add, advise or assist the

Observer. However, the number of Assistant Observer(s) shall not exceed five at any time.

The Returning Officer may authorise any of the Assistant Returning Officer to

function as Returning Officer for any specific period for the reasons assigned by him.

In absence of the Returning Officer, the senior most Assistant ReturningOfficer shall

perform the functions of Returning Officer.

Following be added in Sub-Clause-(s) of Clause-3 after the words “hold the

election.”

(s) Returning Officer: The Bar Council, in consultation with the Bar Council of

India, shall appoint either a former Judge of Patna High Court or a designated Senior

Advocate as the Returning Officer to conduct the elections.

However, for the purpose of filling up of the casual vacancies in the State Bar

Council, the Secretary shall be the Returning Officer.

(n1) Observer: The Bar Council, in consultation with the Bar Council of India, shall

appoint a former Judge of the High Court as Observer for the elections, who shall be

empowered to supervise the entire election process. However, the decisions/

orders/directions of Returning Officer or the Observer may be Challenged before Central

Election Tribunal and the decision of the Tribunal shall be final in matter relating to

election.

(e1) Central Election Tribunal/Committee: The Central Election Tribunal/

Committee of Bar Council of India shall have the same meaning and functions as prescribed

under the Rules and Resolutions of Bar Council of India. All the disputes relating to election

shall be decided by the Central Election Tribunal/Committee of Bar Council of India.

Replaced Sub-Clause-(j) of Clause-3

(j) Electoral Roll: Electoral Roll means and includes the Roll containing the names

of Advocates prepared in accordance with the Rules and Resolutions of Bar Council of India

as amended from time to time. An Advocate who has not cleared the dues of Welfare Fund

under Rule-40 of Bar Council of India Rules before the specified date, shall not be a voter in

the Elections of State Bar Council.

Rule-10: Doubt as to validity of proposals be replaced with the following:-

10. Doubt as to validity of proposals: On the date fixed for the scrutiny of

nomination under Rule 7 above, the Returning Officer shall examine the nomination and on

an objection by a candidate or on his own motion after such summary enquiry, if any, as he

may deem necessary reject the nomination on the following grounds:

(a) That the nomination paper did not comply with the requirements of either these

Rules or any Rules/Resolutions of Bar Council of India prescribing ineligibility or

disqualification of a candidate to contest or to be a member of Bar Council.

(b) That the signature of the candidate or the proposer or seconder on the

nomination paper is not genuine.

The candidate and/or their agent shall be entitled to be present at the time of

scrutiny and to make submission.

No Nomination Paper shall be rejected except for defect of substantial nature and

the Returning Officer may allow any defect to be rectified subject to the ineligibility of

candidate to contest or to be a member according to any Rule or Resolution of Bar Council

of India.

Rule-15: Form of Voting Paper be replaced with the following: -

Rule-15: Form of Voting Paper:- The Voting Paper shall contain the names of all

the candidates, the address of the candidate and the date of his enrolment as Advocate as in

the roll shall be given against the name of each candidate. An asterisk mark shall be put

against the name of candidate who on the relevant date have been on the State Roll for at

least 10 years for the purposes of proviso to Section-3(2)(b) of the Act. The Voting Paper

shall also bear on it the facsimile of the Returning Officers/Assistant Returning Officer’s

signature. It shall state the total number of the candidate to be elected. The Voting Paper

shall, as nearly as possible, be in the Form ‘C.

Rule-39(a) shall be amended as follows:-

Rule-39 Arrangement of valid voting papers in parcels: (a) On the day fixed for

counting, the Returning Officer/Assistant Returning Officers shall open all the ballot

boxes/packets containing ballots and mix all the voting, papers before the counting of

voting papers.

Rest of the provisions of Section-39 will remain the same.

Repeal of Rule-49

The Rule-49 shall be repealed. All the procedures relating to disputes relating to

election shall be decided by the Central Election Tribunal/Committee constituted by the

Bar Council of India as per the regulations prescribed in this regard.

The Bihar State Bar council shall follow the Rules of Bar Council of India (F.

No.BCI:D:3582 of 2020 dated 30.12.2020) and the resolution dated 01.02.2020 of Bar

Council of India relating to weeding out the fake persons and non- practitioners.

Though as per said resolution, there shall be no election unless the process of

verification of certificates of all the Advocates are complete as per the verification Rules of

2015 of Bar Council of India. However, with the permission and approval of Bar Council of

India, the Bar Council can hold the elections of its Members on the basis of

application/verification forms received from the Advocates, if the process of verification is

not likely to be completed within the tenure of the elected members of Bar Council. In that

case, the verification of the remaining certificates will be undertaken after the publication

of result and constitution of new Bar Council. However, without the completion of

verification of certificates, normally the election shall not be held. Any relaxation of these

Rules, can be made only with the permission and approval of the Bar Council of India.

है। िजला पदाͬधकारȣ, भोजपुर }kjk Įी ͧमĮ के è पç टȣकरण को è वीकार योÊ य ĤǓतवेǑदत नहȣं ͩकया गया है ।
