THE FIRST STATUTES OF THE BIHAR UNIVERSITY OF HEALTH SCIENCES

(Vide Section 28 of the Act)

CHAPTER- I

No.-1/Vividh-46/2019(Shadow File)-709(1)/Health—In exercise of powers conferred by

sub section (1) of section 29 of the Bihar University of Health sciences Act, 2021, (Bihar Act

19 of 2021) the Government of Bihar, hereby frames the First Statutes for The Bihar

University of Health Sciences as follows:-

1. Short title, extent and commencement:—

(1)

The Statutes may be called as the First Statutes of Bihar University of Health

Sciences.

(2)

It shall extend to whole of the State of Bihar.

(3)

It shall come into force on such date as the Government may, by notification

in the official gazette, specify.

2. Definitions:-

(1) In the First Statutes, unless the context otherwise requires-

(i)

‘Academic Council' means the Academic Council of the University;

(ii)

'Affiliated Institution' means an institution affiliated by the

University

(iii)

‘Academic Staff’ means such categories of staff as are designated

by the Statutes to be the academic staff of the University;

(iv)

'Affiliation' means affiliation granted by the University in

accordance with the Statutes and Regulations made for the

purpose;

(v)

‘Chancellor' means the Chancellor of the University;

(vi)

‘Chief Minister’ means the Chief Minister of the State of Bihar;

(vii)

‘Colleges’ means a colleges teaching courses leading to a Bachelor

or Higher degree in Modern System of Medicine, AYUSH systems

of Medicine, Nursing Education, Pharmacy Education, Dental

Education, Education on Laboratory Technology, Physiotherapy &

Occupational Therapy, Speech Therapy and Education on other

Paramedical Courses and inter disciplinary areas such as Health

Economics, Health administration etc., include an institution

maintained or controlled by the University (established by State) or

maintained by the State Government;

(viii)

'Courses’ means courses leading to a Bachelor or Higher degree in

relevant streams of Health Sciences and such other courses as

notified by the Government in future;

(ix)

‘Court' means the Court of the University;

(x)

‘Dental Council of India' (DCI) means Dental Council constituted

under section- 3 of the Dentists Act – 1948 (Act 16 of 1948) and its

amendment Act 1993;

(xi)

‘Employee’ means any person appointed by the University,

Colleges or Institution as the case may be;

(xii)

‘Executive Council’ means the Executive Council of the University;

(xiii)

‘Finance committee’ means the finance committee of the

University;

(xiv)

‘Government' means the Government of Bihar;

(xv)

'Health Sciences' means the Modern system of Medicine, Nursing

Education, Pharmacy Education, Dental Education, Laboratory

Technology, Physiotherapy and Occupational therapy, Speech

therapy and Education on other paramedical courses in all their

branches

concerning

preventive,

promotive,

curative

and

rehabilitative services;

(xvi)

‘Institution’ means an academic institution or a colleges admitted

to the privileges of the University;

(xvii)

‘Medical Council of India' (MCI) means Medical Council of India

constituted by Indian Medical council Act-1956 (Act 102 of 1956)

and its amendment Act 1993;

(xviii)

'Misconduct' means a misconduct prescribed by the Statutes;

(xix)

'Modern System of Medicine' means all branches of modern

medicine dealing with pre-clinical, clinical, para-medical and para-

dental disciplines at diploma and degree level or above and such

other disciplines as may be prescribed;

(xx)

'National Medical Commission' (NMC) means National Medical

Commission constituted by National Medical Commission Act-

2019 (Act 30 of 2019);

(xxi)

'Notification' means a notification published in the official Gazette;

(xxii)

‘Pharmacy Council of India’ (PCI) means the Central Council

constituted under Section-3 of the Pharmacy Act-1948;

(xxiii)

‘Indian Nursing Council’ (INC) means Nursing Council established

under the Indian Nursing Council Act-1947 (Act No. 48 of 1947)

(xxiv)

‘National Commission for Indian System of Medicine’ (NCISM)

means commission established under the National Commission for

Indian System of Medicine Act 2020 (Act No.14 of 2020)

(xxv)

‘National Commission for Homeopathy’ (NCH) means commission

established under the National Commission for Homeopathy Act

2020 (Act No.15 of 2020)

(xxvi)

‘Rehabilitation Council of India’ (RCI) means Rehabilitation

Council established under the Indian Rehabilitation Council of India

Act 1992 (Act No.34 of 1992)

(xxvii)

‘All India Council for Technical Education’ (AICTE) means

Council constituted under All India Council for Technical

Education Act 1987 (Central Act No.52 of 1987)

(xxviii) "Planning Board" means the “Planning Board” of the University;

(xxix)

‘Principal’ means the head of a colleges and includes, where

there is no principal, the person who is for the time being duly

appointed to act as the Principal, and, in the absence of the

Principal or the acting Principal, as the case may be, a Vice-

Principal duly appointed as such;

(xxx)

‘Professional Education’ means education connected with a job

that needs special training or skill, and includes Medical, Dental,

Pharmacy, Physiotherapy, Occupational Therapy, Medical Law

Teaching etc.;

(xxxi)

‘Recognized Teachers’ means such persons as are approved by the

University for the purpose of imparting instruction in a college or an

institution admitted to the privileges of the University;

(xxxii)

‘School’ means a school of studies of the University;

(xxxiii) ‘School of Studies’ means the School of Studies of the University;

(xxxiv) “Screening committee” means the committee as constituted under

section 11(3) of this act ;

(xxxv)

‘Self-Financing Institution' means those institutions which are set-

up by a Trust or a Society or a Company and are Self Financing

imparting education in the field of different streams of Health

Sciences;

(xxxvi) ‘Senate’ means the Senate of the University ;

(xxxvii) ‘Statutes’ and 'Regulations' mean respectively the Statutes and

Regulations of the University for the time being in force.

(xxxviii) ‘Technical staff’ means employees working in the technical cadre

of the University;

(xxxix) ‘University’ means the Bihar University of Health Sciences as

incorporated under this Act;

(xl)

‘University

Grants

Commission'

means

the

Commission

established under Section- 4 of the University Grants Commission

Act, 1956 (Central Act 3 of 1956) ;

(xli)

‘University teachers' means Professors, Readers/ Associate

Professors, Lecturers/Assistant Professors and such other persons

as may be appointed for imparting instruction or conducting

research in the University, or in any colleges or institution

maintained by the University and are designated as teachers by the

Statutes.

(xlii)

‘University Review Commission’ means the commission defined

under section- 36 of this act;

(xliii)

'Vice-Chancellor' means, Vice- Chancellor of the University;

(xliv)

The words and expressions used herein and not defined in the Act

shall have the same meaning respectively assigned to them in the

Act.

3. Authorities:—

The following shall be the authorities of the University namely:-

(i)

The Senate as constituted under section 20 of the Act;

(ii)

The Executive Council as constituted under section 22 of the Act;

(iii)

The Academic Council as constituted under section 23 of the Act;

(iv)

The Board of Planning as constituted under section 24 of the Act;

(v)

The Board of Studies as constituted under section 19 (viii) and section 27

of the Act;

(vi)

The Board of Affiliation as constituted under section 25 of the Act;

(vii)

The Finance Committee as constituted under section 26 of the Act;

(viii) The Examination Board as constituted under section 19(viii) and section

27 of the Act

4. Senate.—In addition to the constitution, power, functions and meetings of the

Senate mentioned under section 20 of the Act, the Registrar of the University shall act as ex-

officio Member-Secretary to the Senate.

5. Executive Council.—The Executive Council shall have all powers necessary to

administer the University, subject to the provisions under Section 22 of the Act.

6. The Academic Council.—The Academic Council shall be the principal academic

body of the University and shall subject to the provisions under Section 23 of the Act.,

Co-ordinate and exercise general supervision over the academic policies of the University.

7. The Board of Planning.—The Board of Planning shall be the Principal Body for

preparing plans for the growth and development of the University to achieve its objective as

per provisions under Section 24 of the Act.

8. The Board of Studies:-

(a)

Each Department shall have a Board of Studies.

(b)

The constitution of the Board of Studies and the term of office of its

members shall be as follows:

(i)

Dean (Academic): Chairman

(ii)

Two HODs of the respective branch to be nominated by Vice-

Chancellor;

(iii)

Two experts of the respective field to be nominated by the

Academic Council;

(iv)

One expert from Health Education to be nominated by the

Executive Council;

(v)

Controller of Examinations:- Member Secretary

The term of office of the nominated members of the Board of

Studies, other than ex-officio members, shall be of two years.

(c)

Subject to the overall control and supervision of the Academic Council, the

functions of Board of Studies shall be to propose course structure and to

approve subject for research for various degrees and other requirements of

research degrees. To appoint examiners for courses excluding Research

Degrees.

(d)

To propose measures for the improvement of the standard of teaching and

research.

(e)

Four members of the Board of Studies shall form quorum for meeting of the

Board of Studies.

9. Board of Affiliation.—The Board of Affiliation shall be responsible for admitting/

affiliating/colleges and institutions to the privileges of the University.

(a)

The Board of Affiliation shall consist of the following members namely:-

(i)

The Vice-Chancellor - Chairman

(ii)

One Representative of the Department of Health, Govt. of Bihar;

(iii)

The Director-in-Chief (Administration), Health Services, Bihar

(iv)

Two Principals/Professors/Associate Professors to be nominated

by the Department of Health Govt. of Bihar;

(v)

One Person with Academic background in Health Sciences to be

nominated by the Executive Council;

(vi)

One Person with Academic background in Health Sciences to be

nominated by the Academic Council;

(vii)

Registrar.

(b)

All members of the Board of Affiliation, other than ex-officio members,

shall hold office for the term of three years.

(c)

Four members of the Board of Affiliation shall form quorum for meeting

of the Board of Affiliation.

(d)

The Board of Affiliation shall meet at regular interval and at least once in

a year depending upon number of cases to examine and scrutinize

proposals for admitting colleges and institutions to the privileges of the

university.

(e)

All the Colleges and institutions covered by the Act shall be required to

seek affiliation from the Bihar University of Health Sciences.

(f)

The Board shall examine the reports of inspection team constituted by

“New Teaching Programme Committee” for grant of Autonomy/

Affiliation in the light of the criteria laid down by the concerned Apex

Body/University/Council.

(g)

The board shall scrutinize the applications received for grant of fresh

affiliation or extension of affiliation to colleges and to make its

recommendations.

(h)

Fee for affiliation of Colleges/Institutions shall be decided by the

Executive Council on the recommendation of the Finance Committee.

10. Finance Committee:—

(a)

The Finance Committee shall consist of the following members namely:-

(i)

The Vice-Chancellor as the Chairman

(ii)

Three persons to be nominated by the Executive council, out of

whom at least one shall be a member of the Executive council;

(iii)

The Registrar

(iv)

The Finance Officer- Member Secretary.

(b)

Five members of the Finance Committee shall form quorum for meeting

of the Finance Committee.

(c)

All the members of the Finance Committee other than Ex-officio

members, shall hold office for a term of three years.

(d)

The Finance Committee shall advise the university on any question

affecting its finance.

(e)

The Finance Committee shall prepare the annual estimate of income and

expenditure of the university.

(f)

The Finance Committee shall be responsible for maintenance of

Accounts of income and expenditure of the university.

(g)

The Finance Committee shall meet at least twice every year to examine

the accounts and to scrutinize proposals of expenditure.

(h)

All proposals relating to creation of Posts, and those items which have

not been included in the Budget, shall be examined by the Finance

Committee before they are considered by the Executive Council.

(i)

The Finance Committee shall recommend limits for the total recurring

expenditure and the total non-recurring expenditure for the year, based on

the income and resources of the university.

(j)

The Finance Committee shall discharge such other functions of financial

nature as may from time to time be entrusted to it by the Executive

Council.

11. Examination Board.—The Examination Board shall consist of following

members:-

(a)

The Examination Board shall give advice in respect of conduct of

Examinations, appointment of Examiners, setting of question papers,

preparation and publication of examination results, submission of

such examination results to the Academic Council and generally

regulating the methods of improvement in the procedure of correct

evaluation of achievements of Students. The board shall also advice

to cancel the examination due to unfair-means/irregularities reported,

if any. The final decision, however shall be of the Vice-Chancellor in

the above matter.

(b)

The Examination Board shall submit the proposal for fixing the fees,

emoluments, travelling and other allowances for the examiners and

question paper setters to the Academic Council;

(c)

The Examination Board shall be competent to order for re-evaluation

of the answer books if it is satisfied that the evaluation of the answer

book has not been fairly done or evaluation has been done in

violation of the provisions of the Statutes and Regulations. However,

the decision of the Vice-Chancellor shall be final in the matter.

(d)

Three members of the Examination Board shall form quorum for

meeting of the Examination Board.

12. Such other Authorities Created by the Vice-Chancellor after approval of the

Chancellor of the University.

The Vice-Chancellor, after approval of the Chancellor of the University, may constitute

such other authorities of the University, otherwise not mentioned in the Statute, in the interest

of the University.

13. Travelling Allowance of the Members of the Authorities of University:—

Members of the Executive Council and other authorities of the

University and members of the Committee constituted under the Act or the

Statutes or appointed by the Executive Council and other authorities shall be

entitled to travelling allowance and daily allowances as per rules and regulations of

the State Government. However, sitting fee for attending the meetings of the

authorities and their Committees will be decided by the Finance Committee and

approved by the Executive Council from time to time.

14. Classification of Members of the Officer / Staff: -

The members of the Officer/staff of the University shall be classified as under:

Controller, Section Officer, Store Keeper, Assistants, Upper Division

Clerk, Lower Division Clerk, Personal Assistant to VC and such other

Administrative and other Staff as may be decided by the Executive

Council from time to time.

(ii) Technical Staff:-Web Developer, System Analyst, Programmer and such

other technical posts as may be decided by the Executive Council from

time to time.

15. Selection Committee.—There shall be a Selection Committee for making

recommendations to the Chancellor for appointment to the posts of the officer of the University

(Finance Officer, Examination Controller, Librarian and such other post as may be declared by

the Statute) shall be as follows:-

(c) Where a post is to be filled on contract basis or by invitation, the Executive

Council may, constitute such Adhoc Selection Committee, as circumstances of

each case may require.

(d) If the post is to be filled by advertisement, the Registrar shall advertise the terms

and conditions of the post and the screening Committee for the purpose of short

listing the eligible and most desirable candidates shall screen all applications

received within the date specified in the advertisement.

(e) At the time of Interview, the Selection Committee shall examine credentials (i.e.

weightage of all examinations passed, experience, paper publications, patent,

written test, interview etc. decided by recruitment rules) of all candidates who

have been called for the interview, interview the eligible candidates and

recommend the appointment of the most suitable candidate to the competent

authority for approval.

(f) The recommendations of the Selection Committee shall remain valid for a

period of one year from the date of approval of the competent authority and if

for any reason the recommendations are not approved by the competent

authority or appointment orders not issued after the approval of

recommendations within the said period of one year, the recommendations shall

lapse and fresh advertisement shall be issued.

(g) The minimum quorum of the selection committees shall be of four (04)

members. However, SC/ST and women representative nominated by the

Department of Health, Govt. of Bihar shall be mandatory.

(h) Unless otherwise provided for under the Statutes, the Selection Committee

constituted for the purpose of making recommendation for appointment to a

post shall continue to exercise its functions in relation to that post till the

appointment is made against that post.

(i) All appointments made at the University shall be reported to the Executive

Council at its next meeting.

(j) The appointment of officers other than officers mentioned under Section 10 of

the Act shall be made on the recommendation of the Selection Committee

constituted for the purpose and the officers shall be a whole-time salaried

officer of the university or these officers may be Deputed to the University.

(k) If the Executive council is unable to accept the recommendations made by the

Selection Committee, It shall record its reasons and submit the case to the

Chancellor for final orders.

(l) If the Vice-Chancellor is satisfied that in the interests of work it is necessary to

fill any vacancy forthwith, the appointment may be made on a purely temporary

basis subject to maximum period of six months.

(m) No teacher or officer appointed against temporary vacancy by the Vice-

Chancellor shall continue beyond six months unless his appointment is

approved by the Executive Committee.

16. Vice-Chancellor:—

(1)

The emoluments and other conditions of service of the Vice-Chancellor

shall be as follows: -

(i)

The Vice-Chancellor shall be a whole-time officer and shall be paid

pay and allowances other than house rent allowance, at the rates

fixed by the state government from time to time and he shall be

entitled to rent free, furnished residence during his term of office and

no charge shall fall on the Vice-Chancellor in respect of the

maintenance and security of such residence. Where the person

appointed as Vice-Chancellor gets pension from the Central or the

State government or any University or from any other source, the

amount of pension due to him from such source shall be deemed to

be the part of his salary as Vice-Chancellor. His/her salary will be

determined by deducting the amount of pension and dearness relief

on it from his last salary with all allowances. The rate of dearness

allowances and dearness relief will be revised as per the revision in

his/her last organization from time to time for such calculation.

(ii) The Vice-Chancellor and his/her spouse and dependent sons and

daughters shall be entitled to free medical treatment and the

University shall reimburse their medical bills.

(iii) The Vice-Chancellor shall also be entitled to other benefits and

allowances such as free fuel staff car, telephone (Landline), Mobile

Phone, electricity, newspapers and magazine, etc. as may be fixed by

the Executive Council.

Provided that where an employee of the University, or a colleges

or an Institution maintained by the university, or of any other

university, or any colleges or institution maintained by or admitted to

the Privileges of such other University, is appointed as the Vice-

Chancellor he may be allowed to contribute to provident fund of

which he is a member and the previous employer shall transfer the

balance standing to the credit of the employee in his Provident Fund

Account to his present employer/university and the Vice-Chancellor

shall continue in the same scheme in which he was member in the

former organization.

(2)

The Vice–Chancellor shall be entitled to various kinds of Leave e.g.-Casual

Leave, Medical Leave, Earned Leave, Special Leave and other Leaves as

per Bihar Service Code.

(3)

The Vice-Chancellor shall be entitled to Travelling allowance and Daily

allowance at the rate prescribed by the State Government for Secretary

Rank officer.

17. Powers, duties and functions of the Vice-Chancellor:—

Powers, duties and functions of the Vice-Chancellor will be as per Section 12 of

the Act.

However,

The Vice-Chancellor, with the approval of the Executive Council may

retain the services of a legal practitioner as “Legal Consultant” on fixed

monthly professional fee or otherwise from time to time consultation on

legal issues as also for defending cases in court.

ii.

The Vice-Chancellor with the approval of the Executive Council may retain

the services of a person, who is proficient in Examination Related work, as

per need on fixed monthly honorarium.

iii.

The Vice-Chancellor, with the approval of the Executive Council may

retain the services of a person as ‘Liaison Officer’, till the permanent

appointment is made, on terms and condition fixed by the Executive

Council.

iv.

The Vice-Chancellor with the approval of the Executive Council may retain

the services of Computer Professionals as per need on fixed monthly

honorarium.

18. Removal of the Vice-Chancellor.—The Vice-Chancellor will be removed as per

Section 13 of the Act.

19. The Deans.—The appointment of Deans shall be made by the Vice-Chancellor for

a period of two years on the basis of additional charge of existing duties amongst the Principal/

Professor /Associate Professor of the Medical/Dental/Pharmacy/Nursing/ Ayush Colleges

under the University.

Provided that if the Vice-Chancellor for administrative reasons or thinks it

necessary otherwise he may revert the Deans to their original posts and appoint another

person on the post for the unexpired period.

There shall be following Deans:-

(iii) Dean (Student’s Welfare)

(iv) Dean (Faculties)

(i)

The Dean - Academic

Duties and Responsibilities

(a)

He/she shall coordinate the development and implementation of the

academic vision and goal of the University.

(b)

He/she shall lead and coordinate the academic planning and curriculum

development and research strategy.

(c)

He/She shall attend the meetings and establish the necessary

coordination amongst the Boards of Studies, Examination Committee

and other related bodies

(d)

He/She shall be the overall coordinator for under graduate studies, Post

Graduate studies, academic research and promotion of entrepreneurship

activities at the University and shall perform all such duties as may be

assigned by the Vice-Chancellor of the University in this regard to make

the Under Graduate programme and Post Graduate Programme at the

University and Colleges a vibrant and reputed one;

(e)

He/She shall monitor the existing programmes and prepare the proposals

for new Under Graduate, Post Graduate and other such academic

programmes of the University and will carry out overall coordination to

see that the decisions are implemented.;

(f)

He/She shall prepare the schemes for admission procedures for different

under graduate programmes, post graduate programmes and Doctoral

programmes keeping in view the trends at the national and international

levels.

(g)

He/She shall propose from time to time the necessary reforms for theory

and practical examination at the under graduate level, post graduate level

courses for the consideration of appropriate authorities of the University.

(h)

He/She shall be responsible to prepare a repository of the various

academic and co-curricular achievements of the undergraduate students,

post graduate and Doctoral Students of the University both at national

and international levels.

(i)

He/She shall liaison with the national level sponsoring agencies,

governmental as well as non-governmental, other educational

institutions and research organizations, to seek the opportunity of

sponsored or collaborative research and will prepare the necessary

proposals and will carry out the required follow ups.

(j)

He/She shall seek the international collaborations for research and will

obtain the government approval wherever necessary.

(k)

He/She shall be the nodal coordinator at the University level for all the

sponsored research at various colleges and shall provide the necessary

assistance and guidance to the colleges to encourage and promote such

activities.

(l)

He/She shall monitor the memoranda of understanding signed in this

regard and will monitor their progress and report to appropriate bodies

of the University.

(m)

He/She shall also be responsible for the intellectual property rights

related to overall research and technology transfer at the University.

(n)

He/She shall perform all such other duties as may be assigned by the

Vice-Chancellor in this regard.

(ii)

The Dean (Examination) :- .

Duties and Responsibilities

(a)

He/She shall ensure timely conduction of examinations in the University

and matters relating thereto.

(b)

Responsible for the due custody of the records pertaining to his work as

Dean (Examination)

(c)

Developing and implementing assessment system of the University

(d)

He/She shall be assisted by Examination Controller, Deputy Registrar

(Examination) and Assistnat Registrar (Examination)

(e)

He/She shall perform such other duties as may be specified in the

Statutes, the Ordinances or the Regulations or as may be required from

time to time by the Vice-Chancellor or the Executive Council.

(iii)

The Dean (Student’s Welfare):

Duties and Responsibilities

(a)

The Dean of Students welfare shall be responsible for all the aspects of

welfare of students as may be assigned by the Chancellor, Vice-

Chancellor, the Executive Council, and any other appropriate authority

of the University or the State or National bodies in this regard.

(b)

He/She shall coordinate various extra and co-curricular events and

activities aimed at overall development of the students.

(c)

He/She shall propose to help financially the needy students after due

consideration from the funds provided for the students’ welfare and

activities by the Governments, students, alumni and other donors as

accepted by the Executive Council.

(d)

He/She shall preside over or attend all such meetings that are related

with the students’ welfare and activities and will see that all the

decisions are effectively implemented.

(e)

He/She shall take necessary measures for the functioning of libraries,

remedial courses etc. aimed at helping the students admitted under

reserved categories.

(f)

He/She shall continuously prepare and upgrade the plans of students’

welfare.

(g)

He/She shall be the main coordination officer related to anti-ragging and

anti-women harassment schemes and efforts of the University and

colleges.

(h)

He/She shall exercise general control over the superintendence of

physical education, NCC, NSS, or any other facilities/activities related

with students.

(i)

He/She shall prepare the budget requirements related to students’

welfare and other activities and provide the same to be included in the

annual budget of the University or Colleges.

(j)

He/She shall communicate with the parents/guardians of a students in

respect of any matter requiring his assistance, when necessary.

(k)

He/She shall preside over such committees special or standing related to

students discipline and shall advise the Vice-Chancellor in the matters

related to actions against a student on disciplinary grounds.

(l)

He/She shall perform all such other duties as may be assigned by the

Vice-Chancellor in this regard.

(iv)

The Dean (Faculties):

The University shall have the following Faculties: -

Faculty of Dental Sciences.

iii.

Faculty of Pharmaceutical and Paramedical Sciences (includes

Physiotherapy and Occupational Therapy and others)

Faculty of Nursing

Such other Faculties as may be declared by the Regulation to be Faculty

of the University from time to time.

Duties and Responsibilities

To constitute the Board of the Courses of study of the Departments

allotted to it.

ii.

To exercise such powers as may be assigned to it by the Academic

Council from time to time.

20. The Registrar:—

(a) The Search-cum-Selection Committee for The Registrar of the University

will be as follows:-

(i)

Vice-Chancellor

- Chairman

(ii) One member from outside the University to be

nominated by the Hon’ble Chancellor

- Member

(iii) One member to be nominated by the

Executive Council

- Member

(iv) One member to be nominated by the

Department of Health, Govt. of Bihar

- Member

(b) The Search-cum-Selection Committee will invite the applications for the post

of Registrar and will conduct the interview of eligible candidates.

(c) A panel of three eligible candidates will be prepared by the Search-cum-

Selection Committee and will be forwarded to the Hon’ble Chancellor of the

University for the appointment of the Registrar.

(d) The Registrar shall be a whole time salaried officer of the university.

(e) The Registrar shall be appointed for a term of 3 years and shall be eligible for

re-appointment. The Registrar shall superannuate on attaining the age as

prescribed by the State Government.

(f) The Chancellor may require the Registrar to continue in the office for such

period which will not exceed the total period of one year and as may be

specified by the Chancellor after expiry of the term.

(g) The emoluments shall be such as approved by the State Government from

time to time and other terms and conditions of service of the Registrar shall

be such as may be prescribed by the Executive Council from time to time

Where the person appointed as Registrar gets pension from the Central or the

State government or any University or from any other source, the amount of

pension due to him from such source shall be deemed to be the part of his

salary as Registrar. His/her salary will be determined by deducting the

amount of pension and dearness relief on it from his last salary with all

allowances. The rate of dearness allowances and dearness. Relief will be

revised as per the revision in his/her last organization from time to time for

such calculation.

(h) The Registrar shall be entitled to have water, power, and rent free furnished

residential accommodation with such furniture, as may be approved by the

University. The premises of his/her lodging will be maintained by the

University. The Registrar shall also be entitled to other benefits and

allowances such as fuel free staff car, telephone (Landline), Mobile Phone,

newspapers etc. as may be fixed by the Executive Council.

(i) When the office of the Registrar is vacant or when the Registrar is by reason

of illness, absence or any other cause, unable to perform the duties of his/her

office the duties of the office shall be performed by such officer as the Vice-

Chancellor may appoint for the purpose.

(j) (i) The Registrar shall have power to take disciplinary action against such of

the employees, excluding teachers and officers, and to suspend the

employees and to initiate enquiry into the charges, and impose penalty

as provided in this Statute.

Provided that no such penalty shall be imposed unless the person

has been given a reasonable opportunity of showing cause against the

action proposed to be taken in this regard.

(ii) An appeal shall lie to the Vice-Chancellor against any order of the

Registrar imposing any of the penalties specified in the Statute.

(iii) In a case where the inquiry discloses that a punishment beyond the

power of the Registrar is called for, the Registrar shall upon the

conclusion of the inquiry as provided in the Regulation make a report to

the Vice-Chancellor along with his recommendations.

Provided that an appeal shall lie to the Chancellor against an

order of the Vice-Chancellor imposing any penalty within a period of

sixty days.

Duty of the Registrar:-

(i) To be the custodian of the records, the common seal and such other

property of the University as the Executive Council shall commit to his

charge;

(ii) Registrar shall act as Member Secretary of the Executive Council,

Academic Council, Board of Planning, Board of Affiliation and of any

Committee appointed by the Authorities.

(iii) To issue all notices convening the meeting of the Senate, the Executive

Council, the Academic Council and of any Committee appointed by

these Authorities;

(iv) To keep the minutes of all the meetings of the Senate, the Executive

Council, the Academic Council and of any Committee appointed by

these Authorities;

(v) To conduct the official correspondence of the Senate, the Executive

Council and the Academic Council and other Statutory committees;

(vi) To supply to the Chancellor, copies of the agenda of the meetings of the

Senate and Executive Council as soon as they are issued and minutes of

such meetings;

(vii) To represent the University in suits or proceedings by or against the

University, sign powers of attorney and verify pleadings or depute his

representative for the purpose; and

(viii) To perform such other duties as may be assigned by the Vice-

Chancellor.

21. The Finance Officer:—

(a)

The Finance Officer shall be appointed by the Chancellor on the

recommendation of the Selection Committee of the University. However,

services of member of Bihar Finance Service / Bihar Financial

Administrative Service may also be taken on deputation. University may

also engage retired officer from the office of Accountant General and Bihar

Finance Service / Bihar Financial Administrative Service on contract.

(b)

The Finance Officer shall be appointed for a term of 3 years and shall be

eligible for re-appointment, and shall retire at the age as prescribed by the

State Government. In case of retired employee, it shall be regulated as per

the provision of State Government.

(c)

The emoluments shall be such as approved by the State Government from

time to time & other terms and conditions of service of the Finance Officer

shall be such as may be prescribed by the Executive Council from time to

time.

(d)

When the office of the Finance Officer is vacant or when the Finance

Officer is by reason of illness, absence or any other cause, unable to

perform the duties of his/her office, the duties of the office shall be

performed by such person as the Vice-Chancellor may appoint for the

purpose.

(e)

The Finance Officer shall be Member Secretary of the Finance Committee.

(f)

In all proposals having financial implications the advice of the Finance

Officer shall be obtained.

(g)

The Finance Officer shall-

(i)

Exercise general supervision over the funds of the University and

shall advise as regards its financial policy; and

(ii)

Perform such other function as may be assigned by the Executive

Council or prescribed by the Statutes or Regulations.

(iii)

To perform such other duties as may be specified by the Vice-

Chancellor.

(h) Subject to the control of the Executive Council, the Finance Officer

shall-

(i)

Hold and manage the property and investments of the University

including trust and endowed property;

(ii)

Ensure that the limits fixed by the Executive Council for recurring

and non-recurring expenditure for a financial year are not exceeded

and that all moneys are expended on the purpose for which they are

granted or allotted;

(iii)

Be responsible for

(1) Preparation of annual Accounts and budget of the University,

(2) Maintenance of Accounts,

(3) Audit of Accounts from time to time,

(4) Compliance of Audit-objection,

(5) Timely receipt of grants from the State Government or the

UGC/NMC/DCI/NCISM/NCH/PCI/INC/RCI and submission

of Utilization certificates.

(iv)

Keep a constant watch on the State of the cash and bank balances

and on the State of investments;

(v)

Watch the progress of the collection of revenue and advise on the

methods of collection employed;

(vi)

Ensure that the registers of buildings, land, furniture and equipment

are maintained up to date and that stock checking of equipment and

other consumable materials in all Offices, Departments, Centres and

specialized laboratories is conducted.

(vii)

Bring to the notice of the Vice-Chancellor unauthorized expenditure

and other financial irregularities and suggest disciplinary action

against persons at fault; and

(viii)

Call for from any Office, Department, Centre, Laboratory, Colleges

or Institution maintained by the University any information or

returns that he may consider necessary for the performance of his

duties.

(i)

Any receipt given by the Finance officer or the Person or persons duly

authorized in this behalf by the Executive Council for any money payable

to the University shall be sufficient discharge for payment of such money.

22. The Examination Controller.—The Examination Controller shall be appointed by

the Chancellor on the recommendation of the Selection Committee of the University

(a)

Examination Controller shall be a whole – time salaried officer of the

University.

(b)

He shall be appointed for a term of 3 years and shall be eligible for re-

appointment.

(c)

The emoluments shall be such as approved by the State Government from

time to time and other terms and conditions of service of the Examination

Controller shall be such as may be prescribed by the Executive Council.

(d)

The Examination Controller shall be assisted by the Deputy and Assistant

Examination Controller in conducting examination of various courses.

Provided that the Examination Controller shall retire on attaining the age as

prescribed by the Government.

(e)

When the office of the Examination Controller is vacant or when the

Examination Controller is by reason of illness, absence or any other cause,

unable to perform the duties of his/her office, the duties of the office shall

be performed by such person as the Vice-Chancellor may appoint for the

purpose.

Duties:-

(a)

The Examination Controller shall arrange for and superintend the

Examinations conducted by the University and will be solely responsible

for conducting fair and transparent examinations.

(b)

He/She shall be wholly responsible for the work of high confidential nature

that may be under taken by his/her section.

(c)

He/She shall be responsible for preserving of the documents, deeds etc.

concerning his/her section.

(d)

The Examination Controller must personally look into the court cases

concerning his/her section and must take steps to deal with the legal

matters of his/her section adequately.

(e)

To perform such other duties as may be assigned by the Vice-Chancellor.

23. Other officers of the University:—

(a)

Subject to the provision of sub section (7) of section 10 of the Act, the

following shall also be the Officer of the University in addition to the

Officers mentioned at section 10 of the Act :-

NOTE: -

The qualification and experience for the above mentioned posts shall be

determined by the Executive Council of the University or as prescribed by

the State government time to time.

2. Above mentioned officers shall be appointed by the Executive Council on

the recommendation of the Selection Committee of the University.

However, they can be taken on deputation for a period of two years.

24. Other Committees:—

(A) An authority of the University may appoint as many standing committees as

it may deem fit, and may appoint to such committees persons who are not

members of such authority.

(B) A committee appointed under sub-section (a) above may deal with any

subject delegated to it, subject to subsequent confirmation by the authority

appointing it.

(C) The Term of membership of the committees other than ex-officio members

shall be two years from the date of their nomination.

(g) Purchase and Sales Committee:—

The committee shall consist of the following: -

The Committee shall be responsible for procurement of goods and

services. It shall consider annual requirements of University’s stores including

Examination stores, shall open and consider tenders and the samples and makes

its recommendations for purchases to be made from time to time.

The Committee shall conduct auction and make arrangement for the

sale of saleable articles or for settlement of land, orchard etc. of the University

Estate.

Anything not covered in the statute will be governed by the Bihar

Financial Rules as issued and amended from time to time.

(h) Discipline Committee for Teachers, Officers and other Staff of the

University:—

The Committee shall consist of the following:-

(i)

The Committee shall prepare University Academic Calendar each year

for the full duration of the course in respect of the students to be admitted in

following academic session. The academic calendar should contain the date of

starting the teaching, the courses to be covered in each area of each academic

year and the dates of University examinations.

(l) Cultural activities Committee:—

The Committee shall consist of the following:-

(i)

The committee shall look after all the works relating to cultural

activities of the University and colleges.

(m) Internal Complaint Committee:—

The Committee shall consist of the following:-

(i)

One Senior most teacher (Women) of

Colleges/Institutions to be nominated by the

Vice-Chancellor

Presiding Officer

(ii)

Three (at least one women from SC/ST and

one from EBC/BC ) teachers having

experience in social work to be nominated by

the Vice Chancellor

Member

(iii) One member amongst N.G.O. or associations

committed to the cause of women to be

nominated by the Vice-Chancellor

Member

(iv) Deputy Registrar

One half of the nominated member should be female. Presiding Officer

and every Member of the Internal Committee shall hold office for such period,

not exceeding three years, from the date of their nomination

The Committee shall follow the directions of the Supreme Court

enjoining all employees to develop and implement a policy against sexual

harassment at the workplaces. To evolve a mechanism for prevention and

redressal of gender-based discrimination, sexual harassment and other acts of

gender-based violence.

CHAPTER-II

AFFILIATION TO

THE BIHAR UNIVERSITY OF HEALTH SCIENCES

[Under Section 6(11) of BUHS (The Bihar University of Health Sciences) Act, 2021]

Objectives.—

The Statutes provide for:—

Grant of Extension of Affiliation/ new Affiliation to all existing

Professional Medical or other Colleges/Institutions imparting education in

Modern System of Medicine, Dental, Ayurveda, Homeopathy, Siddha,

Unani, Yoga, Naturopathy, Nursing, Pharmacy, Laboratory Technology,

Physiotherapy & occupational Therapy, Speech Therapy, Paramedical

Courses, health Economics, health administration and allied subjects, owned

by government or Government controlled Societies, Private aided and

private unaided self-Financing educational agencies ( except deemed

Universities) falling within the territorial jurisdiction of the university

within state of Bihar.

ii.

Addition of new program or increase in intake.

iii.

Withdrawal of affiliation or reduction in intake.

2. Applicability.— Subject to the provisions contained in the University Act the

Statutes shall be applicable to

Colleges and institutes established by the state government or constituent to

any existing university of the state or to be established in future imparting

professional education in Health Sciences.

Existing professional colleges and institutes of the state set up by a duly

registered trust or society as self-financed colleges/ institutes provided they

opt for affiliation to this university and get delinked from other university of

the state to which they were affiliated earlier.

2.1. Existing Government Colleges.—Government colleges of the state

imparting professional education in one or more streams shall become

affiliated to the university with effect from such date as the state

government may decide and publish it in the official gazette and there

after affiliation of such colleges and institutes with other university of

the state shall cease.

2.2. Existing self-financed colleges and institutes.— The existing colleges

and institutes set up by a duly registered society or trust on self-

financed basis and already affiliated to some other university of the

state may be affiliated to this university if such colleges or institutes

makes an application in the prescribed format for affiliation and fulfills

all the requirements contained in the Act, Statutes and Regulation.

Their affiliation from earlier university shall cease w.e.f. the date they

are affiliated to this university.

2.3. New professional colleges/ institutes.—All professional colleges and

institutes whenever established in future by the government or to be

established by the society/ trust on self-financed basis within the

territorial jurisdiction of the university shall be required to get affiliated

to this university after its becoming functional.

3. Eligibility criteria .—Colleges and institutes imparting professional education within

the territorial jurisdiction of the university may be admitted to the university as its affiliated

colleges/ institutes if they fulfill the undernoted requirements at the time of inspection of the

colleges/ institutes by the university.

The colleges or the institutes is having approval or is in the process of getting

approval from the concerned Central Council/ apex body.

No objection certificate (Essentiality Certificate) from the state government

wherever necessary.

Undisputed Ownership/Long-term lease (30 years or more) and possession of

at least so much of land as is required under the norms of the concerned

Central Council/ apex body.

Provided if the courses offered by the colleges/ institutes do not come

within the ambit of any of the concerned Central Council/ apex body but

possesses at least 5 acres of undisputed land for colleges building, hostel,

quarters, playground and etc. if situated in rural area or 2.5 acres in urban

area in not more than two blocks shall be also eligible. However, restriction

on area of land may be relaxed under special circumstances by the Senate of

the university which will be applicable only to the institutes under

consideration.

Infrastructure requirements in terms of built-up area for separate hostels for

boys & girls, lecture halls, seminar, tutorial, laboratory, library,

administrative block etc. are as per norms of the concerned Central Council/

apex body.

Adequate civic facilities for essentials such as electricity, ventilation,

separate toilets for boys and girls, etc. in conformity with National Building

Code.

All the buildings are easily accessible and friendly to physically challenged

persons.

A library for each course/discipline consistent with the proposed programme

including text, reference books and journals and a book bank facility for

students belonging to SC/ST/BC/EBC and other categories as may be

specified from time to time by their apex body.

A multipurpose complex having an auditorium, canteen, health centre, indoor

stadium, separate common room for boys and girls in accordance with norms

of the university/ concerned Central Council/ apex body.

Necessary furniture for lecture, theatre, seminar room, tutorial rooms,

laboratories, library, faculty rooms, administrative wing and auditorium of

the multipurpose complex as specified by concerned Central Council/ apex

body/University.

A duly constituted governing body having members and office bearers as per

provisions in the statute made for the purpose in case of Non-government

Colleges/Institutes.

Adequate number of teaching and non-teaching staff and a Principal having

qualifications prescribed by the university/ concerned Central Council/ apex

body.

4. Financial requirement :—

A non-government institutes shall have endowment fund to the extent

decided and notified by the university from time to time to run the institutes

at least for 03 (three) years without aid from external sources.

Endowment fund shall be maintained in either of the two modes:-

In the name of the institutes by way of government securities.

ii.

FDR of Nationalized bank held by the institutes and pledged to the

university. In addition, the institutes seeking affiliation shall give an

undertaking to the university that it has sufficient recurring income

from its own resources for its continued and efficient functioning.

5. Procedure for granting affiliation

5.1. Temporary affiliation:—

Every newly established institutes or existing self-financed institutes

set up by a trust/ society seeking affiliation may be granted temporary

affiliation for specified period in the first instance subject to

fulfillment of the requirements laid down in the statutes.

ii. Letter of University’s permission (Consent of Affiliation) for starting

new courses or starting additional courses or enhancement of seats in

the existing courses in Health Sciences has to be obtained by the

college/institution from the University.

5.2. Application :—

a. For grant of affiliation an application in the Performa prescribed by the

university shall be submitted by the Principal of the concerned

colleges/institutes in case of Government Colleges/Institutes and by

the Chairman or Secretary of the duly registered trust/ society in case

of Non-government Colleges/Institutes.

b. University shall notify the last date for submission of fresh application

and review of existing application.

c. Non-refundable inspection cum processing fee as prescribed by the

university from time to time by demand draft drawn in favor of “The

Bihar University of Health Sciences Inspection cum processing Fund,

Patna” payable at Patna should be submitted with the application.

Note:- No inspection cum processing fee shall be charged from colleges/

institutes established by the government. The expenditure incurred on

payment of fee to inspectors, TA/ DA. etc. shall be met from the fund

received against the Inspection cum processing fund.

5.3. Certified copies of the documents to be submitted by Non-Government

Colleges/Institutes along with the application seeking affiliation for the

first time.

Registration certificate of the society/ trust from competent authority

along with details of its constitution and copy of memorandum of

association.

Letter from the competent authority designated by the state

government for classification of land and its location as in city or

other area.

Land use certificate from competent authority designated by the

government.

Building plan of proposed colleges prepared by a registered

architect.

No objection certificate from the concerned government department

permitting the society/ trust to start the colleges wherever necessary.

Details of the latest fund position duly certified by the bank.

Undertaking that after the affiliation of the colleges no transference

of management shall be made except with the prior approval of the

university, and the colleges shall faithfully adhere to the provisions

of the Act, Statutes, and Regulations of the University.

5.4. Processing of the application.— Applications received from the colleges/

institutes for any of the undernoted purpose:

i. Grant of fresh affiliation for existing colleges/ institutes setup by a

trust/ society on self-finance basis and affiliated to any other

university of the state.

ii. Newly established colleges/ institutes either by the government or a

trust/ society on self-finance basis.

iii. Addition of new programme or increase in intake in the affiliated

colleges of the university shall be processed in the following

manner;

The Registrar of the university on being satisfied that

application is in order and fulfill all the requirements laid

down in the statutes shall place the application before the

“New Teaching Programme Committee” for consideration and

necessary action.

The inspection team constituted by the “New Teaching

Programme Committee” shall visit the colleges/ institutes and

carry out inspection and shall submit its report in the proforma

prescribed by the university duly signed by all the members of

the inspection team. In case any member differs and does not

agree on certain points he can submit note of dissent in a

separate cover within seven days of the inspection.

The inspection report so received shall be placed before the

“New Teaching Programme Committee” for its perusal and

remarks. The “New Teaching Programme Committee” with its

remarks shall then transmit the inspection report to the “Board

of Affiliation”.

The “Board of Affiliation” shall scrutinize and examine the

inspection report and recommendation of the “New Teaching

Programme Committee” and on being satisfied may allow

programme wise temporary affiliation for specified duration

with or without condition or reject it for the reasons to be

recorded in writing.

The decision of the “Board of Affiliation” will be placed in

the very next meeting of the Executive Council for final

decision on the issue of granting affiliation or otherwise.

In case of non-government colleges/ institutes the university

will notify the affiliation only after the receipt of the requisite

affiliation fee and deposit of endowment fund as provided in

clause 4 (b).

Note:- No affiliation fee or endowment is required to be paid by

government colleges/institutes for such notification.

If the Executive Council for the reasons to be recorded in

writing rejects the application, the university shall convey the

decision of the Executive Council to the colleges/ institutes

giving therein the grounds of rejection and in such event the

colleges/institutes may apply again for affiliation after

removing the shortcomings but not before the expiry of six

months after rejection.

No colleges/ institutes can be affiliated with retrospective

effect.

Temporary affiliation of colleges/institutes can be extended on

year to year basis following positive inspection report and

approval of extension by the concerned Central Council/ Apex

Body wherever required.

6. Permanent Affiliation .—

6.1. Eligibility criteria.— Subject to the conditions hereunder given the university

may consider grant of permanent affiliation to a colleges/ institutes in part or

in full on receipt of such application from the colleges/ institutes.

a. The colleges/ institutes has completed at least five years of satisfactory

performance and has been accredited by national body after getting the

first temporary affiliation.

b. The construction of the buildings and infrastructure have been completed

as per standard and norms of the concerned Central Council/ apex body.

c. Appointment of Principal, adequate number of teaching and non-

teaching staff as per norms of the concerned Central Council/ Apex Body

has been done on regular basis by the governing body of the colleges/

institutes on the recommendation of the duly constituted selection

committee of the colleges for Non-government Colleges or by the

government for Government Colleges.

d. The colleges/institutes has a duly constituted governing body for Non-

government Colleges.

Provided the constitution of governing body for Government

Colleges is not mandatory.

6.2. Procedure for granting permanent affiliation.—

a. The procedure for grant of permanent affiliation shall be the same as for

temporary affiliation as laid down in clause (5) of Chapter-II of the

statutes.

Provided where any colleges/ institutes is already holding

permanent affiliation from any other university of the state for more than

ten (10) years and has been recognized for high level performance by

concerned Central Council/ apex body or any other similar statutory

body may be allowed permanent affiliation by this university after

following the prescribed procedure for such affiliation.

b. In case the University for reasons to be recorded in writing declines to

allow permanent affiliation to any Colleges/Institutes, the same shall be

communicated to the colleges/ institutes with reason of rejection. The

colleges/ institutes may apply again after removing the deficiencies but

not before expiry of six months after the date of rejection of the earlier

application.

7. Addition of new programme/ increase in intake.—

Proposal from any colleges/ institutes already affiliated with the university for

commencing new programme shall be considered by the university subject to the

following conditions:-

a. That there is genuine need of such a new programme in the existing colleges/

institutes and that it would not adversely affect the programme of any nearby

existing colleges/ institutes.

b. The colleges/ institutes has submitted application in the proforma prescribed

for each purpose separately along with the requisite fee through bank draft

drawn in favor of “Bihar University of Health Sciences inspection cum

processing fund, Patna” payable at Patna.

c. Increase in intake determined by teacher taught ratio by respective apex body

and fulfillment of other qualifying conditions laid down.

7.1.

Processing of the application.— Procedure for according the permanent

affiliation shall remain the same as mentioned in clause (5.4) in chapter- II of

the statutes. The addition of new programme or increase in intake shall come

into effect only after the approval of concerned Central Council/ apex body,

wherever necessary and the university is paid by the colleges/ institutes the

required additional affiliation fee.

8. Withdrawal of affiliation.—The affiliation of a colleges/institutes may at any time

be withdrawn in full or part or suspended, modified by the university if the colleges/ institutes

after due enquiry by a committee, constituted by the Board of affiliation, is found lacking in

one or more aspects as given below:

The colleges/ institutes has failed to comply with the provision of the

concerned Central Council/ Board or statutes, regulation of the university.

The colleges/ institutes is found to have failed to comply with the prescribed

condition/ requirements for affiliation.

The colleges/ institutes is found conducting itself in manner prejudicial to the

academic and administrative standard and detrimental to the interest of the

university.

The colleges/ institutes is found to have obtained affiliation by submitting

forged/ fake documents or by concealing certain facts.

The colleges/ institutes has violated any of the terms and conditions of the

bond contained in clause (9) of chapter –II of the statutes.

Cessation of the functioning of the colleges/ institutes for consecutive two

years after grant of affiliation.

The colleges/ institutes has shifted its location without obtaining prior

approval of the university.

The ownership of the colleges/ institutes or management has been transferred

to a different society/ trust without obtaining prior approval of the university.

If the colleges/ institutes has failed to start the classes during the academic

year for which permission was granted.

If the colleges/ institutes has not provided education/ instruction continuously

for at least three years in the course (s) for which affiliation has been

obtained.

Provided that no action under these clauses shall be taken unless the

concerned colleges/ institutes is given opportunity to be heard and the matter

shall be referred to the Senate through the Executive Council and the decision of

the Senate shall be final.

No college/Institute shall take admission of students for any course, after

an order of withdrawal of affiliation will be passed.

9. Execution of bond by society/ trust.— The registered society/ trust proposing the

self-financed colleges shall execute a bond for the following:-

a. To impart instruction only in the subjects and for the courses/programme in the

colleges/institutes for which affiliation has been granted by the university and

not any other discipline and shall not seek retrospective affiliation. All such

courses/programme shall follow the syllabi approved by the appropriate

academic bodies of the university.

b. To comply with all the provisions of the Act, Statutes and Regulation of the

university framed in this regard.

c. To follow the Rules, Regulations and Guidelines of the concerned Central

Council/Apex Body issued from time to time.

d. To the effect that the number of teaching posts, the qualification of teaching

staff and recruitment/promotion procedures as prescribed by the concerned

Central Council/Apex Body and condition of service shall be in accordance with

the Statutes /Regulation of the university and shall ensure imparting adequate

instruction to the students in the courses/programme of studies to be undertaken

by the colleges/ institutes and shall make effort to maintain the student-teacher

ratio in the colleges as per norms of the concerned Central Council/Apex Body.

e. To the effect that the members of the teaching and non-teaching staff are paid in

the pay scale prescribed by the university from time to time.

f. To the effect that appointment of the members of the teaching and the non-

teaching staff shall be made only on consideration of merit based on

qualification and experience prescribed for them and not by demanding or

accepting any donation or other considerations.

g. To the effect that all fees to be charged from the students shall be as per the fee

structure approved by the Executive Council of the university from time to time.

h. To the effect that the colleges shall not collect any capitation fee or donation in

any form amounting to corrupt practices from or on behalf of any of its student

or their parents/guardians except the prescribed fee and other charges as

approved by the university.

i. To the effect that no students shall be admitted to any programme of study by

the colleges/ institutes in anticipation of grant of affiliation or in excess of the

number of seats sanctioned per programme of study by the university.

j. To the effect that institutes has not received any grant or aid anytime either for

maintenance or development from the central government, state government or

any statutory body under their control for disbursing grant.

k. To the effect that the colleges shall not, without the previous permission of the

university, suspend the already approved course/ programme of study or

decrease the approved intake without the permission of the university.

l. To the effect that the academic and welfare activities of the students belonging

to the scheduled castes and other disadvantaged groups, including minorities,

wherever applicable, shall be properly taken care of by the colleges.

m. To the effect that all registers and records, including audited statement of

accounts as required be maintained under the regulations/ orders of the

university shall be maintained and made available as and when required for

inspection.

n. To the effect that the colleges shall furnish all such returns and other

information as the university may require to enable it to monitor and judge the

performance of the colleges/ institutes with regard to maintenance of academic

standards and shall take such action as the university may deem fit to maintain

the same.

o. To the effect that the payment of salary to the employees shall be made through

cheques/ bank transfer and that statutory deductions in respect of Provident

Fund etc. shall be deposited in the name of employee.

10. Saving.— Under Section 37 of the Act every employee or student of the Colleges

or of an Institution admitted to its privileges shall notwithstanding anything contained in this

Act, have a right to appeal within a period of 90 days to the Chancellor against the decision of

any officer or authorities of the University, and their upon the Chancellor may confirm, modify

or reverse the decision appealed against.

CHAPTER- III

GENERAL CONDITIONS OF SERVICES

1. General Conditions of Services for all officers / employees of the University will be

as per Bihar Government Servants (Classification, Control and Appeal) Rules, 2005

2. Rules, Regulations and Circulars notified by General Administration Department /

Finance Department, Government of Bihar shall be applicable to the University Officers/

Employees.

Note:-

In all matters not specifically dealt with in the Statues, Rules and orders updated

from time to time by State Govt. / UGC / Apex Body / Council shall be

applicable to the University Officers/Employees.

ii.

If any question arises regarding interpretation of any section of the statute it

shall be referred to the Chancellor, whose decision thereon shall be final.
