No. 3Pa/ZP-12-01 /2021/15544/P.R.—In exercise of the powers conferred by the
section 146 read with section 87 of the Bihar Panchayat Raj Act, 2006 (Bihar Act 6, 2006),
the Governor of Bihar is pleased to make the following Rules :-
1. Short name, extension and commencement :- (i) These Rules shall be called
the Bihar Zila Parishad (Conditions of Service) Rules, 2023
(ii) It shall extend to all Zila Parishads of the State.
(iii) It shall come into force from the date of its publication in the Official
Gazette.
2. Definitions:- In this Act, unless there is anything repugnant in the subject
or context-
(i)
"Act" means the Bihar Panchayat Raj Act, 2006;
(ii) "Section" means the section of the Bihar Panchayat Raj Act, 2006;
(iii) "Commission" means the Bihar Staff Selection Commission;
(iv) "Service Condition" means conditions relating to appointment, posting,
seniority, transfer, pay-allowances, leave, promotion, disciplinary control,
penalty, retirement, pension, gratuity and provident fund etc. ;
(v)
"Appointment on Compassionate Ground" means appointment of any
one of the dependents of the Zila Parishad employee who died in harness,
on compassionate ground in accordance with relevant circulars, directions
and instructions of the General Administration Department and Panchayati
Raj Department;

(vi) "Appointing Authority" means Chief Executive Officer of the concerned
Zila Parishad;
(vii) All other words and terms used but not defined in these Rules shall have
the same meaning as are assigned to them in the Act.
3. Classification of Officers/Employees of Zila Parishad :- Every Zila parishad
shall consist of the following category of posts :-
(a)
Administrative Category - The posts of Chief Executive Officer,
Additional Chief Executive Officer and Chief Planning Officer shall fall
under this category.
(b)
Clerical Category - The posts of Head Clerk, Upper Division Clerk and
Lower Division Clerk for office and various works related to Zila Parishad
shall fall under this category.
(c)
Engineering Category- The posts of District Engineers, Technical Advisor
(Assistant Engineer) and Estimating Officer (Junior Engineer/ Technical
Assistant) shall fall under this category.
(d)
Accounts cum Revenue Category - The posts of Chief Accounts officer
cum Revenue officer and Accounts officer/Accountant will fall under this
category.
(e)
IT Category- The posts of IT Manager, Zila Parishad, IT Assistant/Data
Entry Operator/Executive Assistant shall fall under this category.
(f)
Other Categories- The posts of Amin, Driver and Multi Tasking Staff
(MTS) such as Tax Collector, Orderly-cum-Chaukidar-cum-Sweeper cum
Gardener etc, shall fall under this category.
4. The number of different posts in Zila Parishads of type A and type B, based on
number of blocks in the districts, shall be such as determined by the Government from time
to time.
Note: Zila Parishads having more than 15 Blocks have been classified as type 'A'
Zila Parishad, where as Zila Parishads upto 15 Blocks have been classified as type 'B' Zila
Parishad.
5. State Government Officers posted in Zila Parishad:-
(1) Officials from the State Government may be posted/ deputed in each Zila
Parishad against the post of
(i) Chief Executive Officer.
(ii) Additional Chief Executive Officer.
(2) The salary and other emoluments/ allowances of such officials shall be paid
by the State Government.
Provided that the Chief Executive Officer/ Additional Chief
Executive Officer will charge his traveling allowances (other than transfer
or traveling on government duty) from fund of the concerned Zila Parishad.
(3) In addition to the officials mentioned in sub-rule (1), the following officials
may either be deputed in a Zila Parishad by the State Government by
obtaining their prior consent or may be selected by Zila Parishad in case of
non availability of officials from the State Government. Such officials shall
draw their salary and other emoluments from fund of the Zila Parishad.
(i)
Chief Accounts Officer.
(ii) Chief Planning Officer.
(iii) District
Engineer/Assistant
Engineer/Junior
Engineer/Technical
Assistant.
(iv) Such other officer as the Government thinks fit from time to time.

(4) The officials posted by the State Government in a Zila parishad shall be
governed by the directives issued from time to time by the concerned
department of the State Government with respect to their transfer, leaves,
tour diary and travelling allowance, annual confidential remarks etc.
subject to the following conditions :-
(a) The interim tour programme of the gazetted officers posted in Zila
Parishad shall be approved by the concerned Chief Executive Officer
or such authorities who have been authorised by him.
(b) The Adhyaksha may call for explanation from any official, posted by
State Government gazetted or non-gazetted, and may forward it to the
Divisional Commissioner with his comment for initiating necessary
disciplinary action against the erring official. The Divisional
Commissioner, after satisfying himself may send his recommendation
to the disciplinary authority of the concerned government official to
take necessary action against him in accordance with the provisions
of the Bihar Government Servant (Classification, Control and Appeal)
Rules, 2005.
(c) The Adhyaksha shall at the end of each financial year send a report to
the Collector on the performance and conduct of the Chief Executive
Officer and other gazetted and non-gazetted officials of the State
Government during the year. The Collector shall duly consider that
report before recording his annual confidential remark on
performance of the concerned official.
6. Sanction of leave etc. - (1) All officers and employees mentioned in Rule 3
(from A to E) shall be under the administrative control of the concerned Zila Parishad.
(2) Casual leave of all officers and employees save the Chief Executive Officer
of Zila Parishad shall be sanctioned by the Chief Executive Officer. Casual
leave of the Chief Executive Officer shall be sanctioned by the Adhyaksha,
Zila Parishad with intimation to the District Magistrate.
(3) The service condition of officials/employees posted in Zila Parishad shall
be same which is prescribed for the equivalent category of officials/
employees posted in the State Government.
7. Appointment and Promotion in Clerical Category - (1) There shall be a
clerical cadre in every Zila Parishad consisting of Lower Division Clerk, Upper Division
Clerk and Head Clerk. The post of Lower Division Clerk shall be of basic category, whereas
the posts of Upper Division Clerk and Head Clerk shall be filled from promotion.

(2) Direct Appointment on recommendation of the Commission shall be made
in the category of Lower Division Clerk. The persons appointed in the
Lower Division Clerk category shall be deemed to be employees of Zila
Parishad and their any claim to get pay scale and allowances etc. in par
with state government employees shall not be admissible.
(3) Promotion of an employee of clerical cadre will be done by a Promotion
Committee under the chairmanship of the Director, Panchayati Raj
Department, having other members as follows :-
(i) Departmental Joint Secretary/Deputy Secretary.
(ii) An officer belonging to SC/ST deputed by General Administration
Department and not below the rank of Deputy Secretary.

(iii) An officer belonging to minority class deputed by General
Administration Department and not below the rank of Deputy
Secretary.
(4) In matters of promotion of basic category Clerk to a Higher Category
Clerk, the Zila Parishad shall follow the same procedure which is adopted
by the General Administration Department, from time to time, after
completion of a stipulated time period, in promotion of equivalent level of
employees.
8. Procedure and other conditions of Appointment for clerical cadre of Zila
Parishad- (1) The appointing authority shall calculate the vacancies as on 1st April of every
year and after approval of the roster by the concerned District Magistrate will send it to the
Panchayati Raj Department by 30th April. The Panchayati Raj Department shall send
requisition to the Commission detailing categorywise/ Zila Parishad wise vacancies.
(2) The Commission shall publish the vacancies and after conducting
competitive examination shall prepare merit list of successful candidates
and send it to the Department. The merit list shall remain valid for one year
from the date of receipt of recommendation.
(3) The selected candidate will mark their preference as to which Zila Parishad
they desire to be appointed in. Accordingly their names will be forwarded
to the Zila Parishad of their choice for appointment. In case of more than
one choice against a single post for a particular Zila Parishad, preference
will be given to the candidate having seniority in the merit list.
(4) After scrutiny of certificates and verification of vacancies, the appointing
authority (Chief Executive Officer) shall appoint the candidate on
probation for a period of two years.
(5) Candidates appointed in clerical cadre shall have to clear Hindi Noting and
Drafting examination and computer compatibility test from an institution
prescribed by the Government.
(6) The minimum qualification for direct appointment on the post of Lower
Division Clerk shall be Intermediate (10+2) or equivalent qualification
with knowledge of computer application and typing.
(7) The minimum age for appointment shall be 18 years and the maximum will
be the age which shall be laid down by the State Government (General
Administration Department) from time to time.
9. Reservation - The provisions relating to reservation/roster by the State
Government shall be followed in appointment and promotion of the employees appointed by
Zila Parishad.
10. Probation - Every appointment from direct recruitment shall be made on
probation for a period of two years, and may be extended for one year by the Appointing
Authority (Chief Executive Officer) narrating the reasons in writing if service during the
probation period is not found to be satisfactory. If service is not found satisfactory even in
the extended period, the services of the concerned person shall be terminated.
11. Departmental Examination - (1) Every directly recruited employee shall have
to clear the departmental examination conducted by the Central Examination Committee of
Board of Revenue.
(2) The subject and course of departmental examination shall be determined by
the Central Examination Committee.
12. Confirmation: - After successful completion of the probation period and
passing out the Hindi Noting and Drafting examination, the computer compatibility Test and

departmental examination as prescribed, the service of the employee on probation shall be
confirmed.
13. Seniority list- Seniority list of clerical cadre shall be maintained at the level of
Zila Parishad, and the commissionery level seniority list for different posts at the level of the
commissioner of the respective division. Persons appointed on compassionate ground shall
be junior to such persons who shall be appointed through competitive examination in the
concerned recruitment year.
14. Transfer: The transfer of officials/employees posted or deputed in Zila Parishad
by the State Government shall be governed by the general rules prevalent in government
departments.
15. Appointment on compassion ground :- Zila Parishad Compassion Committee
constituted under the chairmanship of Chief Executive Officer, Zila Parishad shall be
competent to take decision on appointment of a dependent of the employee duly employed
in Zila Parishad office who died in harness. All members of the District Compassion
Committee shall be members of the Zila Parishad Compassion Committee. The Compassion
Committee shall follow the circulars/directions issued by the General Administration
Department (formerly personnel and Administrative Reforms Department) and Panchayati
Raj Department from time to time in matters of appointment on compassionate ground.
16. Status of Previous Posts: Posts held previously which are not included in these
Rules shall automatically cease to exist with the superannuation of employees appointed and
working on those posts.
17. Gratuity, Group Insurance Scheme and other benefits:- (1) Employees
appointed by Zila Parishad shall be covered by National Pension Scheme. The percentage
amount determined by National Pension Scheme shall be deducted as contribution from
their monthly pay and the percentage amount determined by National Pension Scheme shall
be contributed by the employer ie. Zila Parishad. Detailed guidelines regarding the
implementation of the scheme shall be issued separately.
(2) The employees appointed by Zila Parishad shall be eligible for payment of
cash amount equivalent to unutilized earned leave and death-cum-
retirement gratuity as admissible to employees of the State Government.
(3) Zila Parishad may grant the benefits of pay revision to its employees as
admissible to employees of the State Government after factual assessment
of its resources. No amount for this purpose shall be made available to Zila
Parishad by the State Government in any circumstances. To grant the
benefit of pay revision to employees without availability of resources shall
be construed as disregard of the government directives and the Chief
Executive Officer shall be held wholly responsible for this.
(4) The concerned Zila Parishad shall cover all employees appointed by it
under Group Insurance Scheme like State Government employees. After
retirement of the employee the total amount accrued with interest under this
scheme shall be returned to the concerned employee. In case of death of the
employee during service period, the amount accrued under this scheme
along with the insured amount shall be returned to the legal heir of the
employee.
18. Control and Appeal:- (1) All officers and employees of Zila Parishad shall
work under complete discipline and control of Chief Executive Officer, Zila Parishad.
(2) If any employee appointed by Zila Parishad, in opinion of the Chief
Executive Officer, Zila Parishad is found guilty of misconduct or refusal or
neglect in discharge of his duties or misuse of powers vested in him, Chief

Executive Officer, Zila Parishad may impose any punishment other than
dismissal, removal or reduction in rank to such officer or employee. ^^Zila
Parishad shall adopt the provisions of the Bihar Government Servant
(Classification, Control and Appeal) Rules, 2005 mutatis mutandis for
initiating action against an employee appointed by it.**
(3) Any officer or employee aggrieved by the order of the Chief Executive
Officer, Zila Parishad may prefer an appeal before Adhyaksha, Zila
Parishad, within 30 (thirty) days of the order.
(4) The Chief Executive Officer, Zila Parishad may recommend the dismissal,
removal or reduction in rank of such officer or employee and the Zila
Parishad may after consideration dismiss, remove or demote such officer or
employee after giving him reasonable opportunity of hearing.
(5) An appeal against the orders of the Zila Parishad shall lie with the
concerned Divisional Commissioner.
19. Residual matters:- Any matters not covered by these Rules, the members of the
cadre shall be governed by Rules or Orders applicable to the employees of equivalent level
of the State Government.
20. Interpretation:- If any doubt arises with respect to interpretation of any
provisions of these Rules or it appears that no provision has been made in it, the matter shall
be determined by the State Government and such determination shall be final.
21. Power of Government to make Regulations :- The State Government may, if
deemed necessary, make regulations from time to time for effective implementation of the
provisions of these rules.
22. Removal of difficulties:- (1) If any difficulty arises in giving effect to the
provisions of these Rules, the State Government or any other authority by order of the State
Government, as the case may be, dispose of or decide the issue.
(2) In the intervening period before implementation of these rules, the state
government may provide a procedure for making temporary/contractual
appointments to address the issue of providing manpower to Zila Parishads
in view of immediate requirements.
23. Repeal and savings:- (1) The Bihar Panchayat Samiti and Zila Parishad
(condition of service) Rules, 1964 is hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken in exercise
of any power conferred by or under the said Rules shall be deemed to have
been done or taken in exercise of the powers conferred by or under these
Rules as if these Rules were in force on the day on which such thing was
done or action taken.
