under proviso to Article-309 of the constitution of India, the Governor of Bihar is
pleased to make the following Rules for regulating the recruitment and service
conditions of the clerical cadre of the Audit Directorate, Finance Department, Bihar,
Patna and its Divisional offices :-
1.
Short title, extent and commencement.—These Rules may be called as
the "Audit Directorate Clerical Cadre (Recruitment and Service
Conditions) Rules, 2023".
(2) These Rules shall apply to the clerical cadre employees of the
Audit Directorate, Finance Department and its divisional offices.
(3) It shall come into force at once.
2.
Definitions:– In these Rules, unless otherwise requires in any context:–
(i) "Government" means the Government of Bihar;
(ii) “Governor” means the Governor of Bihar;
(iii) "Department" means the Finance Department, Bihar, Patna;
(iv) “Directorate” means the Audit Directorate, Finance Department,
Bihar, Patna,
(v) “Commission” means the Bihar Staff Selection Commission,
Patna.
(vi) “Cadre” means the Clerical cadre of the Audit Directorate,
Finance Department and its divisional offices;
(vii) “Member” means any person appointed to the cadre and it
includes any person appointed and working on a regular basis in
the clerical grade under the Audit Directorate, Finance
Department before coming into force of these rules;
(viii) "Appointing authority" means the Director of the Audit
Directorate, Finance Department, Bihar, Patna;

Constitution of cadre.—The constitution of the Clerical cadre in the
Audit Directorate, Finance Department and its divisional offices shall be
as follows:–

(ii) The pay scale of the posts of the said cadre shall be such as may
be sanctioned by the State Government from time to time.
4.
Cadre strength.—The Cadre strength shall be determined by the State
Government from time to time as per its requirements.
5.
Sources of recruitment:–
(i)
85 percent of the post in the category of Lower Division Clerk
shall, on the recommendation of the commission, be filled by
direct appointment.
(ii)
The appointing authority shall, on the basis of 1st April of each
year, calculate the vacancies (category wise) and shall send the
requisition to the Commission by 30th April.
(iii) The Commission shall recommend, to the appointing authority,
the names of successful candidates in order of the merit
prepared after selection on the basis of the competitive
examination.
(iv)
The appointing authority shall appoint the candidates on
probation for a period of two years after due scrutiny of the
credentials.
6.
Qualification:–
(i)
The minimum educational qualification for appointment to the
post of Lower Division Clerk shall be Intermediate (10+2) pass
or equivalent along with knowledge of computer operation and
computer typing.
(ii)
The minimum age for appointment shall be 18 years and the
maximum age limit shall be such as may be determined, by the
Government (General Administration Department) from time to
time.
7.
Reservation.—The rules, circulars and orders regarding reservation/
roster issued by the Government (General Administration Department)
shall apply to the appointments and promotions under these rules.
8.
Recruitment by promotion.—15 percent of the post in the category of
Lower Division Clerk shall, on the recommendation of Departmental
Promotion Committee, be filled on the basis of seniority-cum-
eligibility, from amongst such office attendants who possess the
required qualification for the appointment as Lower Division Clerks on
completion of "Kalawadhi" as determined by the General
Administration Department from time to time.
9.
Probation period.—Lower Division Clerks appointed under Rule 5 of
these rules shall remain on probation for a period of two years from
the date of appointment and such probation period may be extended for
one year in special circumstances by the appointing authority. Such
extension shall be done only if the appointment authority is of the
opinion that probationer has chance to improve. If the service is not
found satisfactory in the extended period also, the person concerned
shall be removed from the service.

10. Departmental examination.—The subject, syllabus and procedure for
the departmental examination shall be determined and conducted by
the Central Examination Committee (Revenue board), Bihar, Patna.
11. Confirmation:–
(i)
A probationer shall be confirmed after completion of
satisfactory probationary period as well as on completion of the
required training and on passing of the prescribed departmental
examination.
(ii)
Annual increment of pay to Lower Division Clerks shall be
granted only if they have qualified in typing and computer
efficiency test.
12. Seniority:–
(i)
The seniority of the employees appointed through direct
recruitment shall be in order of the merit–list determined by the
Commission, but the inter-se seniority decided before
notification of these rules shall remain unchanged.
(ii)
The Person appointed through promotion shall be senior to the
person appointed through direct recruitment in same recruitment
year.
(iii) The person appointed on the basis of compassionate ground
shall be junior to such persons who have been appointed through
promotion or direct recruitment in the concerned recruitment
year.
(iv)
The seniority list of the cadre shall be determined by the Audit
Directorate, Finance Department.
13. Promotion:–
(i)
Promotion from basic grade to higher may be given on
completion of "Kalawadhi" as determined by the General
Administration Department from time to time on the basis of
seniority-cum-eligibility and on the recommendation of
Departmental Promotion Committee.
(ii)
Departmental Promotion Committee shall be constituted by the
Audit Directorate, Finance Department.
14. Level of cadre.—This cadre shall be at state level and the employees of
this cadre shall be transferred to the headquarter under the Audit
Directorate, Finance Department and its divisional offices.
15. Stipulation regarding working area :– (i) The employees of this cadre
shall be transferred/posted/deputed to the headquarter and divisional
offices of the directorate by the Cadre Controlling Authority. The State
Government shall have right to depute any employee of this cadre to
any such cadre/ ex-cadre post.
16. Training.—The employees of this cadre must participate in the
prescribed training. The evaluation made at the end of the training may
be taken into consideration by the Departmental Promotion Committee.

17. Residual matters.— In respect of all such matters not specifically
provided for in these rules, the rules or instructions applicable to the
employees of the State Government for the time in force, shall apply.
18. Regulations.— The Audit Directorate, Finance Department shall have
the power to make regulations as per needs to make effective the
provisions of these rules.
19. Interpretation.—If any doubt arises as to the interpretation of any of
the provisions of these rules, the matter shall be decided by the
Department whose decisions shall be final.
20. Repeal and Saving:–
(i)
All rules/ instructions/ orders issued earlier with respect to this
cadre are hereby repealed.
(ii)
Notwithstanding such repeal, anything done or any action taken
under the said rules/instructions/orders shall be deemed to be
done or taken under these rules.
