Accordingly, the impugned order of dismissal dated 30.06.2015 (Annexure35) and

subsequent order dated 05.05.2016 rejecting the petitioner’s review applications are

hereby set aside. Consequences of setting aside of the impugned orders shall follow. The

petitioner shall be required to be reinstated in service forthwith.

Since the order of dismissal is based on perverse finding without evidence, it is

held that the petitioner shall be entitled to all back wages for the period during which he

remained out of service by virtue of order of dismissal which has been set aside. The order

of dismissal shall have no consequence right from the date when it was passed. Payment

of back wages shall depend upon the petitioner making out a case before the authorities

that he was not gainfully employed elsewhere during the period in question.

It goes without saying that the respondents shall be at liberty to take appropriate

action in accordance with law depending on the outcome of the criminal case instituted

against the petitioner.

Apparently thus, an order passed more than two years ago, has not been

implemented so far and the State is not willing to implement the said order on the ground

of filing of a time barred Letters Patent Appeal.

In my considered opinion, a case is made out of deliberate disobedience of this

Court's order.
