No.- 13/D.H-52/2020-180/Agri—In exercise of the power conferred by the proviso
to Article 309 of the Constitution of India the Governor of Bihar, is hereby pleased to
formulates the following rules for the recruitment, promotion and service conditions of
Block Horticulture Officer under the Bihar Horticulture Subordinate Service (Agriculture
subordinate Group-7 ) which is under the control of Directorate of Horticulture namely:-
1. Brief Name, Description and Commencement:
(1) These rules may be called the Bihar Horticulture Subordinate Service
(Agriculture subordinate Group-7) Block Horticulture Officer Recruitment,
Promotion and Other Services condition Rules, 2024.
(2) This shall be applicable across the State of Bihar.
(3) These shall come into force with immediate effect from the date of
publication in State gazette.
2. Definition:
(1) Department means Department of Agriculture, Government of Bihar
(2) “Cadre” means the cadre of Bihar Horticulture Subordinate Service
(Agriculture subordinate Group-7)
(3) Commission means Bihar Public Service Commission
(4) “Year” means financial year i.e. the period from 1st April to 31st March of
ensuing year
(5) “Member” means Person recruited under Bihar Horticulture Subordinate
Service (Agriculture subordinate Group-7)
(6) “Appointing Authority” means appointing authority as mentioned in the
Bihar Rules of Executive Business.
3. Constitution of Cadre and hierarchy of the post:
(1) This service shall be at the State level and Department of Agriculture,
Government of Bihar shall be its controlling department.
(2) The hierarchy of this cadre shall be as follows:

4. Appointment in the basic category-
(1) It shall be obligatory for the candidate to be a citizen of India for
appointment under the services. The vacant posts of the Block Horticulture
Officer shall be filled through direct recruitment.
(2) The appointing authority shall take stock of the vacancies as on 1st April of
each year and shall send the requisition to commission by 30th April.
(3) Educational qualification: The minimum educational qualification for basic
category of position of the cadre shall be graduation degree in horticulture
science (B. Sc. Horti.) / agriculture science (B. Sc. Ag.) from recognized
university / institute.

(4) Direct appointment:
a) Direct appointment shall be done from the candidates recommended on the
basis of the competitive exams conducted by the commission.
b) Selection on basic category posts will be done on the basis of the sum of
marks obtained in written and oral examination and giving weightage to the
period of work done under contract employment on the same post.
The merit list for selection shall be made on the basis of total marks by
following:
(i)
Weightage of marks received in written exam of Commission and
interview - 75 Marks
(ii) Weightage on years of experience of working on contractual basis
with Government of Bihar or non-private organizations under the
Government of Bihar (Such as Government of India, Urban Local
Bodies, Panchayat etc.)- 25 Marks
(For the contractual work experience at the rate of 5 marks per year
the maximum marks will be 25)
Note:- “The contractual service period with Government of Bihar
or non-private organizations under the Government of Bihar (Such
as Government of India, Urban Local Bodies, Panchayat etc.) shall
be decided by the controlling officer on the basis of scale of
payment issued under payment certificate. For the purpose of
calculating the work experience period, the service period shall be
estimated from the date of publication of the advertisement.”
But the duly recruited and employed contractual employees, in
regular appointment under direct recruitment on the same post, will
be given relaxation in the maximum age limit up to the number of
years for which they have worked in the same post on contractual
basis in Government of Bihar or non-private organizations under
the Government of Bihar (Such as Government of India, Urban
Local Bodies, Panchayat etc.).
c) Age limit: The minimum age as on 1st August of the year in which
applications are invited will be 21 (twenty one) years and the maximum age
limit will be the same as prescribed from time to time by the General
Administration Department for direct appointment in the services of the State
Government, but in special circumstances the department will be able to
increase it by recording the reason in written for the same.
d) Reservation: The compliance of reservation/roaster as notified by the State
Government from time to time, will be mandatory in recruitment and
promotion.
e) For direct appointment, the department will send a requisition with the
number of general and reservation category wise vacancies to the
commission every year.
f) Subject and syllabus for competitive exam: For direct appointment to the
post of Block Horticulture Officer, it will be mandatory to pass Hindi subject

of 100 marks in the examination conducted by Bihar Public Service
Commission, but its marks will not be counted for the purpose of preparing
the merit list. The merit list will be prepared on the basis of sum of marks
obtained
against
two
question
papers
of
200
marks
each
in
Horticulture/Agriculture Science, one question paper of General Knowledge
for 100 marks and oral examination for 50 marks. The syllabus of Hindi and
General Knowledge will be the same as decided for the joint competitive
examination conducted by Bihar Public Service Commission. The curriculum
of Horticulture/Agriculture Science will be prepared by the department in
consultation with Bihar Public Service Commission. Appropriate number of
candidates will be called for oral examination on the basis of the sum of
marks obtained in the three papers of Horticulture/Agriculture Science and
General Knowledge. The oral examination will be of 50 marks.
g) Recommendation of candidates by the Commission: Commission will
create separate merit list based on the sum of weightage of total marks
obtained in the written and oral examination and weightage of the marks
resulted from the contractual engagement. From these lists, the Commission
shall send reservation category wise recommendation to Department based
on the reported requisition.
5. Probation:
(1) Every member appointed by direct recruitment to the service shall be
on probation for a period of two years from the date of joining the post,
but in special circumstances, this period can be extended by the
department by one year with reasons to be recorded in written. If the
work of a member is not found satisfactory even within the extended
period, service of such member can be terminated by the government
without asking any reason or show cause, but written information shall
be given to the said member with the reasons.
(2) The probation period shall be calculated for the purpose of regular
service.
6. Training: It will be mandatory for the members appointed in Bihar Agricultural
Subordinate Service (Horticulture) group - 7 to receive training from the institute
determined by the department for promotion. Training institutes will be selected
by the department from time to time.
In-service/training will be organized by the Agriculture Department, in
which it will be mandatory for the officer to participate. On the basis of the
above, the benefit of promotion will be estimated, but the said promotion shall
not be obstructed in case the department does not organize training on time.
7. Departmental examination:
(1) It shall be compulsory for the members to pass the departmental examination
conducted by the Central Examination Committee (Revenue Board), Bihar.
(2) After the first increment in the pay scale of the basic category the second
increment will be given only after passing the departmental examination and
confirmation of service.

(3) This pause in the increment of the employees will be non-cumulative and the
withheld increments will be given after passing the examination.
(4) After completing 50 (fifty) years of age, employees can be exempted from
the requirement of passing the departmental examination under the
circulars/instructions issued from time to time by the General Administration
Department.
8. Service
Confirmation-After completing probation period, passing of
departmental examination and successful completion of prescribed training and
services found clear, the service of directly appointed members shall be
confirmed against the permanent cadre posts in the basic category.
9. Determination of seniority: The seniority of a member shall be determined in
the light of the policy laid down from time to time by the General Administration
Department.
10. Promotion to higher posts from the basic category:
(1) Promotion to higher posts in the hierarchy of service cadre will be given on
the basis of seniority cum merit over the personnel working in the line
immediately below and in the light of the instructions issued from time to
time by the General Administration Department. But promotion will be
given only after completing the provisioned training.
(2) However, the promotion will not be obstructed as a result of training not
being conducted timely by the department/institute.
(3) Confirmation will be necessary for promotion and the basis of promotion
will be seniority-cum-merit, internal clearance and fixed time period.
(4) Departmental Promotion Committee–The recommendation of the
Departmental Promotion Committee may be considered for promotion.
Departmental Promotion Committee will be constituted by the department.
11. Resolution of miscellaneous matters:
(1) The department shall be competent to interpret the rule of these Rules which
will be compulsory to obtain the opinion of the General Administration
Department/Law Department/Finance Department.
(2) The Department may resolve any difficulty arising in implementing any rule
of these Rules by publication of appropriate order in the Official Gazette
which is not inconsistent with the provisions of these Rules.
(3) The subjects or points for provisions not made in these Rules, the rules made
in the code/rules/resolution/instructions for the time being enforced by the
State Government shall be applicable in the context of this service in respect
to them.
12. Repeal and Savings:
(1) All the circulars/instructions/resolutions released regarding appointment of
staff/service conditions of this cadre before the commencement of these rules
are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the
said circulars/instructions/resolution previously issued shall be deemed to be
done or taken under these rules as if it were enforced on the day on which
such thing was done or such action was taken.
