Notification
The 16th January 2024
No.- M/ASTHA.A.RA.(A.)01/2015(AND)-36—In exercise of powers conferred by
Proviso to Article- 309 of the constitution of India, the Governor of Bihar is pleased to make
the following Rules for regulating the Recruitment, Promotion and other service conditions
of the clerical cadre for the office under the Directorate of Fisheries under Animal And Fish
Resources (Fish) Department :-
1. Short title, extent and commencement: –
(i)
These Rules may be called as "Bihar Fisheries Clerical Cadre recruitment
and service condition Rules, 2023.
(ii)
It shall extent to the whole of the State of Bihar.
(iii) It shall come into force at once.
2. Definition :- Unless otherwise required in the subject or context, in these rules :-
(i)
"Government" means The Government of Bihar;
(ii)
"Department" means Animal And Fish Resources (Fish) Department;
(iii)
"Commission" means Bihar Staff Selection Commission;
(iv)
"Appointing Authority" means Director Fisheries, Bihar, Patna ;
(v)
"Cadre" means Bihar Fisheries Clerical Cadre;
(vi)
"Departmental Promotion Committee" means Committee chaired by
Director Fisheries, constituted by the Department time to time;
(vii)
"Directorate" means Fisheries Directorate;
(viii) "Due Date" means the date of commencement of this Rule;
(ix)
"Appointment on Compassionate" means any one of the Dependant of the
deceased Government Servant appointed on compassionate ground as per
related Circular/Guidelines;
3. Cadre Structure :- The structure of the clerical cadre shall be as follows :-

Note: - The existing hierarchical structure of L.D.C. and U.D.C., Head clerk and
Assistant Administrative Officer shall continue till further order.
4. Cadre Strength.—This cadre will be a state cadre. The number of post as well as
total number of post in each category shall be as per the total post sanctioned by the
Government from time to time.
5. Recruitment: -
(i)
85 Percent of the total strength of L.D.C. shall be filled up through direct
recruitment/compassionate ground and remaining 15 percent shall be filled
with office group-D candidate having Intermediate qualification, eligible
for clerk, without any examination.
(ii)
Dependant of such deceased Government servant, who died during service
period, shall be directly recruited on the vacant post, those who meet the
requisite prescribed norms, on the basis of compassionate ground for which
recommendation of the Commission shall not be required.

(iii) Direct recruitment of Lower Division Clerk post shall be on the basis of
recommendation of Commission.
6. Qualification :-
(i)
For the direct recruitment for the post of L.D.C. minimum qualification
required is Computer operation and typing knowledge along with
Intermediate pass or equivalent.
(ii)
Minimum age required is 18 years for direct recruitment in this cadre and
maximum age shall be the same which is fixed by the State Government
from time to time.
(iii)
The principle for the age cut off date shall be 1st August of the year of
advertisement.
7. Procedure of Recruitment: -
(i)
Every year on the 1st April, the vacancy shall be calculated of basic cadre
for direct recruitment after roster clearance and requisition shall be sent
category wise to the Commission by 30th April.
(ii)
As per the requisition, application shall be invited and candidate shall be
selected by the Commission after publication of vacancy on the basis of
Inter (10+2) level examination.
(iii)
The Commission shall send its recommendation, category wise, as per
requisite vacancy, to the Appointing Authority. The appointing authority
shall verify the certificates of all the recommended candidates.
(iv)
After the recommendation of the Commission, the appointment procedure
shall comply the guidelines issued time to time by the Government.
(v)
The joining shall be accepted only after the issuance of appointment letter
by the appointing authority.
8. The notification issued by the Government from time to time for reservation/roster,
shall be enforced in direct recruitment and promotion of this cadre.
9. Recruitment through promotion: -
(i)
The appointing authority shall prepare list of Intermediate, or equivalent
passed. Office attendant/ attendant (special)
(ii)
On the recommendation of the Departmental Promotion Committee,
Promotion shall be given.
(iii)
Office attendant/attendant (special) shall be promoted as the gradation list,
but such promoted Lower Division clerk shall not be given further
increment after first increment unless they pass the noting and drafting,
computer competency test.
10. Promotion period.—There will be 2 years of probation period for the Lower
Division Clerk appointed through direct recruitment. The probation period shall be
enhanced for year if the services are satisfactory.
Even if the services are not satisfactory during the enhanced period, the appointing
authority shall terminate the service of such Lower Division Clerk without issuing
any notice.
11. Training.—Probating Lower Division Clerk have to complete successfully the
training conducted by Bihar Public Administrative and Rural Development Institute.
12. Departmental Exam:-
(i)
The Lower Division Clerk appointed through direct recruitment will have to
pass the examination conducted by Central Examination Board as well as
Scheduled Departmental Examination.

(ii)
The subject, syllabus of the Departmental Examination shall be determined
by Board of Revenue.
(iii)
The provisions of Bihar Government Servant (for confirmation computer
competency test) Rule 2011, shall be applicable.
(iv)
First annual increment shall be after passing the noting and drafting
examination conducted by Rashtrabhasha Directorate and eligible for next
annual increment only after passing in all the papers of all subjects of
Departmental Examination.
13. Confirmation.—After satisfactory completion of probation period, successful
completion of training and passing Departmental Examination services of Lower
Division Clerk shall be confirmed.
14. Seniority:-
(i)
The seniority of direct recruited Lower Division Clerk shall be fixed as per
the merit list of commission.
(ii)
The reciprocal seniority of Lower Division Clerk appointed through
promotion, will be determined as per the reciprocal seniority of office
attendant/attendant (special).
(iii)
The seniority of Lower Division Clerk appointed on compassionate ground
will be according to appointment order.
(iv)
In a calendar year, Lower Division Clerk appointed through direct
recruitment will be junior to the Lower Division Clerk appointed through
promotion but will be senior to the Lower Division Clerk appointed on
compassionate ground.
(v)
But prior to fixed date, the hierarchy of seniority fixed in this cadre will be
immutable.
15. Promotion:
(i)
After confirmation of services under available vacancy as per seniority and
merit, Promotion in higher category shall be considered.
(ii)
For promotion, the provision/order regarding duration issued by
Government shall be implemented.
(iii)
Character or work performance report, guidelines of charges shall be
implemented during considering promotion.
(iv)
The separate order for constitution of Departmental Promotion Committee
shall be issued by the Department.
16. Residual matter.—With regard to matters not specifically covered by these Rules,
the members of the cadres shall be governed by the Rules, Regulations or orders
applicable to the employees of the State Government at appropriate level.
17. Removal of difficulties.—The Government (General Administration Department)
may from to time, issue such general or special direction as may be necessary to
remove difficulties in the operation of any of the provisions of these Rules.
18. Power to relax.—Where the Government is of the opinion that it is necessary or
expedient so to do, it may, by order, for reasons to the recorded in writing, relax any
of the provisions of these Rules with respect to any person or any grade.
19. Interpretation.—Where any doubt arises as to the interpretation of any of the
provisions of these Rules, the matter shall be decided by the General Administration
Department whose decisions shall be final.

20. Repeal & Savings.-
(1) All resolutions and instructions issued earlier with respect to this cadre are
hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken in exercise
of any power conferred by or under such resolutions, instructions shall be
deemed to have been done or taken in exercise of the powers conferred by or
under these Rules as if these Rules were in force on the day on which such
thing or action was done or taken.
