सं. 3/4/आईडी/2024/एसडीआर/खÖड-I—1. यतः लोक Ĥितिनिध×व अिधिनयम, 1951 कȧ

धारा 61 मɅ यह उपबंिधत है ǐक िनवा[चकɉ के Ĥितǽपण का िनवारण करने कȧ Ǻǐƴ से, ताǐक उƠ

अिधिनयम कȧ धारा 62 के अधीन वाèतǐवक िनवा[चकɉ का उनके मत देने के अिधकार को और

अिधक Ĥभावी बनाया जा सके, मतदान के समय िनवा[चकɉ कȧ पहचान सुिनिƱत करने के साधन के

ǽप मɅ िनवा[चकɉ के िलए िनवा[चक फोटो पहचान पğ के उपयोग हेतु िनयमɉ के Ʈारा उपबंध ǐकए जा

सकते हɇ, तथा

2. यतः िनवा[चकɉ का रिजिèĚकरण िनयम, 1960 का िनयम 28 िनवा[चन आयोग को, इस

Ǻǐƴ से ǐक िनवा[चकɉ के Ĥितǽपण का िनवारण हो सके तथा मतदान के समय उनकȧ पहचान को

सरल बनाया जा सके, िनवा[चको को राÏय कȧ लागत पर फोटोयुƠ िनवा[चक फोटो-पहचान पğ

जारȣ करने के िलए िनदेश देने कȧ शǐƠ Ĥदान करता है; तथा

3. यतः, िनवा[चनɉ का संचालन िनयम, 1961 के िनयम 49 ज(3) और 49 ट(2) (ख) मɅ यह

उपबंिधत है ǐक जहाँ ǐकसी िनवा[चन ¢ेğ के िनवा[चकɉ को िनवा[चक रिजिèĚकरण िनयम, 1960, के

िनयम 28 के उƠ उपबंधɉ के अधीन िनवा[चक फोटो पहचान-पğ ǐदए गए हɇ, वहां िनवा[चकɉ को

मतदान केÛġ मɅ अपना िनवा[चक फोटो पहचान-पğ ǐदखाना होगा तथा उनकȧ ओर से उन िनवा[चक

फोटो पहचान पğɉ को नहȣं ǐदखाए जाने या ǐदखाने मɅ असमथ[ होने पर उÛहɅ मत डालने कȧ अनुमित

देने से इÛकार ǐकया जा सकता है; तथा

4. यतः, उƠ अिधिनयम, और िनयमɉ के उपयु[Ơ उपबंधɉ को िमलाकर एवं सामंजèयपूण[

ढंग से उनके अÚययन से यह èÜषट होता है ǐक यƭǐप मत देने का अिधकार िनवा[चक नामावलȣ मɅ

नाम के होने से हȣ होता हɇ, यह िनवा[चन आयोग Ʈारा राÏय कȧ लागत पर, मतदान के समय उनकȧ

पहचान सुिनिƱत करने के साधन के ǽप मɅ Ĥदान करवाए गए िनवा[चक फोटो पहचान पğ के Ĥयोग

पर भी िनभ[र करता है, तथा दोनɉ का एक साथ Ĥयोग करना होता है; तथा

5. यतः, िनवा[चन आयोग ने एक समयबƨ काय[Đम के अनुसार सभी िनवा[चकɉ को िनवा[चक

फोटो पहचान-पğ ई0पी0आई0सी0 जारȣ करने का िनदेश देते हुए 28 अगèत, 1993 को एक आदेश

जारȣ ǐकया है; तथा

6. यतः, देश मɅ लगभग 100% िनवा[चकɉ को िनवा[चक फोटो पहचान पğ जारȣ ǐकए जा चुके

हɇ ,तथा

7. अत: अब, सभी संबƨ कारकɉ तथा ǐविधक एवं तØया×मक िèथितयɉ को, Úयान मɅ रखते

हुए, िनवा[चन आयोग, एतÙƮारा, यह िनदेश देता है ǐक ǐदनांक 20.03.2024, 28.03.2024, 12.04.2024,

18.04.2024, 26.04.2024, 29.04.2024, 07.05.2024 को अिधसूिचत होने वाले वत[मान लोक सभा

तथा आंĢ Ĥदेश, अǽणाचल Ĥदेश, ओǐडशा और िसिÈकम ǐवधान सभाओं के साधारण िनवा[चन,

2024 एवं 13 राÏयɉ मɅ 26 ǐवधान सभाओं (अनुलÊनक-1) के उप िनवा[चनɉ के िलए सभी िनवा[चकɉ

िजÛहɅ िनवा[चक फोटो पहचान पğ जारȣ ǐकए गए हɇ, से अपे¢ा कȧ जाती है ǐक वे मतदान èथल पर

ǐबहार गजट (असाधारण), 21 माच[, 2024

अपना मत डालने से पहले अपनी पहचान सुिनिƱत करने हेतु अपना िनवा[चक फोटो पहचान पğ

ǐदखाएंगे। ऐसे िनवा[चक जो अपना िनवा[चक फोटो पहचान पğ Ĥèतुत नहȣं कर पाते हɇ, उÛहɅ अपनी

पहचान èथाǐपत करने के िलए िनàनिलिखत वैकिãपक फोटो पहचान दèतावेजɉ मɅ से कोई एक Ĥèतुत

करना होगा:-

बɇको / डाकघरɉ Ʈारा जारȣ ǐकए गए फोटोयुƠ पासबुक,

8. एǐपक के संबंध मɅ, लेखन अशुǐƨ, वत[नी कȧ अशुǐƨ इ×याǐद को नजरअंदाज कर देना

चाǐहए बशतɏ िनवा[चक कȧ पहचान एǐपक से सुिनिƱत कȧ जा सके। यǐद कोई िनवा[चक फोटो पहचान

पğ Ĥदिशत[ करता है, जो ǐक ǐकसी अÛय सभा िनवा[चन-¢ेğ के िनवा[चक रिजèĚȣकरण अिधकारȣ

Ʈारा जारȣ ǐकया गया हɇ, ऐसे एǐपक भी पहचान èथाǐपत करने हेतू èवीकृत ǐकए जाएंगे बशतɏ उस

िनवा[चक का नाम जहां वह मतदान करने आया है उस मतदान कɅ ġ से संबंिधत िनवा[चक नामावलȣ मɅ

उपलÞध हो। यǐद फोटोĒाफ इ×याǐद के बेमेल होने के कारण िनवा[चक कȧ पहचान सुिनिƱत करना

संभव न हो तब िनवा[चक को उपयु[Ơ पैरा 7 मɅ विण[त ǐकसी एक वैकिãपक फोटो दèतावेज को Ĥèतुत

करना होगा।

9. उƠ पैरा 7 मɅ ǐकसी बात के होते हुए भी, Ĥवासी िनवा[चकɉ को जो अपने पासपोट[ मɅ

ǐववरणɉ के आधार पर लोक Ĥितिनिध×व अिधिनयम, 1950 कȧ धारा 20क के अधीन िनवा[चक

नामाविलयɉ मɅ पंजीकृत हɇ, मतदान केÛġ मɅ केवल उनके मूल पासपोट[ (तथा कोई अÛय पहचान

दèतावेज नहȣं) के आधार पर हȣ पहचाना जाएगा ।

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the

Election Commission to direct, with a view to preventing personation of electors and

facilitating their identification at the time of poll, issue of Electors Photo Identity Card to

electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules,

1961, stipulate that where the electors of a constituency have been supplied with

Electors’ Photo Identity Card under the said provisions of Rule 28 of the Registration of

Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the

polling station and failure or refusal on their part to produce those Elector Photo

Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of

the said Act and the Rules, makes it clear that although the right to vote arises by the

existence of the name in the electoral roll, it is also dependent upon the use of the

Elector Photo Identity Card, where provided by the Election Commission at State cost, as

the means of establishing their identity at the time of polling and that both are to be

used together; and

5. Whereas, the Election Commission made an Order on the 28^th August, 1993,

directing the issue of Electors’ Photo Identity Card (EPIC) to all electors, according to a

time bound programme; and

6. Whereas, Electors’ Photo Identity Card have been issued to approximate 100%

electors in the country, and

7. Now, therefore, after taking into account all relevant factors and the legal and

factual position, the Election Commission hereby directs that for the current General

Election to the Lok Sabha and Legislative Assemblies of Andhra Pradesh, Arunachal

Pradesh, Odisha & Sikkim, 2024 and Bye-elections to 26 Assembly Constituencies in 13

States (as per Annexure-I) to be notified on 20.03.2024, 28.03.2024, 12.04.2024,

18.04.2024, 26.04.2024, 29.04.2024, 07.05.2024 all electors who have been issued EPIC

are expected to produce the EPIC for their identification at the polling stations before

casting their votes. Those electors who are not able to produce the EPIC shall produce

one of the following alternative photo identity documents for establishing their

identity:-

(i) Aadhaar Card,

(ii) MNREGA Job Card,

(iii) Passbooks with photograph issued by Bank/Post Office,

(iv) Health Insurance Smart Card issued under the scheme of Ministry of

Labour,

(v) Driving License,

(vi) PAN Card,

(vii) Smart Card issued by RGI under NPR,

(viii) Indian Passport,

(ix) Pension document with photograph,

(x) Service Identity Cards with photograph issued to employees by

Central/State Govt./PSUs/Public Limited Companies,

(xi) Official identity cards issued to MPs/MLAs/MLCs, and

(xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment,

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored

provided the identity of the elector can be established by the EPIC. If an elector

produces an EPIC which has been issued by the Electoral Registration Officer of another

Assembly Constituency, such EPIC shall also be accepted for identification provided that

the name of that elector finds place in the electoral roll pertaining to the polling station

where the elector has turned up for voting. If it is not possible to establish the identity

of the elector on account of mismatch of photograph, etc. the elector shall have to

produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are

registered in the electoral roll under Section 20A of the Representation of the People

Act, 1950, based on the particulars in their Indian Passport, shall be identified on the

basis of their original passport only (and no other identity document) at the polling

station.
