public trust. Society is, therefore, entitled to expect that a
Judge must be a man of high integrity, honesty and
required to have moral vigour, ethical firmness and
impervious to corrupt or venial influences.
…..... It is, therefore, a basic requirement that a Judge’s
official and 2onourab conduct be free from impropriety;
the same must be in tune with the highest standard of
propriety and probity.”

“…….It is settled law that mere inclusion of a name of a
candidate in the select list does not confirm on such
candidate any vested right to get an order of appointment.
The position is made clear in para 7 of the Constituion
Bench Judgement of this court.
In Commissioner of Police & Ors. Vs. Mehar Singh Civil Appeal no. 4842 of 2013
The Apex Court held that:-
31. In the ultimate analysis, we are of the view that
the opinion formed by the Screening Committee in both
these cases which is endorsed by the Deputy
Commissioner of Police (Recruitment), Delhi, that both
the respondents are not suitable for being appointed in
the Delhi Police Force does not merit any interference. It

is legally sustainable. The Tribunal and the High Court,
in our view, errored in setting aside the order of
cancellation of the respondents’ candidature. In the
circumstances, the appeals are allowed. The orders of the
Delhi High Court impugned in both the appeals are set
aside. The cancellation of candidature of the respondents
– Mehar Singh and Shani Kumar is upheld.

“13. It is thus well settled that acquittal in a criminal case
does not automatically entitle him for appointment to the
post. Still it is open to the employer to consider the
antecedents and examine whether he is suitable for
appointment to the post. From the observations of this
Court in Mehar Singh, 2013 (7) SCC 685 and Parvez
Khan, 2015 (2) SCC 591 cases, it is clear that a candidate
to be recruited to the police service must be of impeccable
character and integrity. A person having criminal
antecedents will not fit in this category. Even if he is
acquitted or discharged, it cannot be presumed that he
was 3 onourably acquitted/completely exonerated. The
decision of the Screening Committee must be taken as
final unless it is shown to be malafide. The Screening
Committee also must be alive to the importance of the
trust reposed in it and must examine the candidate with
utmost character.
28. We, thus, are of the view that the High Court did not commit
any error in dismissing the writ petition. The appellant was
not entitled for any relief in the writ petition. In the result,
while dismissing this appeal we observe that stigma, if any,
of the criminal case lodged against appellant under Section
498A/406/34 IPC is washed out due to the acquittal of the
appellant vide judgement dated 18.09.2019.
