सं. 576/एि᭍जट/2024/एसडीआर/ख᭛ड–I—यतः िनवाᭅचन आयोग के ᮧेस नोट सं. ईसीआई/

पीएन/ 32/2024 ᳰदनांक 27.03.2024 के साथ पᳯठत ᮧेस नोट सं. ईसीआई/ पीएन/ 23/ 2024 और

ईसीआई/पीएन/24/2024 ᳰदनांक 16 माचᭅ, 2024 के जᳯरए घोिषत ᳰकए गए लोक सभा तथा आंᮥ

ᮧदेश, अᱧणाचल ᮧदेश, ओिडशा और िसᳰᲥम िवधान सभाᲐ के साधारण िनवाᭅचन, 2024 एवं 12

रा᭔यᲂ मᱶ 25 िवधान सभाᲐ के उप िनवाᭅचन के िलए कायᭅᮓम (संलᲨक-1 के अनुसार) कᳱ घोषणा कर

दी गई है ।

2. यतः, लोक ᮧितिनिध᭜व अिधिनयम 1951 (संᭃेप मᱶ लो.ᮧ.अिधिनयम, 1951) कᳱ धारा

126क मᱶ यह िविन᳸दᭅ᳥ ᳰकया गया है ᳰक "(1) कोई भी ᳞िᲦ कोई िनगᭅम मत सवᱷᭃण नहᱭ करेगा और

ᳰकसी िनगᭅम मत सवᱷᭃण के पᳯरणाम का, ऐसी अविध के दौरान जो िनवाᭅचन आयोग ᳇ारा इस संबंध

मᱶ अिधसूिचत कᳱ जाए, ᳲᮧंट या इले᭍ᮝॉिनक मीिडया के मा᭟यम से ᮧकाशन या ᮧचार या ᳰकसी भी

ᮧकार कᳱ अ᭠य रीित मᱶ ᮧसार नहᱭ करेगा।

(2) िनवाᭅचन आयोग, उपधारा (1) के ᮧयोजन के िलए, िन᳜िलिखत को ᭟यान मᱶ रखते ᱟए

साधारण आदेश ᳇ारा तारीख और समय अिधसूिचत करेगा, अथाᭅत :-

(क) साधारण िनवाᭅचन कᳱ दशा मᱶ, वह अविध मतदान के पहले ᳰदन के संबंध मᱶ मतदान के

िलए िनयत समय के आरंभ होने से शुᱨ होगी और सभी रा᭔यᲂ और संघ रा᭔य-ᭃेᮢᲂ मᱶ

मतदान समा᳙ होने के आधे घंटे तक जारी रहेगी;

(ख) ᳰकसी उप-िनवाᭅचन या एक साथ कराए जाने वाले अनेक उप-िनवाᭅचनᲂ कᳱ दशा मᱶ वह

अविध मतदान के पहले ᳰदन से ही मतदान के िलए िनयत समय के आरंभ होने से शुᱨ

होगी और मतदान समा᳙ होने के प᳟ात् आधे घंटे तक जारी रहेगी;

परंतु िभ᳖-िभ᳖ ᳰदनᲂ पर एक साथ कराए जाने वाले अनेक उप-िनवाᭅचनᲂ

कᳱ दशा मᱶ, वह अविध मतदान के पहले ᳰदन के संबंध मᱶ मतदान के िलए िनयत समय

के आरंभ होने से शुᱨ होगी और अंितम मतदान समा᳙ होने के प᳟ात आधे घंटे तक

जारी रहेगी।

(3) कोई ᳞िᲦ, जो इस धारा के उपबंधᲂ का उ᭨लंघन करेगा ऐसी अविध के कारावास से,

जो दो वषᭅ तक कᳱ हो सकेगी या जुमाᭅने से या दोनᲂ से, दंडनीय होगा।"

3. अब, इसिलए, लोक ᮧितिनिध᭜व अिधिनयम, 1951 कᳱ धारा 126क कᳱ उपधारा (1) के

अधीन शिᲦयᲂ का ᮧयोग करते ᱟए िनवाᭅचन आयोग उᲦ धारा कᳱ उप-धारा (2) के उपबंधᲂ के

दृि᳥गत,19 अᮧैल, 2024 (शुᮓवार) को पूवाᭅ᭮न 07:00 बजे तथा 1 जून, 2024 (शिनवार) को

अपरा᭮न 6:.30 बजेके बीच कᳱ अविध को, ऐसी अविध के ᱨप मᱶ अिधसूिचत करता है िजसके दौरान

वतᭅमान लोक सभा के साधारण िनवाᭅचन और लोक सभा के साधारण िनवाᭅचन के साथ-साथ

आयोिजत कराए जाने वाले आंᮥ ᮧदेश, अᱧणाचल ᮧदेश, ओिडशा और िसᳰᲥम िवधान सभाᲐ के

साधारण िनवाᭅचन, 2024 एवं 12 रा᭔यᲂ मᱶ 25 िवधान सभाᲐ के उप िनवाᭅचनᲂ (संलᲨक-1 के

अनुसार) के संदभᭅ मᱶ ᳰकसी भी ᮧकार के एि᭏जट पोल का आयोजन करने तथा ᳲᮧंट या इले᭍ᮝॉिनक

मीिडया ᳇ारा इसके पᳯरणाम के ᮧकाशन या ᮧचार अथवा ᳰकसी भी अ᭠य तरीके से उसका ᮧचार-

ᮧसार करने पर ᮧितबंध होगा।

4. यह भी ᭭प᳥ ᳰकया जाता है ᳰक लोक ᮧितिनिध᭜व अिधिनयम, 1951 कᳱ धारा

126(1)(ख) के अधीन उपयुᭅᲦ साधारण िनवाᭅचनᲂ एवं उप-िनवाᭅचनᲂ के संबंध मᱶ मतदान कᳱ समाि᳙

के िलए िनयत समय पर समा᳙ होने वाली 48 घंटᲂ कᳱ अविध के दौरान ᳰकसी भी इले᭍ᮝािनक

मीिडया मᱶ ᳰकसी भी ओिपिनयन पोल या ᳰकसी अ᭠य मतदान सवᱷᭃण के पᳯरणामᲂ सिहत ᳰकसी भी

ᮧकार के िनवाᭅचन संबंधी मामले के ᮧदशᭅन पर ᮧितबंध हटेगा ।

NOTIFICATION

No. 576/EXIT/2024/SDR/Vol.I--Whereas, the schedule for the General Elections

to Lok Sabha and Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh,

Odisha & Sikkim, 2024 and bye-election to 25 Assembly Constituencies in 12 States

(as per annexure-1) as announced by the Election Commission vide Press Notes No.

ECI/PN/23/2024 and No. ECI/PN/24/2024 both dated 16^th March 2024 read with

Press Note No. ECI/PN/32/2024 dated 27^th March, 2024.

2. Whereas, Section 126A of The Representation of the People Act, 1951(in

short R.P. Act, 1951) specifies that “(1) No person shall conduct any exit poll and

publish or publicise by means of the print or electronic media or disseminate in any other

manner, whatsoever, the result of any exit poll during such period, as may be notified by

the Election Commission in this regard.

(2) For the purposes of sub-section (1), the Election Commission shall,

by a general order, notify the date and time having due regard to the

following, namely: —

(a) in case of a general election, the period may commence from the

beginning of the hours fixed for poll on the first day of poll and

continue till half an hour after closing of the poll in all the States and

Union territories;

(b) In case of a bye-election or a number of bye-elections held together,

the period may commence from the beginning of the hours fixed for

poll on and from the first day of poll and continue till half an hour

after closing of the poll;

Provided that in case of a number of bye-elections held

together on different days, the period may commence from the

beginning of the hours fixed for poll on the first day of poll and

continue till half an hour after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be

punishable with imprisonment for a term which may extend to two years

or with fine or with both.”

3. Now, therefore, in exercise of the powers under sub-Section (1) of Section

126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of

sub-Section (2) of the said Section, hereby notifies the period between 7.00A.M on 19^th

April, 2024 (Friday) and 6.30 PM on 1^st June, 2024 (Saturday) as the period during

which conducting and publishing or publicizing exit poll by means of the print or

electronic media or dissemination in any other manner whatsoever, the result of any exit

poll in connection with the current General Elections to Lok Sabha and Legislative

Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim, 2024 and

bye-election to 25 Assembly Constituencies in 12 States (as per annexure-1) to be

held simultaneously with the general election to Lok Sabha, shall be prohibited

4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951,

displaying any election matter including results of any opinion poll or any other poll

survey, in any electronic media, would be prohibited during the period of 48 hours

ending with the hours fixed for the conclusion of the poll in connection with the

aforesaid general elections and bye-elections.
