Notification

The 11^thSeptember 2024

No- Ni.Vi./Stha.Vi.-527/2008-4436(Enc)— In exercise of the powers conferred by

Section 24 of the Bihar Special Courts Act, 2009 (Act no.5 of 2010), the Governor of Bihar

do hereby make the following rules to amend the Bihar Special Court Rules, 2010.

Short title and commencement:-

(1) These Rules may be called the Bihar Special Courts (Amendment)

Rules, 2024.

(2)

It shall come into force from 26-07-2018.

2.(1) Amendment in section (a) of sub rule (1) of Rule 2 of the Bihar Special

Court Rules, 2010:-

The provision of the section (a) of sub rule (1) of Rule 2 of the said rule

shall be substituted by the following words:-

(a) "Act" means the Bihar Special Courts Act 2009 & Bihar Special

Courts (Amendment) Act,2022."

(2) Amendment in Rule section (b) of sub rule (1) of Rule 2 of the Bihar

Special Court Rules, 2010:-

The provision of the section (b) of sub rule (1) of Rule 2 of the said rule

shall be substituted by the following words:-

(b)

"Court" means a Special Court established under sec-3(1) of Chapter

II of the Bihar Special Courts Act, 2009 & Bihar Special Courts

(Amendment) Act, 2022."

Amendment in Rule 11(g) of Bihar Special Courts Rules, 2010:-

Provision of Rule 11(g) of the said rule shall be substituted by the

following:-

"If the delinquent public servant or other affected person/persons

proposes to contest the valuation of the property, then he/they shall file

objections within the period stipulated in Rule 11(b) & Rule 11(c) of the

Bihar Special Courts Rules, 2010. Thereafter, the Authorised Officer may

take assistance of such State Government agency or Central Government

agency or any other officer or person technically qualified as he may deem fit

and proper.

Amendment in Form No. I prescribed in Sub rule (1) of Rule 7 of Bihar

Special Courts Rules, 2010:-

Form No. I prescribed in Sub rule (1) of Rule 7 of the said rule shall

be substituted by the Appendix-1 attached.

Amendment in Form No. III prescribed in Sub rule (3) of Rule 14 of

Bihar Special Court Rules, 2010:-

Form No. 3 prescribed in Sub rule (3) of rule 14 of the said Rules

shall be substituted by the Appendix-2 attached.

Rest of the provisions of the Bihar Special Courts Rules 2010 will remain

unchanged.

DECLARATION

WHEREAS, It was alleged that Shri....................................................... ..(name and

Office) in the State of Bihar committed an offence under clause (e) of sub-section (1) of Section 13

of the Prevention of Corruption Act, 1988 or clause (b) of sub-section (1) of Section 13 of the

Prevention of Corruption Act, 1988 (Amended Act, 2018) and that the matter was investigated in

Vigilance Case No................of,

AND WHEREAS, on scrutiny of relevant materials available on record, the State

Government is of the opinion that there is prima facie case of Commission of the (name of the

accused) who has accumulated properties disproportionate to his known sources of income by

resorting to corrupt means;

AND WHEREAS, it is felt necessary and expedient by the Government that the

said offender should be tried by the Special Court established under sub-section (1) of Section 3 of

Special Courts Act, 2009/Bihar Special Courts (Amendment) Act, 2022;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of

Section 5 of Special Courts Act, 2009/Bihar Special Courts (Amendment) Act, 2022, the State

Government do hereby declare that the said offence shall be dealt with under the Special Courts

Act, 2009/ Bihar Special Courts (Amendment) Act, 2022;
