िनवा[चन सदन, अशोक रोड, नई ǐदã लȣ-110001/ ǐदनांक 17 अÈटूबर, 2024

सं. 576/3 ईवीएम/2024/एसडीआर/खÖड–I— यतः, लोक Ĥितिनिध×व अिधिनयम, 1951 कȧ

धारा 61क मɅ यह उपबंध ǐकया गया है ǐक ऐसे िनवा[चन ¢ेğ या िनवा[चन ¢ेğɉ मɅ वोǐटंग मशीनɉ Ʈारा

मतदान करने और मतɉ के अिभलेखन का यथाǐवǐहत ऐसा तरȣका अपनाया जाए, जैसा ǐक भारत िनवा[चन

आयोग Ʈारा Ĥ×येक मामले कȧ पǐरिèथितयɉ को Úयान मɅ रखते हुए, ǐविनǐद[ƴ ǐकया जाए;

2. यतः, िनवा[चनɉ का संचालन िनयम, 1961 के िनयम 49क के परÛतुक के अनुसार भारत

िनवा[चन आयोग Ʈारा यथा-अनुमोǐदत ऐसे ǐडजाइन वाला Ĝॉप बॉÈस युƠ एक ǐĤंटर भी, ऐसे िनवा[चन ¢ेğ

या िनवा[चन ¢ेğɉ या उसके भागɉ मɅ मत के पेपर Ěेल के मुġण के िलए मतदान मशीन के साथ जोड़ा जाए

जैसा ǐक भारत िनवा[चन आयोग Ʈारा िनदेश ǐदया जाए;

3. यतः, िनवा[चन आयोग ने अपने Ĥेस नोट सं. ईसीआई/पीएन/149/2024 और सं.

ईसीआई/पीएन/150/2024 दोनɉ ǐदनांक 15 अÈटूबर,2024 के जǐरए घोǐषत झारखंड और महाराƶ कȧ

ǐवधान सभाओं के िलए वत[मान आम चुनावɉ और 48 ǐवधानसभा िनवा[चन ¢ेğɉ एवं 2 संसदȣय िनवा[चन

¢ेğɉ के िलए उप-िनवा[चनɉ (संलÊनक-1 के अनुसार) मɅ सभी पǐरिèथितयɉ पर ǐवचार ǐकया है,और

िनवा[चन आयोग संतुƴ है ǐक उपयु[Ơ ǐवधान सभा िनवा[चन ¢ेğɉ एवं संसदȣय िनवा[चन ¢ेğɉ मɅ मतदान

कराने के िलए पया[Ư संÉया मɅ इलेÈĚॉिनक वोǐटंग मशीनɅ (ईवीएम) और पेपर Ěेल [मतदाता स×यापनीय

पेपर ऑǐडट Ěेल मशीन (वीवीपैट)] मुǐġत करने के िलए ǐĤंटर उपलÞध हɇ। मतदान कािम[क ईवीएम और

‘वीवीपैट ǐĤंटरɉ’ को कुशलतापूव[क संभालने मɅ अÍछȤ तरह से Ĥिशि¢त हɇ और मतदाता भी ईवीएम और

वीवीपैट ǐĤंटरɉ के Ĥचालन से पूण[ Ǿप से अवगत हɇ।

4. अब, इसिलए, भारत िनवा[चन आयोग, लोक Ĥितिनिध×व अिधिनयम, 1951 कȧ उƠ धारा

61क तथा िनवा[चनɉ का संचालन िनयम, 1961 के िनयम 49क के तहत अपनी शǐƠयɉ का Ĥयोग करते

हुए, एतÙƮारा, झारखंड मɅ 18.10.2024 & 22.10.2024 को अिधसूिचत ǐकए जाने वाले ǐवधानसभा

िनवा[चन ¢ेğɉ और महाराƶ मɅ 22.10.2024 को अिधसूिचत ǐकए जाने वाले सभी ǐवधानसभा िनवा[चन

¢ेğɉ और ǐविभÛन राÏयɉ कȧ 47 ǐवधानसभा ¢ेğɉ और 18.10.2024 को अिधसूिचत ǐकए जाने वाले

केरल मɅ वयनाड संसदȣय िनवा[चन ¢ेğ; 22.10.2024 को अिधसूिचत ǐकए जाने वाले उƣराखंड के

केदारनाथ ǐवधान सभा िनवा[चन ¢ेğ तथा महाराƶ के नांदेड़ संसदȣय िनवा[चन ¢ेğ (संलÊनक-1 के

अनुसार), को ऐसे िनवा[चन ¢ेğɉ के Ǿप मɅ ǐविनǐद[ƴ करता है, िजनमɅ िनवा[चनɉ का संचालन िनयम, 1961

और इस ǐवषय पर िनवा[चन आयोग Ʈारा समय-समय पर जारȣ ǐकए गए अनुपूरक अनुदेशɉ के अंतग[त

ǐवǐहत तरȣके से इलेÈĚॉिनक वोǐटंग मशीनɉ तथा वीवीपैट ǐĤंटरɉ के माÚयम से मत डाले और अिभिलिखत

ǐकए जाएंगे।

No. 576/3 EVM/2024/SDR/Vol.I — Whereas, Section 61A of the Representation of

the People Act, 1951, provides that the giving and recording of votes by voting machines in

such manner as may be prescribed, may be adopted in such constituency or constituencies

as the Election Commission of India may, having regard to the circumstances of each case,

specify; and

2. Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules,

1961, a printer with a drop box of such design, as may be approved by the Election

Commission of India, may also be attached to voting machine for printing a paper trail of

the vote, in such constituency or constituencies or parts thereof as the Election Commission

of India may direct; and

3. Whereas, the Election Commission has considered the circumstances in current

general elections to the Legislative Assemblies of Jharkhand & Maharashtra and bye

elections to 48 Assembly Constituencies and 2 Parliamentary Constituencies (as per

Annexure-1) announced vide the Election Commission’s Press Notes No. ECI/PN/

149/2024 and No. ECI/PN/150/2024 both dated 15^th October, 2024, and is satisfied that

sufficient number of Electronic Voting Machines (EVMs) and Printers for printing Paper

Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the poll in the

above said Assembly Constituencies. The polling personnel are well trained in efficient

handling of EVMs and ‘VVPAT Printers’ and the electors are also fully conversant with

the operation of the EVMs and the VVPAT Printers;

4. Now, therefore, the Election Commission of India, in exercise of its powers

under the said Section 61A of the Representation of the People Act, 1951, and Rule 49A of

the Conduct of Elections Rules, 1961, hereby specifies the Assembly Constituencies in

Jharkhand to be notified on 18.10.2024 & 22.10.2024; all the Assembly Constituencies

in Maharashtra to be notified on 22.10.2024; 47 Assembly Constituencies in various

States and Wayanad Parliamentary Constituency in Kerala to be notified on

18.10.2024; Kedarnath Assembly Constituency in Uttarakhand and Nanded

Parliamentary Constituency in Maharashtra to be notified on 22.10.2024 (as per

Annexure-1), as the constituencies in which the votes, shall be given and recorded by

means of EVMs and VVPAT printers in the manner prescribed, under the Conduct of

Elections Rules, 1961, and the supplementary instructions issued by the Election

Commission from time to time on the subject.

5. The Election Commission also hereby approves the design of EVMs and

VVPAT Printers as developed by the Bharat Electronics Ltd., Bangalore and Electronics

Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be

used for the giving and recording of votes in all the Constituencies.
