3/4/आईडी/2024/एसडीआर(पᳯरषद)—यतः, भारत िनवाᭅचन आयोग वषᭅ 2000 से लोक सभा तथा

िवधान सभाᲐ के िनवाᭅचनᲂ मᱶ िन᳸द᳥ पहचान द᭭तावेजᲂ के मा᭟यम से िनवाᭅचकᲂ कᳱ अिनवायᭅ पहचान कᳱ नीित का

अनुसरण करता आ रहा है ताᳰक िनवाᭅचनᲂ मᱶ ᮧितᱨपण को रोका जा सके िजससे लोक ᮧितिनिध᭜व अिधिनयम, 1951 कᳱ

धारा 62 के अंतगᭅत वा᭭तिवक िनवाᭅचकᲂ के मत देने के अिधकार को अिधक ᮧभावी बनाया जा सके; और

2. यतः, िनवाᭅचनᲂ का संचालन िनयम, 1961 के िनयम 35(3) और 37(2) (ख) के उपबंधᲂ के दृि᳥गत आयोग यह

िनदᱷश जारी करता रहा है ᳰक लोक सभा और िवधान सभाᲐ के िनवाᭅचनᲂ मᱶ िनवाᭅचक मतदान कᱶᮤ पर अपना िनवाᭅचन

फोटो पहचान पᮢ या अ᭠य िन᳸द᳥ द᭭तावेज ᮧ᭭तुत करᱶगे और उनकᳱ ओर से उᲦ िनवाᭅचन फोटो पहचान पᮢ या द᭭तावेज

ᮧ᭭तुत करने मᱶ िवफल रहने पर या इंकार करने पर उनको मतपᮢ ᮧदान करने या मत देने कᳱ अनुमित ᳰदए जाने से मना

ᳰकया जा सकता है; और

3. यतः, िनवाᭅचकᲂ कᳱ पहचान और ᮧितᱨपण के ᮧित सुरᭃोपाय से संबंिधत उᲦ ᮧावधान, '᭭ नातक' िनवाᭅचन

ᭃेᮢᲂ के िनवाᭅचनᲂ मᱶ भी समान ᱨप से लागू होते हᱹ और चूंᳰक इन िनवाᭅचन ᭃेᮢᲂ के िनवाᭅचक, िवधान सभा िनवाᭅचन ᭃेᮢᲂ

मᱶ भी िनवाᭅचक होते हᱹ, इसिलए उ᭠हᱶ उनके संबंिधत िवधान सभा िनवाᭅचन ᭃेᮢᲂ मᱶ िनवाᭅचकᲂ के ᱨप मᱶ िनवाᭅचक फोटो

पहचान पᮢ ᮧदान उपल᭣ध कराए गए हᲂगे;

4. अतः, अब, सभी सुसंगत कारकᲂ तथा िविधक एवं त᭝या᭜मक ि᭭थितयᲂ को ᭟यान मᱶ रखते ᱟए, िनवाᭅचन

आयोग, एत᳏ारा, यह िनदेश देता है ᳰक ितरᱟत ᳩातक िनवाᭅचन- ᭃेᮢ, से िबहार िवधान पᳯरषद के वᱫᭅमान उप-िनवाᭅचन

के ऐसे सभी िनवाᭅचकᲂ,िज᭠हᱶ एिपक जारी ᳰकये गये है, को 11 नव᭥बर, 2024 (सोमवार) को अिधसूिचत ितरᱟत

᭭ नातक िनवाᭅचन- ᭃेᮢ से िबहार िवधान पᳯरषद के वᱫᭅमान उप-िनवाᭅचन मᱶ मतदान करने के िलए मतदान के᭠ᮤᲂ

आने पर अपने मतािधकार का ᮧयोग करने िलए इन काडᲄ को ᮧ᭭तुत करना होगा। तथािप, ऐसे िनवाᭅचक जो

अपना िनवाᭅचक फोटो पहचान पᮢ ᮧ᭭तुत करने मᱶ असमथᭅ है, उ᭠हᱶ अपनी पहचान ᭭थािपत करने के िलए

िन᳜िलिखत वैकि᭨पक फोटो पहचान द᭭तावेजᲂ मᱶ से कोई एक द᭭तावेज ᮧ᭭तुत करना होगाः-

(i)

आधार काडᭅ;

(ii)

ᮟाइᳲवग लाइसे᭠स;

(iii)

पैन काडᭅ;

(iv)

भारतीय पासपोटᭅ;

(v)

रा᭔य/के᭠ᮤ सरकार, सावᭅजिनक ᭃेᮢ के उपᮓमᲂ, ᭭थानीय िनकायᲂ या अ᭠य िनजी औ᳒ोिगक

घरानᲂ ᳇ारा अपने कमᭅचाᳯरयᲂ को जारी ᳰकए गए सेवा पहचान-पᮢ;\

(vi)

सांसदᲂ/िवधायकᲂ/पाषᭅदᲂ को जारी ᳰकए गए सरकारी पहचान पᮢ;

(vii)

शैिᭃक सं᭭थाᲐ, िजसमᱶ संबंिधत िशᭃक/ ᭭ नातक िनवाᭅचन ᭃेᮢ का िनवाᭅचक िनयोिजत हो, ᳇ारा

जारी सेवा पहचान पᮢ;

(viii)

िव᭫ विव᳒ालय ᳇ारा जारी िडᮕी/िड᭡लोमा का मूल ᮧमाण-पᮢ;

(ix)

सᭃम ᮧािधकारी ᳇ारा जारी ᳰद᳞ांगता संबंधी मूल ᮧमाण-पᮢ;और

(x)

यूिनक िडसएिबिलटी आईडी (यूडीआईडी) काड़ᭅ, सामािजक ᭠याय एवं अिधकाᳯरता मंᮢालय,

ORDER

No.3/4/ID/2024/SDR(Council)—Whereas, the Election Commission has been

following the policy of compulsory identification of electors by means of specified

identification documents at elections to the House of the People and Legislative

Assemblies from the year 2000 onwards, so as to prevent impersonation at elections

thereby making the right of genuine electors to vote, under section 62 of the

Representation of the People Act, 1951, more effective; and

2. Whereas, keeping in view the provisions of Rules 35(3) and 37(2)(b) of the

Conduct of Elections Rules, 1961, the Commission has been issuing directions that the

electors at election to House of the people and Legislative Assemblies shall produce their

Electors Photo Identity Card or other specified documents at the polling station and failure

or refusal on their part to produce those Electors Photo Identity Card or documents may

result in the denial of supply of a ballot paper to them and permission to vote; and

3. Whereas, the said provisions regarding identification of electors and safeguards

against impersonation are equally applicable at elections from Graduates’ Constituencies,

and as the electors in these constituencies are also electors in assembly constituencies,

they would have been supplied with Electors Photo Identity Card as electors in their

respective Assembly Constituencies;

4. Now, therefore, after taking into account all relevant factors and the legal and

factual position, the Election Commission hereby directs that all the electors at the

current bye election to the Bihar Council from Tirhut Graduates Constituency, who

have been issued with their EPICs, shall have to produce these cards to exercise their

franchise, when they come to the polling stations for voting at the current bye election to

the Bihar Legislative Council from Tirhut Graduates’ Constituency, notified on 11^th

November, 2024 (Monday). However, those electors, who are not able to produce their

EPICs, will have to produce any of the following alternative documents for establishing

their identity: -

Aadhaar Card,

ii. Driving License,

iii. PAN Card,

iv. Indian Passport

Service identity card issued to its employees by state/Central government,

Public Sector Undertakings, Local bodies or other Private Industrial

Houses.

vi. Official identity Cards issued to MP's/MLAs/MLCs.

vii. Service Identity Card issued by the educational Institutions in which the

electors of the concerned Teachers’/Graduates’ Constituency may be

employed,

viii. Certificate of degree/Diploma issued by University, in original,

ix. Certificate of physical handicap issued by competent Authority, in

original,

Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment,

Government of India.
