The 6th December 2024
No-6-N-13-02/2014-1603(6).—In exercise of powers conferred under proviso to
Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the
following Rules to regulate selection, appointment, promotion and service conditions of the
Nursing Teaching Cadre under the Health Department:-
1. Short title, extent and commencement.—
(i)
These Rules may be called the “Bihar Nursing Teaching Cadre
Rules, 2024”.
(ii) It shall extend to the whole of the State of Bihar.
(iii) It shall come into force form the date of its publication in the
official gazette.
2. Definitions.-In these Rules, unless otherwise required in the subject or context-
(i)
"Government" means Bihar State Government;
(ii) "Department" means Health Department;
(iii) "Appointing Authority" means Director-in-Chief (Nursing), Health
Services, Bihar, Patna in the case of Tutor and the Government in the
case of Principal.
(iv) "Commission" means Bihar Technical Service Commission;
(v)
"Cadre" means Bihar Nursing Teaching Cadre;
(vi) "Appendix" means appendix appended to these Rules; and
(vii) "Recognized Institutions" means the institution recognized by the
State Government of Bihar or its authorised body but in the case of
institutions located outside of the State of Bihar, must comply with
Suitability conditions as per Indian Nursing Council, New Delhi.
3. Constitution of cadre.—The cadre of Bihar Nursing Teaching shall be at the
State level and academic cadre. In this cadre total number of posts in the cadre shall be such
as may be sanctioned by the government from time to time. The ratio of women and men
employee in this cadre will be as much as determined by the Indian Nursing Council, New
Delhi and the State Government from time to time. Employees appointed/promoted and
working on the post of the cadre provided of appendix of these rules, before the enforcement
of these rules, will be considered automatically included in this cadre and their previous
mutual seniority will remain intact.
4. Chain of posts of cadre.— Different categories and chain of posts of this cadre
shall be according to the appendix.
5. Recruitment.— The appointment in this cadre shall be made by direct
recruitment to the basic category posts of Tutor (Nursing) through competitive examination

and on the basis of recommendation of the Commission through the procedure laid down in
the rules 8(ii).
6. Qualification.— (1) For appointment by direct recruitment to the basic category
posts, minimum educational qualification shall be pass in M.Sc Nursing or B.Sc. Nursing
(Basic/Post Basic) or Diploma in Nursing Education and Administration course of the
duration determined by Indian Nursing Council from time to time from a recognized
institute along with two years of professional work experience and related certificate, but in
case of institutes located outside of the State of Bihar suitability as per norms of Indian
Nursing Council, New Delhi shall be mandatory. A valid of registration of candidates from
Bihar Nursing Registration Council shall also be necessary.
7. Age Limit.—
(i) The minimum age limit for direct recruitment will be 21 years and the
maximum age limit will be the same as decided by the General
Administration Department, Government of Bihar from time to time in
respect of different categories including reservation categories.
(ii) Any applicant who has rendered service on contract in any
Government/Non-Private (Central Government, Panchayat, Municipal
Corporation etc.) under health facilities/hospitals situated in the State of
Bihar shall be given relaxation in maximum age limit equal to the period of
work done earlier on the same post. Such relaxation will be admissible
even in respect of service rendered for part of a particular year, however
benefit will accrue only for the period of actual service done on contract.
Provided that appointment on contract should have been done on the basis
of selection and following the policy of reservation in the State of Bihar at the
time of contract appointment and appointment should have been done by
competent authority against duly sanctioned post. In such cases instructions
issued by General Administrative Department from time to time shall be
followed.
(iii)
1st August of the concerned year shall be cut-off-date for determination
of age.
8. Procedure of recruitment.—
(i) The appointing authority, after calculating the vacancy as on 1st April of the
year and getting roster cleared, shall send category wise requisition to the
Commission as far as practicable by 30th April of the same year.
(ii) In view of the requisition, the Commission shall invite application by
advertising the vacancies and shall prepare a merit list on the following basis:-

Nursing Council will be based on the syllabus).

Explanation:- Allowance shall be given to any candidate for the marks obtained in
the competitive examination. The marks to be awarded will be
determined by multiplying the percentage of total marks obtained in
the competitive examination by a factor of 0.75. For example, if a
candidate has secured 50 percent marks, then he will be awarded
50x0.75 = 37.5 marks.
(iii) The Commission will prepare the merit list as per the category wise
requisitioned vacancies on the basis of the above mentioned sub-rule (ii) and
will send its recommendation to the department. The department will
thoroughly check the certificates of the recommended candidates. Thereafter,
the concerned appointment authority will get the candidates health test, police
verification (of antecedents) and will make the appointment by following the
appointment
related
quidelines
issued
by
the
government
(General
Administration Department) from time to time.
9. Appointment/Posting.— The appointment and posting of tutors of Bihar Nursing
Teaching Cadre will be done in ANM/GNM Nursing Institutes of the Government Sector of
the State. Tutors who have completed one year of teaching experience can also be posted in
B.Sc Nursing Colleges as per the requirement.
10. Probation period.— After direct appointment to the post of Tutor (Nursing) on
the recommendation of the commission, the probation period will be of one year, If the
service is not found satisfactory during the probation period, the probation period can be
extended for the next one year. If the service is not found satisfactory even in the extended
period, the appointing authority can discharge such Tutor (Nursing) from service.
11. Confirmation.— The service of the Tutor (Nursing) may be confirmed by the
appointing authority on satisfactory completion of the probation period, completion of
prescribed induction training, passing all papers of prescribed departmental examination and
fulfilling other service conditions prescribed by the department, from time to time. Separate
guidelines will be issued regarding training and departmental examination.
12. Seniority.— The seniority of Tutor (Nursing) will be determined according to
the merit list prescribed by the commission.
13. Chain of Posts of Promotion.—
(i)
A Tutor (Nursing) confirmed in service may be considered for promotion
to higher post as provided in the Appendix of these Rules on the basis of
seniority-cum-merit on completion of qualification and experience/
service period prescribed by the Indian Nursing Council, subject to
availability of vacancy.
(ii) While considering promotion, it will be mandatory to follow the
instructions issued by the General Administration Department from time
to time regarding promotion and tenure and instructions issued regarding
in sealed envelope system etc. regarding character or PAR.
14. Departmental Promotion Committee.—
(i)
Promotions will be considered on the basis of recommendations of the
Departmental Promotion Committee.

(ii) The Departmental Promotion Committee shall be constituted by the
Department by a separate order.
15. Transfer of Tutor (Nursing).—The transfer of Tutor (Nursing) shall be
governed by the extant Rules/Regulation/Directions of the Department of Cabinet
Secretariat, Government of Bihar.
16. Reservation.—It shall be mandatory to comply with the provisions of the
Reservation Act of the Government and the reservation roster issued by the Government
from time to time for direct recruitment and promotion.
17. Delegation of power.—Keeping in view the ease of work, the Appointing
Authority made delegate same of its powers to the Civil Surgeon-com-Chief Medical

Hospital/Director concerned Superspeciality Hospital.
18. Residuary Matter.—In the matters for which provisions have not made in this
rules, the provisions of the relevant Code/Rules/Resolution/Instruction of the Government
shall apply.
19. Removal of doubt.—If any doubt arises with respect to interpretation of any
provisions of these Rules, it shall be referred to the Department and in this respect the
decision of the Department after consultation with the Law Department shall be final.
20. Removal of difficulties.—If any difficulty arises in implementation of
provisions of these Rules, the department may remove such difficulty after consultation with
the Law Department by such order which is not inconsistent with the provisions of these
Rules.
21. Repeal and Savings.—
(i)
The Bihar Nursing Cadre Rules, 2019 are hereby repealed with effect from
the date of coming into force of these rules.
(ii)
Notwithstanding such repeal, anything done or any action taken under the
aforesaid rules shall be deemed to have been done or taken by these rules as
if these rules were in force on the date on which such thing was done or such
action was taken.
