No. 06/Estt.Misc.-32/2021/2255/Agri—In exercise of the powers conferred under

article 309 of the constitution of India, the Governor of Bihar is pleased to make the

following rules to regulate the recruitment and other service conditions of the posts of

"Stenographer Cadre" in the Agriculture Department, Bihar, Patna :-

Short title, Extent and Commencement-

(i)

These rules may be called the Bihar Agriculture Department

Stenographer Cadre (Recruitment, Promotion and Service Conditions)

Rules, 2025.

(ii) It shall extend to the whole of the State of Bihar.

(iii) It shall come into force from the date of its publication in the gazette.

(iv)

These rules will be applicable to the entire Agriculture Department

except

the

personnel/offices

covered

under

Bihar

Stenographer Service Rules, 2006 (as amended from time to time) issued

by the General Administration Department.

2. Definitions- In these rules, unless the context otherwise requires :-

(i)

“Government” means the Government of Bihar;

(ii)

“Appointing

Authority”

means

the

Additional

Chief

Secretary/Principal Secretary/Secretary, Agriculture Department, Bihar,

Patna;

(iii)

“Department” means the Agriculture Department of the Government of

Bihar;

(iv)

“Cadre” means the Bihar Agricultural Department Stenographers Cadre;

(v)

“Commission” means the Bihar Staff Selection Commission;

(vi)

“Member” means any person appointed to the cadre which shall include

all persons appointed to the cadre before the coming into force of these

rules;

(vii) "Vacancy" means a vacancy arising in a particular year from the

creation of new posts in the service, retirement, death, removal from

service and demotion;

(viii) “Appointed Date” means the date on which these rules come into force.

3. Structure of the Cadre.-

(a)

Bihar Agriculture Department Stenographer Cadre will be a state level

non-gazetted cadre, whose structure will be as follows :-

(b)

The sanctioned strength of the said posts shall be as may be approved by

the government from time to time.

(c)

The grade pay/pay level of the said posts will be the same as may be

approved by the state government from time to time.

(d)

Employees appointed and working on regular basis before the appointed

date shall be deemed to be automatically included in the posts of

equivalent level in this cadre.

4. Reservation.-The provisions of reservation/roster notified by the state

government from time to time shall be applicable in appointment/promotion to

the service or cadre.

5. Appointment in Basic Category. -

(i)

Appointment to the post of Stenographer, Grade III in the substantive

category shall be made by direct recruitment by the appointing authority

on the recommendation of the Bihar Staff Selection Commission.

(ii)

The appointing authority shall calculate the vacancies on the basis of 1st

April of each year and send the requisition to the commission by 30th

April of each year.

(iii)

The commission shall publish advertisement of vacancies and select

successful candidates on the basis of competitive examination and

recommend the names of the candidates in merit order to the appointing

authority. The validity of the merit list shall be one year from the date of

receipt of recommendation.

(iv)

After due investigation the appointing authority will appoint the

recommended candidates.

6. Educational Qualification.-

(a)

The minimum educational qualification for appointment in the

stenographer cadre will be passing intermediate or its equivalent. Along

with this, it will also be necessary to have knowledge of shorthand/typing

and basic knowledge of computer/word processing.

(b)

The minimum age for recruitment shall be 18 years and the maximum

age shall be as determined by the state government (General

Administration Department) from time to time.

(c)

Eligibility Test :-

(i)

Hindi dictation will be checked by dictation for 4 minutes at the

speed of 80 words per minute. Before starting dictation, one

minute dictation check (dictation writing) will be given. 20

minutes will be given to type the dictation. Apart from this,

candidates will be given 2 minutes for correction before starting

typing. Correction of typing of dictation will have to be done

within the time prescribed for typing. To pass the typing of

dictation, there should not be more than 10 percent mistakes

otherwise they will be declared disqualified.

(ii) Apart from dictation, candidates will have to type 300 words in

Hindi at the speed of 30 (thirty) words per minute on computer in

10 minutes. To qualify in this, there should not be more than one

and a half percent mistakes otherwise they will be disqualified.

7. Seniority.-

(i)

The mutual seniority of the members of the cadre shall be at the state

level and the mutual seniority of the members of the service shall be

determined in accordance with the principles and procedures determined

by the General Administration Department, Bihar, Patna.

(ii)

The department shall publish a consolidated seniority list after re-

determining the mutual seniority of the members of the cadre as

determined before these rules come into force.

(iii)

The seniority of the personnel appointed by direct recruitment on the

basis of competitive examination shall be determined in accordance with

their merit position as determined by the commission.

(iv)

The seniority of the employees automatically included in any hierarchy

of the cadre on the appointed date will be determined on the basis of their

date of promotion to the respective hierarchy. If the date of promotion is

same, then the seniority will be determined on the basis of their date of

first appointment in the cadre and if the date of first appointment is also

same, then the seniority will be determined on the basis of their age on

the appointed date.

8. Probation Period- Members of this cadre appointed through direct recruitment

on the recommendation of the commission will be on probation for 01 (one)

year. If the service is not satisfactory during the probation period, it can be

extended for 01 (one) more year. If the service is not satisfactory even during the

extended period, the service can be terminated.

Training- It will be compulsory for the employees of the Stenographer cadre to

undergo training as prescribed by the government from time to time. If any

examination is fixed at the end of the training, it will be compulsory to pass it.

10. Departmental Examination and Syllabus- Employees appointed through

direct recruitment of the cadre will have to pass all the papers of the

departmental examination as determined by the Central Examination

Committee, Revenue Board. However, the employees who have passed the

departmental examination conducted by the Agriculture Department prior to

this notification shall be exempted from the departmental examination

conducted by the Revenue Board.

11. Confirmation- For salary increment and service confirmation, it will be

necessary for the personnel appointed by direct recruitment of the cadre to pass

the Hindi note drafting test and the departmental examination conducted by the

Revenue Board.

12. Promotion-

(a)

Promotion to higher posts in the cadre may be made on the basis of

seniority-cum-merit on the recommendation of the Departmental

Promotion Committee.

(b)

The reservation provisions as prescribed from time to time by the

General Administration Department for promotions in the state

government services shall apply.

(c)

The Departmental Promotion Committee shall be constituted by the

department by a separate order.

13. Residual matters- In cases where specific provision has not been made in

these rules, the employees of this cadre will be covered by the provisions made

for employees of equivalent level in the state government.

14. Removal of Difficulty-

(i)

Additional Chief Secretary/Principal Secretary/Secretary, Agriculture

Department, Bihar, Patna will be competent to interpret the rules of these

rules.

(ii) The department may, by order published in the official gazette, remove

any difficulty arising in the implementation of any rule of these rules.

15. Repeal and Avoidance-

(i)

All Circulars/Instructions/Resolutions issued regarding appointment/

service conditions etc. of the personnel of this cadre before the

appointed date shall be deemed to have been repealed.

(ii) Notwithstanding such repeal, anything done or any action taken under

any earlier circular/instruction/resolution shall be deemed to have been

done or taken under these rules as if these rules were in force on the day

on which such thing was done or such action was taken.
