THE BIHAR CONTINGENCY FUND (AMENDMENT) ORDINANCE, 2025
AN
ORDINANCE
TO AMEND THE BIHAR CONTINGENCY FUND ACT, 1950
(BIHAR ACT 19 OF 1950).
Preamble – WHEREAS, in a year, it is essential to provide disaster relief to victims
affected by unforeseen potential disasters;
AND WHEREAS, to ensure the availability of funds for the timely implementation
of important schemes recommended by the State Government, and for several projects for
which central assistance is to be received from the Government of India but corresponding
budget provisions have not been made, and the central share of such projects must be
expended within a defined period;
AND WHEREAS, Currently, the provision to temporarily increase the permanent
corpus of ₹350 crore of the Bihar Contingency Fund upto 4% of the expenditure budget
has proven inadequate. It is necessary to increase this limit to 10% and after the increase, it
shall be sufficient to use one-tenth (1/10th) of the increased amount only for relief and
rehabilitation measures due to natural disasters. Hence, it is necessary to make changes in
the present provision.
AND WHEREAS, the Legislature of the State of Bihar is not in session,
AND WHEREAS, the Governor of Bihar is satisfied that circumstances exist which
render it necessary for him to take immediate action to amend the Bihar Contingency Fund
Act, 1950 (Bihar Act 19 of 1950) in the manner hereinafter appearing.
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article
213 of the Constitution of India, the Governor of Bihar is pleased to promulgate the
following Ordinance:
1. Short Title and Commencement.—
(1) This ordinance may be called the Bihar Contingency Fund (Amendment)
Ordinance, 2025.
(2) It shall come into force at once.
2. Amendment of Section 4A of the Bihar Contingency Fund Act, 1950.— Section
4A of the Bihar Contingency Fund Act, 1950 (Bihar Act 19 of 1950) shall be substituted as
follows:-
"4A Temporary Corpus.— In the period starting from the date of
commencement of the Bihar Contingency Fund (Amendment) Ordinance,
2025, to 30th March of every year, if it requires to increase the permanent
corpus of the contingency fund beyond ₹350 crores, the same may be
enhanced temporarily by the Cabinet which is maximum up to 10% of the

expenditure budget of that year up to 30th March of that financial year.
One-tenth (1/10) of the amount which has increased, will be used only for
relief and rehabilitation measures due to natural calamities."
